grantee, and Brothers Two Developers, d/b/a/ Captain D's Seafood (Brothers Two)
named as grantor, in an instrument called Agreement and Grant of Easement, and
recorded at OR Book 275, Page 254, public records, Okeechobee County, Florida;

WHEREAS, by said agreement Brothers Two granted unto the City an easement for water
drainage, maintenance and similar use overa certain portion of real property owned

ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 5, PAGE 7,

WHEREAS, a request was made by Brothers Two to the City to release said easement,
as since the inception of the easement the drainage in the area had been modified
by Florida Department of Transportation, and was no longer necessary for the City's
use; and
WHEREAS, the matter was heard by the City Council at a regularly called meeting on
January 6, 2009, at which time Clty Staff related that it did In fact appear the
easement was not In use and not further necessary for use by the City, and
WHEREAS, upon consideration thereof, the City Council did approve the request to
release the easement, and thereupon:
IT IS, hereby declared by the CITY OF OKEECHOBEE, FLORIDA, that the Easement
heretofore granted to the City by virtue of that Grant of Easement dated January 3,
1986 and recorded In OR Book 275, Page 254, public records of Okeechobee,
Florida, is hereby released to Brothers Two Developers, dlb/a Captain D's Seafood,
its successors or assigns, and the City relinquishes any and all claim, right or

Traffic, Ingress and Egress:
Vehicular access will be via both SW 11th Street and SW 2 "d Avenue. The SW 11th
Street driveway will replace the previous driveway to US 441, which will be eliminated.
Based on the 7th Edition, ITE Trip Generation Manual, a bank with drive -thru facilities
generates somewhat fewer trips per thousand square feet of floor area during the PM
weekday peak hour than a fast -food restaurant with drive -thru facilities (34.6 for the
bank versus 51.1 for the fast -food restaurant). In addition, the proposed bank facility
will be closing the current entrance from U.S. 441 and all vehicular traffic will use the
driveways on SW 11th Street and SW 2nd Avenue.
Comparison of Proposal with Dimensional Standards:
In addition to the general requirements and limitations applicable to all uses in the CHV
district, the site plan should be reviewed in light of the standards for special exceptions
set forth in Sec. 70- 373(b). In its approval of the Special Exception, the Board of
Adjustment offered no comments requiring special consideration by the TRC with
respect to the standards set forth in the aforementioned section of the LDC.

Other Requirements and Considerations:
Sidewalks (Sec. 78 -36): The City Engineer has identified the need for a sidewalk along
SW 11th Street.
Lighting Plan (Sec. 78 -71): A lighting plan should be submitted that meets the
adopted standard of an average of one -half horizontal foot - candle power of artificial
lighting (adopted by the City under Ordinance 1010 on February 19, 2008).
Drive -thru Lanes. There are no specific standards for drive -thru lanes in the Land
Development Regulations. The Applicant's site plan indicates that the three drive -thru
lanes and the ATM /by -pass lane will be about nine feet wide. This appears adequate.
Dumpster Location: The dumpster location is shown at the southwest corner of the
property and should prove adequately accessible via the drive aisle between the
building and parking spaces 25 — 29.
Compatibility with the surrounding area:
The Board of Adjustment and Appeal's approval contained no recommendation for
special consideration by the TRC with respect to compatibility with surrounding
properties.
Recommendations:
Staff recommends approval of the site plan review provided the infringement of
parking space #3 into the required buffer area is corrected; the Applicant
provides the full measure of shrubs required under Sec 90 -534; a lighting plan
pursuant to Section 78 -71 and a sidewalk along SW 11th Street.
