A. Present Phil Conroy with a 15-Year Service Award. Mayor Kirk presented a Longevity Service Certificate and engraved mantel clock to Mr. Phil Conroy, in appreciation for
his 15-years of service to the City. He was hired May 31,1994 as a Firefighter/EMT to the Fire Department. Mr. Conroy
thanked the Mayor and Council for the opportunity to serve the community.

(Highway 441/SR 15) - Leland Dyals (Exhibit 1). existing building on Lot 16 (the former location of Jetson's Rent -to -Own). Lot 15 once was occupied by a residence
that has since been demolished. When the Florida Department of Transportation (FDOT) was contacted to review the
proposed site plan, Mr. Dyals was advised that the existing curb cut for access to Lot 15 directly off North Parrott
Avenue could not be used.
Enclosed with Exhibit One were copies of a -mails explaining FDOT's decision. According to Mr. Larry Ransom of the
Sebring FDOT office, the City permitted the original building (on Lot 16) to be constructed close to their right-of-way
line so that now there is no room for parking without encroaching in the right-of-way. FDOT installed a driveway cut,
during the widening project, approximately 88 feet from the intersection of Northeast 9' Street & North Parrott Avenue.
This was to access a small house that was there at the time and has since been demolished. The original building on
Lot 16, was a rental storage which is proposed to be a church outreach center with a shell parking lot to the North.
There is presently an unpaved alley abutting the East of the property which runs from 9th to 10th Streets. His opinion
is, the existing connection on North Parrott Avenue does not meet spacing and that there is access from Northeast
9' Street (through the North to South alleyway). The issue of the refusal of parking by the City should be resolved
between the future property owner and the City prior to purchasing the parcels.

for a residence, which has been demolished. Since that demolition, they would expect to have the connection
upgraded to their present standard, which is currently listed as a Class-5 Section of Roadway with a speed limit
between 36 and 45 MPH. This calculates to a spacing requirement of 440 feet. The Department does acknowledge
the fact that your client's property is not wide enough to accommodate such spacing, there is reasonable access to
these parcels from Northeast 9th Street and the alley that abuts the Eastern boarder. It would be a recommendation
by FDOT that should your client continue with this proposed use of land, that the existing curb cut, be removed and
replaced with a full profile curb section to match the adjoining curb.
Mr. Dyals explained that his clients want to pursue the measure further with FDOT and is asking the City to submit a
letter supporting their use of the curb cut so that ingress and egress to the parking area would be accessible from
North Parrott Avenue, not through a 15-foot wide alleyway behind the building.
Council discussed the area, and the problems that would arise from the only access to the parking lot being a 15-foot
wide alleyway, and the purpose of alleys. Attorney Cook was directed to draft a letter as soon as possible, in
support of the Church of God of Prophecy's pursuit for use of the curb cut.
B. Consider proposed Health Insurance Plans - City Administrator and Priorto the start of the meeting, material was distributed regarding research for Health Insurance Plans. The materials
Scott Harris. consisted of a spreadsheet of the existing Aetna Plan, renewal of the current plan; two options through local
representative, Scott Harris, "Aetna Choice POS O409," and "HMO Open Access 0909;" as well as a quote for Blue
Option 1749 from PRM (City's worker's compensation and liability carrier). An e-mail from the Florida League of Cities
outlining what they could offer, without actual premium amounts. A third document consisted of, spread sheets from
PRM of five various plans they could offer the City, as well as a printed power point presentation.
A discussion was held between Accounts Supervisor Riedel, Mr. Harris and the Council on what is the best option for
employees to keep the most coverage without overly increasing out-of-pocket expenses and a premium that is
affordable to the City as well. Council Member Watford moved to go with the Aetna 0409 Health Insurance Plan
and allow emplovees to "buv up" to the current plan (Aetna Choice POS) if thev desire: seconded by Council
Member Markham.

