A. Petition No. 09 -002SE submitted by H. L. Bennett, Engineer on behalf of property owner Linda L. Bridges. 1. Hear from Planning Staff to outdoor vehicle sales lot for property located at 920 NW Park Street. 2. Hear from the Property Owner or designee /agent. 3. Open Public Hearing for public comment Chair. 4. Close Public Hearing Chair. 5. Board Discussion. 6. Consider motion and vote. Mr. Brisson addressed the Board regarding the LaRue Planning and Management Staff Report. He commented on how thoroughly the petition was completed. As per the petition, the requested use is also a special exception. This will change the residence from non conforming to a special exception use. Traffic study was supplied and no excessive traffic will be realized. Landscaping for buffering the North boundary will be provided. There are no problems with density. Petition meets all required codes, therefore we are recommending approval. Mr. H. L. Bennett, P.E. addressed the Board representing the applicant. Mr. Bennett stated the applicant lives in Fort Lauderdale and stays at the residence when she is in town. He spoke about the surrounding zoning as being compatible with the petition and reported having the permit from DOT for ingress /egress on SR70. Chair Maxwell opened the Public Hearing, there were no comments. Chair Maxwell closed the Public Hearing. MAY 21, 2009 PLANNING BOARD /BOARD OF ADJUSTMENT AND APPEALS PAGE 2 OF 3 Board asked about parking. Mr. Brisson explained that would be addressed at the Site Plan Review. Board also asked whether another outdoor vehicle sales lot would encumber any future uses. Mr. Brisson replied he suspected not, due to being on the commercial corridor. He stated people are trying to encourage mixed use. Only inhibitor would be adult use. The Board then asked Mr. Brisson whether there could be any legal ramification of not advertising the special exception for the residence? It's possible, but not anticipated. The special exception is better than non conforming use. Member Hoover moved to approve Petition No. 09 -002SE for outdoor vehicle sales lot for property located at 920 NW Park Street as well as approve a special exception for the residence on the property; seconded by Member Luviano.
