Pastor Randy Huckabee of First Baptist Church offered the invocation;

Mayor Kirk and City Clerk Gamiotea presented Daniel Brian Padgett with a Certificate of Longevity Service and a
Cross pen engraved with his name. Mr. Padgett began his career with the City of Okeechobee on November 5,1999
as a Maintenance Operator assigned to the Public Works Department. He was originally hired by Cleveland Lamb
who was acting as the City's Interim Public Works Director. He now works under the direction of Public Works Director
Donnie Robertson. Mr. Padgett is a 1980 Okeechobee High School graduate. He is an experienced heavy equipment
operator and during his tenure with the City he contributed greatly to the development of the City Hall Park. The City
would like to extend their gratitude in appreciation of Mr. Padgett's hard work and dedication. Service is the lifeblood
of any organization. Everything flows from it and is nourished by it. The citizens of the City have benefitted greatly
by Mr. Padgett's performance.

COUNCIL ACTION - DISCUSSION - VOTE
Mayor Kirk read the following proclamation in its entirety: "WHEREAS, American farmers and ranchers literally
help feed the world by producing a bounty of agricultural products. To do this, they rely on essential
partnerships with urban and suburban communities to supply, sell and deliver finished products across the
country and around the globe. Rural and urban communities working together have made the most of our
nation's rich agricultural resources as they contribute to the health and well being of our country and to the
strength of our economy, and WHEREAS, during National Farm -City Week, we recognize the importance of
this cooperative network Agriculture employs more than 24 million workers including farmers and ranchers,
shippers, processors, marketers, retailers, truck drivers, inspectors and others who annually contribute more
than $1.3 trillion to our gross domestic product The agriculture industry provides us with food and clothing
as well as fuel for our energy needs. And as we welcome new opportunities for trade, the hard work and
successful cooperation between farmers and city workers will continue to play a vital role in our nation's
future. WHEREAS, Farm -City collaborations help maintain and improve our food and fiber supply and
contribute to a better quality of life for countless citizens. We commend the many Americans whose hard
work and ingenuity reflect the true spirit ofAmerica and help to ensure a prosperous future forall. WHEREAS,
this weepy as we gather with family and friends around the Thanksgiving table, it is fitting that we count among
our blessings the vital Farm -City partnerships that have done so much to improve the quality of our lives.
NOW, THEREFORE,1, James E.1 irly Mayor of the City of Okeechobee, by virtue of the authority vested in me,
do hereby proclaim November 19 through November 25, 2004 as Farm -City Week 1 call upon citizens in rural
and urban areas to acknowledge and celebrate the achievements of all those who, working together, produce
and supply our community and nation with an abundance of agricultural products."
Mayor Kirk presented the proclamation to David Raulerson, of Okeechobee Farm Bureau. Mr. Raulerson thanked the
Mayor and Council and presented them with bags of fresh vegetables. He also extended to everyone an invitation to
the November 18, 2004 luncheon at the KOA Campground to kickoff Farm -City Week.
Council Member Markham moved to dispense with the reading and approve the Summary of Council Action for the
October 19, 2004 Regular Meeting; seconded by Council Member Williams. There was no discussion on this item.