B. Consider proposed Health Insurance Plans - City Administrator and Council Member Watford asked Mrs. Riedel, we are assuming you and Mr. Whitehall have looked at all the plans, and
Scott Harris continued. these are the best of the best, basically your recommendation? Mrs. Riedel answered, yes sir, there was an array we
could have chosen from, we picked plans that were most comparable to our current plan. The annual anniversary date
of the health insurance contract was discussed. Mr. Harris explained that the City's contract is considered in the third
quarter, each quarter increases slightly, so should they decide to move the contract date, there is a chance that the
premiums could increase further.

Dear Mr. Ransom:
At our regular meeting of the City Council on June 2, 2009, an agenda item concerned
the vacant commercial property located at 902 N. Parrott Avenue, which would be the structure
immediately North of N.E. 9`h Street on Highway 441/SR 15, at the request of local businessman
Leland Dyals.
As you are aware, the property owners are seeking to make an arrangement with a local
church to use the structure for their purposes, and they have requested that the existing curb cut
approximately 100' North of the intersection of N.E. 9`h Street remain open for access to the
property. It is reported that the MOT response was that the curb cut should be closed by
construction of a regular curb, due to other access available to the property.
I am very familiar with this parcel, as at the time N.E. 9a' Street was improved by the City
in approximately 2004, it became known that the existing parking area on the South side of the
building encroached onto the city road right of way. As a result, it was paved with asphalt, at a
depth unsuitable for vehicular parking. Over the years, several commercial business owners have
inquired about purchasing the property, but are informed upon requesting a development permit,
that the site is not capable of development due to Iack of off street parking.
The only other point of access is the alley to the East of the structure; however, such
access is not permitted under city codes for commercial structures, and the width and location of
utility services in the alley make it unusable for vehicular access in any event. As we understand,
the owner plans to permit the church to make use of the adjacent lot to the North of the structure
for parking, which is accessed by the referenced curb cut from Hwy 441/SR 15. It is the request
of the city council to permit that curb cut to remain in its present condition.

This parcel has been abandoned for several years, and the members of the city council
would appreciate that MOT would permit the curb cut installed by FDOT when the roadway
was four-laned, to remain as the only point of access to the parcel.

Dear Mr. Cook:
At our Access Management meeting on June 23, 2009, the department discussed the project on
902 North Parrott Avenue, which is located at the corner of N.E. 91h Street and U.S. 441.
This roadway has an Access Management Classification of 5, with a posted speed limit of 40
mph as defined in Administrative Rule 14-97. The spacing standard for this classification is 245
feet between existing connections. This connection does not meet that standard.
During a roadway project on U.S. 441, the Florida Department of Transportation installed a curb
cut at the location as a replacement for the existing driveway. The parcel formerly contained a
single family residence, which has been removed. As you stated in your letter, the parcel has
been abandoned for several years. This constitutes a significant change, as defined in 335.182 of
Florida Statutes.
Therefore, the department requires the Permittee to close the curb cut, as the connection poses a
safety and operational problem on the State Highway System. Furthermore, adequate and
reasonable access can be obtained from N.E. 9th Street.

City Council meeting of June 2, 2009
New and Unfinished Business:
• Leland Dyals aDDearance — representing the Church of Gad of Prophecy
requesting the City's endorsement to utilize an existing curb cut
(previously denied by FDOT) to access a future Outreach Center.
• Group Health Insurance — As mentioned in the last report, the City
received notice of an 18.9% premium increase. I've tried to pull all the info
together considering we have no June 16th mtg. Therefore the matter is
added to this Agenda, but we will have to review all info at the meeting as
it becomes available.
• Handicapped (chair lift) accessibility to City Hall — Open bids for the
project on July 7t , a mandatory attendance pre -bid conference is
scheduled for June 23rd. The City has separate quotes to move electric
and plbg out of the war of the project.
• Bathroom remodel 2" Floor — finishing up this much needed ADA
compliance project using our personnel w/ minimal cost.
• ADA compliance — I requested a quote from a compliance firm and below
is the response. In my opinion the price, especially in this environment is
prohibitive.
Full ADA inspection of the building (City Hall only) and written report.
Report addresses all violations and provides the lowest cost corrective
recommendations. Reports include state and federal ADA codes,
diagrams and digital photos.
Secondly, I consult the all involved parties until the project is
completed to make certain the items in my report are successfully
complied with.
Lastly, I conduct a post compliance inspection, issuing a new report
that documents the building is now compliant as per my report. This
report includes a notarized affidavit of compliance.
Please see attached references for your perusal.
The fee for the above services is $4500.00. Fee is due within 30 days
from initial inspection report submission.

