28. The applicant is requesting a mixed use consisting of a real estate office which is
allowed in the CHV Zoning District, and an outdoor vehicle sales lot which requires
a special exception according to Sec 90-283.(18).

30. The business for which the special exception is sought is outdoor vehicle sales. The
business would be for the sale of used vehicles. Other than a small sales office
within the existing remodeled structure, sales and display of vehicles would be
outside. There will be 2 - 4 employees.
The proposed hours of operation will be 10:00AM to 8:00 PM on weekdays, and
10:00AM to 9:00 PM on weekends.

RESPONSE TO ITEMS 31 AND 32 OF APPLICATION
1. Demonstrate that the proposed location and site are appropriate for the use
The proposed location is on the north side of Park Street (SR 70) at the
Intersection with NW le Ave. The area is surrounded by commercial and
professional uses, including an automotive repair shop. There is an existing
access on Park Street that will be utilized, and well as an existing driveway on
NW le Avenue. A preliminary plan is included to show that the site is adequate
for the intended use.
2.
Demonstrate how the site and proposed buildings have been designed so they are
compatible with the adjacent uses and the neighborhood, or explain why no specific
design efforts are needed.
See the attached preliminary plan. The existing single family home will be re-
modeled to accommodate a professional and vehicle sales office as well as a
handicap equipped restroom.
3.
Demonstrate any landscaping techniques to visually screen the use from adjacent uses;
or explain why no visual screening is necessary.
There will be a 10 foot wide landscape buffer along the south and west property
lines (Park St and NW 10d), and a 2 foot wide landscape buffer on the north and
east sides. The adjacent use on the east side is a professional office. The existing

trees and proposed landscaping will minimize any visual impact of this business.
There is one residence located to the north of this parcel and separated by an
alley. This residence is located well away from the outside sales area that is
proposed and landscape buffering will be provided to minimize any visual
impact.
4.
Demonstrate what is proposed to reduce the impact of any potential hazards, problems
or public nuisance generated by the use; or how the nature of the use creates no such
potential problems.
There should be no hazards or problems associated with the proposed use. The
impact of the small proposed outside vehicle sales would certainly be less than
that caused by some of the permitted uses in the CHV District such as
restaurants, nightclubs, and hotels.
5.
Demonstrate how the utilities and other service requirements of the use can be met.
The existing residence on site is currently served by public utilities. The
proposed use will not create additional demands for potable water or sanitary
sewer needs. The existing utilities currently serving this property will be
adequate for the proposed use.
6.
Demonstrate how the impact of traffic generated will be handled, off site and on site.
The existing traffic generated by the current single family residence is as follows.

RESPONSE TO ITEM 32 OF APPLICATION
1.
The use is not contrary to the Comprehensive Plan requirements.
The future land use classification of this parcel is commercial. We believe the
granting of this special exception is consistent with that classification.
2.
The use is specifically authorized as a special exception use in the zoning district-
The outdoor vehicle sales use is specifically stated in Section 90-283.(18) of the
regulation.
3.
The use will not have an adverse effect on the public interest.
The granting of this special exception should not have an adverse effect on the
public interest. The surrounding land use and zoning is commercial and there
are similar uses existing nearby.
4.
The use is appropriate for the proposed location, is reasonably compatible with
adjacent uses and is not detrimental to urbanizing land use patterns.
We believe the proposed use is compatible with adjacent uses, and is appropriate
for this area. Surrounding uses include convenience store, automotive shop,
professional offices, and retail sales.
5.
The use will not adversely affect property values or living conditions, nor be a
deterrent to the development of adjacent property.
This proposed use should enhance property values and assist in the development
•
of adjacent properties. Its current use as a residence does not encourage
development of adjacent business properties.
6.
The use may be required to be screened from surrounding uses to reduce the impact of
any nuisance or hazard to adjacent uses.
The only surrounding use that is not compatible with this request is the residence
located to the northeast side of this property.
7.
The use will not create a density pattern that will overburden public facilities such as
schools, streets, and utility services.
Due to the size and type of use proposed, there will be no adverse affects to public
facilities.
8. The use will not create traffic congestion, flooding or drainage problems, or otherwise
affect public safety.
The proposed use will not create traffic congestion, flooding, or drainage
problems. The Florida Dept. of Transportation has been contacted and will
allow the use of the existing driveway with some modifications. Drainage will be
designed in accordance with all regulations and the impacts from additional
impervious areas will be attenuated.