COUNCIL ACTION - DISCUSSION - VOTE
Council Member Markham moved to approve the first reading of proposed Ordinance No. 876; seconded by Council
Member Williams.
Mr. LaRue reviewed the Planning Status Report with the Council. The Planning Board reviewed the application on
October 26, 2004 and voted unanimously to recommend approval.
Planning Staff Report Summary: The current zoning designation assigned to the property does not allow office
space as a permitted or special exception use. As such, the applicant is requesting the CLT zoning district. This
request, if granted, will bring the subject property into consistency with the Future Land Use Map designation of
Commercial.
Planning Staff Report Analysis: (1) The proposed use is consistent with the Future Land Use Map and the land use
policies regarding commercial development. (2) The proposed use being applied for is specifically authorized under
the zoning district in the Land Development Regulations. Office space is an allowable use under the Land
Development Code's permitted uses in the CLT Zoning District. (3) The proposed use will not have an adverse effect
on the public interest. The site was previously used as a day care facility. (4) The established land use pattern
includes primarily commercial uses. The proposed use is consistent with the surrounding areas. The proposed
change will be appropriate for this location and not detrimental to urbanizing land use patterns. (5) The proposed
change from RMF to CLT will not have an adverse impact on the surrounding properties. (6) The proposed use is
required to provide a 20-foot setback from adjacent residential properties and adequately buffer this area. (7) The
proposed use will not create a density pattern that would overburden public facilities such as schools, streets, and
utility services. (8) The proposed use will not create traffic congestion, flooding or drainage problems, or otherwise
affect public safety. (9) The proposed use has not been inordinately burdened by unnecessary restrictions. The only
restrictions that have been placed on the subject property are those included in the City's Comprehensive Plan and
those found in the City's Land Development Code. (10) The proposed change will not constitute a grant of special
privilege to an individual owner as contrasted with the public welfare.
Planning Staff Report Summary and Conclusion prior to Certification: This request is consistent with the
Comprehensive Plan as stated in criteria 1 of the Planning Staff's Status Report.
Planning Staff Report Additional Regulations: Additional regulations which shall apply to all uses in the CLT district
include, but are not limited to: (1) Concurrency regulations. (2) Parking and loading regulations. (3) Landscapinc
regulations. (4) Sign regulations. (5) Accessory use regulations. (6) Supplementary use regulations (T
Environmental and stormwater regulations. (8) Utilities regulations.

COUNCIL ACTION - DISCUSSION - VOTE
Planning Staff Report Recommendation: Based on the above criteria being met, Planning Staff recommends
approval of the request to allow rezoning from RMF to CLT permitting the applicant to utilize the property as an office.
Council Member Watford agreed that the CLT zoning will concur with the surrounding area, and commended the
applicant for choosing it.

The Mayor, Council and Administrator briefly discussed the meeting schedule for November and December. Council
agreed to only having the first meetings of each month for November and December, with the understanding
that should an emergency situation arise a special meeting could be called.
Council Member Williams moved to award a Vehicle Bid to Don Reid in the amount of eighteen thousand seven
hundred fifty-eight dollars ($18,758.00) per car for twenty-four new police cars, for the 2004/2005 Police Car Leasing
Program; seconded by Council Member Markham. There was a brief discussion on this item.
Council Member Watford abstained from voting since he is employed with one of the companies that submitted a bid.

AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING
THE OFFICIAL ZONING MAP OF OKEECHOBEE BY REZONING A
CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN,
FROM RESIDENTIAL MULTIPLE FAMILY(RMF) ZONING DISTRICT TO
LIGHT COMMERCIAL (CLT) ZONING DISTRICT, AMENDING THEZONING
MAP ACCORDINGLY, PROVIDING FORCONFLICTS, SEVERABILITYAND
AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance
Number: 402 in which a revised Official Zoning Map was adopted for said City; and
WHEREAS, the owner of the property more particularly described hereafter, has
heretofore filed a petition (Petition No. 04-009-R) pursuant to the Land
Development Regulations of the City of Okeechobee for the purpose of rezoning
a certain tract of land consisting of 0.325 acre(s) from Residential Multi -Family
(RMF) Zoning District to Light Commercial (CLT) Zoning District and that this
request be removed from the boundaries of the above mentioned zone to allow for
the processing of the rezoning application; and
WHEREAS, the City Council finds such rezoning consistent with the City's Comprehensive
Plan and deems it in the best interest of the inhabitants of said City to amend
aforesaid revised Zoning Map as hereinafter set forth:
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
OKEECHOBEE, FLORIDA; presented at a duly advertised public meeting; and
passed by majority vote of the City Council; and properly executed by the Mayor or
designee, as Chief Presiding Officer for the City:
SECTION 1. LEGAL DESCRIPTION.
The following described land, located in the City of Okeechobee, to -wit:
LOTS 3 AND 4, BLOCK 21, SOUTH OKEECHOBEE, ACCORDING
TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 5, PAGE

A. Rezoning Petition No. 04-009-R. Consider a recommendation to the City
Council to rezone the property located at 1306 SW 2nd Avenue from Residential
Multiple Family (RMF) to Light Commercial (CLT). K Builders, Inc. is the
property owner, Ted Kelchner is the applicant - Exhibit 1.

Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows:
Planning Staff Report Summary: The current zoning designation assigned to the property does
not allow office space as a permitted or special exception use. As such, the applicant is requesting
the CLT zoning district. This request, if granted, will bring the subject property into consistency
with the Future Land Use Map designation of Commercial.
Planning Staff Report Analysis: (1) The proposed use is consistent with the Future Land Use
Map and the land use policies regarding commercial development. (2) The proposed use being
applied for is specifically authorized under the zoning district in the Land Development
Regulations. Office space is an allowable use under the Land Development Code's permitted uses
in the CLT Zoning District. (3) The proposed use will not have an adverse effect on the public
interest. The site was previously used as a day care facility. (4) The established land use pattern
includes primarily commercial uses. The proposed use is consistent with the surrounding areas. The
proposed change will be appropriate for this location and not detrimental to urbanizing land use
patterns. (5) The proposed change from RMF to CLT will not have an adverse impact on the
surrounding properties. (6) The proposed use is required to provide a 20-foot setback from
adjacent residential properties and adequately buffer this area. (7) The proposed use will not create
a density pattern that would overburden public facilities such as schools, streets, and utility
services. (8) The proposed use will not create traffic congestion, flooding or drainage problems,
or otherwise affect public safety. (9) The proposed use has not been inordinately burdened by
unnecessary restrictions. The only restrictions that have been placed on the subject property are
those included in the City's Comprehensive Plan and those found in the City's Land Development
Code. (10) The proposed change will not constitute a grant of special privilege to an individual
owner as contrasted with the public welfare.

PRESS RELEASE
Daniel Brian Padgett began his career with the City of Okeechobee on
November 5, 1999 as a Maintenance Operator assigned to the Public
Works Department. He was originally hired by Cleveland Lamb who was
acting as the City's Interim Public Works Director. He now works under the
direction of Public Works Director Donnie Robertson. Mr. Padgett is a 1980
Okeechobee High School graduate. He is an experienced heavy
equipment operator and during his tenure with the City he contributed
greatly to the development of the City Hall Park. The City would like to

Below is a brief summary of past and upcoming events.

SYNOPSIS
Hurricane Related Issues — Post hurricane cleanup continues and will for several
weeks. Staff is working closely with the CAS group in identifying damages and
submitting proper forms necessary for FEMA reimbursement. A new roof has been
installed on the City Hall Garage. Materials are on order for roofs at the City Barn and
City Hall. Structural inspections are being made for each facility.
GRIT — John Cook has recently unsuccessfully attempted to initiate contact with
potential re -insurance providers. He has notified GRIT's attorney that there has been no
response from the re -insurance contact they provided. As part of the terms of the
settlement with GRIT, they must provide us with viable re -insurance contact
information.
Industrial Park — Construction has resumed in the industrial park. CAS is working
with Ranger Construction to determine the length of time extension that needs to be
requested of the granting entities, as a result of the storm.
Downtown Streetscape Project — The first phase of work in the downtown parks has
been completed with the exception of a few minor follow-up punch list items. Phase
two should begin following the holidays, with completion before the Speckled Perch
Festival.
Nancy Phillips and Oscar Bermudez are finalizing the designs for storefront
modification. Nancy will be discussing the design proposals with the participants, staff
and the City Council before final approval is requested from the State. Locating
available contractors for this portion of the project may be difficult in light of recent
storm damage demands.