City will help us coordinate w/ the County and set up a committee. We will
be soliciting for those committees, and yes Councilman Watford, you may
sit (or Chair) the `Float Committee'.

the last State legislative session of which is attached.

• Radio (SLERS) system — As of this date l still do not have an Agreement
prepared for the City Council from the County consultant.
• Railroad Depot — No progress!
• Shop locally initiative — As indicated prior hereto, met with the Ec Dev Council
and the Chamber w/ a Group that will eventually be the `Our Okeechobee'.
• Animal Control Interlocal Agreement - No meeting has been rescheduled
with the County (the County called this meeting a few weeks ago to, I
suspect discuss increasing fees).
• Allev use Agreement — Steve Nelson, Okeechobee Drugs, contacted the City
about the applicability of our Alley use Agreements, as it relates to the
improvements he made to the alley behind his store. He indicated he may attend
a meeting in May. What may make this a mute point is that Donnie and l have
been working on prelim design to refurbish the all the alleys, incl this one w/ the
next asphalt program... haven't explained this to Mr. Nelson tho'
• City motto —The motto: `Hospitality lives in Okeechobee'
• Main Street `adopt a median' proiect - Some time ago the City was approached
from a few businesses about a median/blvd maintenance program wherein the
business is recognized w/a sign. The Council kind of shelved the idea due to
'commercialization', I think, on the sign placement issue. The Main Street
approach may be a better plan and they supplied a sample Agreement. Please
advise if you wish to have this matter re-evaluated?
• County special assessment —EMS/Ambulance — as you are aware, the County is
in the midst of analysis and recommendation of methodology to incorp the
revenue assessment which includes CITY residents.
• Treas Coast Council of Local Governments Okeechobee mt — Notice of the
Marvin Wherrell Memorial BBQ on July 1st at IRSC, mtg at 10AM, w/
Congressman Rooney as the guest (RSVP to Robin by 6117109) We want to be
well represented!!

Attorney:
• NW 12 St. 800 blk property — The Council took action to accept ownership of the
nuisance property in lieu of essentially foreclosing on $20, 000 +/- in liens for that
property and the property at 803 NW 12th St. and has cleaned up the property.
The property is then to be transferred to Habitat for Humanity.
• Billboard disputes) - Atty Cook wrote a letter to plaintiffs indicating the
City adopted a new ordinance and inquiring about the status of suit.
Finance:
Recognition letter from the Econ Council was distributed a week or so
ago, applauding the City's "responsiveness and conservative fiscal policy".
Budget/Revenue study — Staff met with Ken Small, FL Leag, on 3/26 to review all
sorts of State and local issues. Over the next few months we will try to unveil
some of the ideas in connection with the budget.

