WHEREAS, the City has received a Street and Alley Closing Application (No. 91) from the
First Baptist Church of Okeechobee for the closing of a certain alleyway and a
portion of a certain streets or rights -of -ways as described in this ordinance to utilize
the entire property for future development; and
WHEREAS, a review of such application reveals that it is in the best interest of the citizens
of the City of Okeechobee as a whole to grant said application; and
WHEREAS, the granting of the application will serve a legitimate public interest and is a
proper exercise of the municipal authority of the City of Okeechobee as a
discretionary function;
WHEREAS, it is in the best interests of the public to use the avenue until such time as its
closure is necessary for construction; and to assure that construction commences
in a timely fashion.
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Okeechobee,
Florida; presented at a duly advertised public meeting; and passed by majority vote
of the City Council; and properly executed by the Mayor or designee, as Chief
Presiding Officer for the City:

hereby closed, vacated and abandoned by the City of Okeechobee,
Florida to -wit:
A fifteen foot wide alley running East to West, between Lots 1 to
6, and 7 to 12 within Block 186, CITY OF OKEECHOBEE,
according to the plat thereof recorded In Plat Book 5, Page 5 of
the public records of Okeechobee County, Florida; together with
That portion of Southwest 5th Street, lying between the West
boundary line of Southwest 3' Avenue and East boundary line of
Southwest 4'" Avenue and between the Southern boundary line
of Lots 7 to 12 of Block 186 and the Northern boundary line of

Saction'fwro. The City of Okeechobee, Florida hereby reserves unto itself, its
successors and assigns, a perpetual, non exclusive easement for
public utility purposes in and over the alleyway located in said Block
186, CITY OF OKEECHOBEE and along the portions of Southwest
4 and 5"' Streets and Southwest 4 Avenue.
Section Three. That the City shall require as a condition to this Street and Alley
closing the following three provisions:
a. The First Baptist Church shall at Site Plan Review before the
Technical Review Committee, provide for and design a cul -de-
sac to be placed at the North end of Southwest 4th Avenue at
Southwest 5'" Street. The cul- de-sac shall nbt encroach onto
private property and shall require a dedication by the Flrst
Baptist Church to the City of a portion of church property to the
extent it cannot be designed for construction solely by using
existing City right -of -way.
b. That In the event the said property owner fails to obtain within
twenty -four (24) months hereof, a certificate of occupancy for
their future development, then Rights -of -Way and Alley shall
be declared open and the provisions of this ordinance declared
null and void. Extension(s) for reverter clause time frame may
be requested.
c. The Flrst Baptist Church shall cooperate with the City to leave
Southwest 4th Avenue open for public use and transit until such
time as It must be closed for construction. The City and First
Baptist Church shall endeavor to negotiate an agreement for
such use but the failure to do so shall not otherwise affect the
validity of this ordinance.
Section Four. The City Clerk shall cause a certified copy of the ordinance to be
recorded in the public records of Okeechobee County, Florida.
Section Five. This ordinance shall be set for final public hearing the 1c^ day of
September. 2008, and shall take effect immediately upon its
adoption.

SUMMARY OF 7-3-08 MEETING RE: 1st BAPTIST CHURCH EXPANSION
WITH
Lane Gamiotea, Steve Dobbs, Denise Bas, and Representatives of the Church,
Bill Brisson and Brian Whitehall
Steve presented a graphic of the proposed site plan and posed two questions relating to (1)the use
of shared parking and(2)what would have to be done to allow the Church to calculate imper-
vious surface coverage based on the whole site rather than on a block-by-block basis.
1. I noted that it appears the Church could take advantage of shared parking but would have to
make its case before the City Council and should prepare a study verifying the total number
and location of spaces proposed would support the arrangement of spaces and uses
proposed. The Applicant is directed to Sections 90-483 90-484 of the Land Development
Regulations.
2. A number of ideas were discussed relative to calculation of impervious surfaces including
unity of title and planned development approaches. We believe a unity of title can best
address development of the entirety of the Church properties, as envisioned in the site plan,
for the following reasons:
a. Use of a planned development approach.
Unfortunately, there is no PUD in the Land Development Regulations (LDRs) that
would apply in this situation. The PUDs adopted last year, as did the original PUD
these replaced, are oriented toward mixed use, either a mix of residential types or a
mix of residential and nonresidential uses. Consequently,the Church expansion
could only be accommodated under a planned development approach if a new
Institutional or Public/semi-public planned development was added to the LDRs
4 I.
b. The alternative of developing under the existing zoning, but with all the Church
properties under a unity of title, was briefly discussed. This would allow all of the
properties to be treated as one parcel. At the time of our meeting, we were unsure as
to whether or not this could be accomplished under the current regulations.
Having discussed the matter, Jim and I agree that this could be done under the current
regulations.
Steve, we want to be sure that you are aware of the differences between this situation
and that of the Southern Trace development. While they are similar in some ways,
there are significant differences.
Specifically, while the Southern Trace project was required to enter into a unity of
title, we did not allow computation of density, lot coverage, or impervious surface
coverage on a project-wide basis, because it was not being developed as a PUD.
Rather, these requirements and limitations were computed individually for each
block. The reason for this is that computation on a project-wide basis could have
resulted in some property owners or residents living in residential settings that would
be inferior or more intense in terms of open space, building coverage, or impervious
surface coverage than others in less intensely developed sections of the project. We
believe this would violate the intent of the limitations on density, building and
impervious surface controls in residential developments.
However, in the case of the First Baptist Church, we will not be dealing with separate
individual residential property owners or tenants, but with just one owner who is
using the property for a single principal nonresidential use and associated accessory
uses. We feel comfortable that,with a unity of title, developing the entire project as
one use and calculating building coverage and impervious surface coverage on the
basis of the entire property will achieve the goals intended by such regulations.

substance, or have any questions,please let me know.

Re: Alley and City Streets closing application for the First Baptist Church of
Okeechobee
Besides all the issues concerning severe drainage problems in City of Okeechobee, I the City
Engineer can not understand the senseless request made from the First Baptist Church to
obtain some of busies and more needed streets of our City.
More than two years ago, I disapproved similar petition when the same Church requested that
the City to abandon an existing and functional street. At that time they obtained their goal,
but this time I consider their petition simply selfish and goes against City Residents.
It is the Engineering Department's opinion and my personal comment that the City of
Okeechobee Council shall not approve to abandon either City Alley or the City functional
Streets.

dead -end from being created, see provision "a" in section three

It is hereby understood and stipulated that whenever said land hereby
conveyed is not used any more for church purposes by the First Baptist
Church of Okeechobee, Inc., that said land shall revert to the
Grantors herein or it's successors in title or it's assigns.
Pursuant to Florida Statute Section 689.18 (5) this reverter is for an
unlimited duration and shall be perpetual.
To have and to Hold, the same together with all and singular the
appurtenances thereto belonging or in anywise appertaining, and all the
estate, right, title, interest, lien, equity and claim whatsoever of grantors,