Fire:
• Controlled burn on the following properties as per Chief Smith:
1) VNA abandon home — May 29th
2) Taylor/Brown abandon house on NW 9th — May 30th
General Services:
• Added a new Vendor Pref form to bidding doc.
• The 5/21/09 Tech Review Comm allowed an expansion at Big Lake eye
care, incl a 2" floor apartment. The Baptist Church project had several
improvement issues and approval was delayed until the June TRC.
• The 5/21/09 Planning Bd considered one application. The property at 909
NW Park (SR70) owned by Linda Bridges to eventually propose a car
sales lot. A special exception was approved. The matter must pass
technical review which has been an obstacle the last cpl of times the
engineer approached the City on other proposed uses.
Police:
Grant award for video equipment Rec'd confirmation today from the
Justice Dept that the City was awarded $15,000 +/- for the latest camera
equip for three vehicles. Congratulations to Officer Zeigler and the PD!!
Law Enf Trust Fund — some time ago the City stopped seizing and compounding
properties (ex. Cars) associated with drug arrests because there was a pending
court case that challenged local jurisdictions ability. Apparently that case has
been completed and local law enf agencies are again seizing property. Chief
Davis has requested clarification from Atty Cook on the matter.
Public Works:
• Water Supply Facilities Plan — Bill Brisson, John Hayford and I had a mtg
aft the 5/21/09 TRC meeting to review progress. We reviewed SFWMD
assertion that there is an expired Consumptive Use Permit. OUA provided
communication that they are operating under the existing permit and the
renewal is being worked on. OUA provided, thru Kimley-Horn, the
County's draft Plan.
• Canal spraying - being done this week again
• OUA proiect on SE 7th St — As a reminder staff met with OUA several
months ago and they agreed to reimburse the City 50% of the asphalt

• Stimulus -funded sidewalk program — Confirmed with FDOT that they will be
bidding the project, due to impossible time -restraints on the City (their
interpretation) ... expect bids to be reed in August.
• DOT and CSX crossing —CSX is estimating one week, between 7/1/09 and
8/15109. One concern is that, according to their plans, 441 will be completely
closed during that time and all traffic will be diverted to NW 9th Avenue.
• Work program — will be participating in the CORE (Comprehensive Offender
Rehab Program), court ordered community work program, with participants
working on cleaning/weeding etc. mostly on weekends.
• Machine Building — After taking quotes a few month ago for the purposes of
determining a budget of about $60-65, 000 we are now putting bid specs together
for a 60' X 100' (12' eave height) building to be located on the north side of the
existing east garage at the `City barn' area.
Employee Spotlight: Jeff Adams
While Jeff's probationary period was extended, DPWks Robinson
elaborated as follows:
Performance is standard, however, exceptionally good with the
sprinkler systems. Eager to learn and works well with other
employees. Takes direction very well. Jeff is very dependable and
is beginning to train on heavy equipment. Jeff and I have a very good
relationship. Jeff has achieved the level of working knowledge in
approximately six months that most employees achieve in 2 years. I am pleased with his
progress and workmanship.

2009 Legislative Session Up -date
Thank you for the opportunity to represent your issues in Tallahassee during the 2009 Legislative
Session. Even though this was a year when there was no funding for local projects we were able
to stop legislation that would have had a negative effect on the City and residents, resulting in a
negative impact of many dollars.
1. Drivers License Offices -Again this year the issue of closing local driver's license
offices came into play. Following up from last year Ken, Connie and Dale using
directives from last session worked to assure that local Okeechobee area offices were
not allowed to enter considerations for closing.
2. HB 691 and SB 1192 - These Bills were originally designed to require the Public Service
Commission to monitor the FGUA, however the manner in which they were written was
too broad and would have brought the Okeechobee Utilities under PSC monitoring. This
would have been expensive to local residents. There could have been up to 4.5% of a
utility operation budget assessed for this monitoring. We worked to have this Bill die in
committee until it could be amended in order to not place hardships on rural utilities.
This Bill will resurface next year. We have an assurance that as the Bill is worked on
during the summer that we will have input to protect Okeechobee areas. — Died in
Committee.
3. SB 1922, Sovereign Immunity — This Bill would have placed counties, cities and school
districts in the position of having to defend against issues that are now considered
sovereign immunity. This is an issue that we worked hard on and the Bill died in
Committee.
4. Solid Waste Tax — We worked to see provisions removed or defeat the solid waste tax
that would have been required to be paid to the State in the amount of $1.25 per ton_
This also did not pass.
5. Payment in -lieu of Taxes (PILT) — IIB 2080 now provides that whenever SFWMD
removes properties from the tax rolls for environmental purposes that a payment in -lieu
of taxes will now be paid in perpetuity. This can result in additional revenue for the
affected local government.