Impact Fees — We have received one proposal as a result of the RFP for an Impact Fee

Consultant. If the City were to select all four areas (transportation, law enforcement,

fire and storm water management) for a study, the cost would be $27,260.00 ($6,815.00

per item). The County Commission will have this as an agenda item at their November
41h meeting. I will be setting up a presentation for the City Council by the submitting
firm as soon as possible (it will be after your November 2`d meeting).
OUA — The City currently needs an Alternate on the OUA Board.
Florida Power and Light — Attorney Cook and I met with representatives of FPL to
discuss their Franchise Agreement, which will expire next. year. We will be working
together to develop a new contract, which should come before the City Council early
next year.
PUBLIC WORKS
While the Public Works Staff is still dealing with hurricane cleanup, they have begun to
return to their regularly scheduled activities, as well.
CODE
Attorney Cook is preparing the documents related to foreclosure on the Brantley
ENFORCEMENT
property. He is also including a nuisance abatement element to the proceedings, which
should enable the City to deal with the ongoing and growing problem while the
foreclosure is being pursued. The Code Board has approved this approach.
Utilization ofthe two part-time employees (Jim Byrd and Sammy Hancock) seems to be
working very well and is a real plus for the City. Both are splitting the hours (and
budgeted salary) that were previously going to one.
FINANCE
Kim Barnes has joined the Finance Department as Lydia Williams' replacement. You
may recall, she has worked for about a year as a shared employee in General Services
and the Clerk's office. Lola seems pleased with her progress thus far.
POLICE
The Police Department has returned to normal activities following the hurricanes. Chief

Davis reports that morale is high.
RFP's have gone out for this year's police cars and the related financing. This will come
before the City Council on November 2❑d. Newly appointed Major Bob Peterson will be
handling the car program.

SYNOPSIS
Every effort is being given to replacement of the destroyed tower and solidifying the
department's communication abilities. It is planned that the old tower will be replaced
by a freestanding (no supporting tension wires) tower. Herb Smith seems to be
adjusting very well to the role of Chief.
The following are included in the items I have asked Attorney Cook to address.
l . Scheduling and conducting a hearing on the Tommy Raulerson issue.
2. GRIT related re -insurance issues.
3. Hamrick Trust — John is in discussion with the County Attorney on this matter.
4. Research annexation issues.
5. LDR issues, such as conversion of former residential structures to commercial
and CBD site regulations and new development within the CBD.
6. Marvin Brantley's continuing situation.
7. Various LDR issues, including the commencement of site -work and sidewalk,
curb and guttering issues.
8. Work with Administrator and FPL toward a renewal ofthe franchise agreement.
Clerk Gamiotea recently attended an Employment Practices Seminar. The items
covered in the seminar were understanding the Facets of the New Fair Labor Standards
Act Regulations, the newest developments in Labor and Employment Laws regarding
ADA, implementing the new HIPAA laws and annual training that must be met, review
ADA Access Compliance and keys to lawful and effective employee monitoring. While
the City is in compliance in most areas, due to the new laws, amendments to the
Employee Handbook will be required and will be forwarded to the Council as soon as
possible.
County Supervisor of Elections Gwen Chandler has advised that early voting is going
well. The last day for early voting is Monday, November 1. The Canvassing Board will
meet Monday, November 1 at 5:30 p.m. to begin processing absentee ballots. Once
those are completed Monday evening, the Board will recess until Tuesday, November 2
at 6:30 p.m. Beginning promptly at 7:00 p.m., the precinct ballots will be processed.
Clerk Gamiotea serves as the City's non -voting ex-officio member to the Canvassing
Board.
The new part-time Office Assistant, Sandy Thomas, has been hired in the Clerk's Office
and began work on Tuesday, October 26.

I hope this letter finds you safe and sound following the recent series of hurricanes that have touched
down in Florida leaving their mark on our beautiful state, and on our 39th annual Jerry Lewis MDA
Labor Day Telethon. I am sure you have already learned that the local portions of the Telethon were
canceled throughout the state, restraining our fundraising efforts.
Thank you for your support in allowing the Okeechobee City Fire Fighters to hold their annual "Fill the
Boot" fundraiser for the Muscular Dystrophy Association during the weekend of August 27' & 28'.
The funds they raised have become even more important in providing services for our members since
Hurricane Frances has cancelled our most important fundraising program. Without your efforts it would
be extremely difficult to provide clinics, support groups or medical equipment to our members.
The Okeechobee City Fire Department displayed efficiency, professionalism and competency at every
level. Extreme caution was used during the "Fill the Boot", and our safety professionals once again put
their knowledge of emergency road skills to good use. They used caution and professionalism on our
streets and this event is estimated to raise over $7,000.
This outstanding effort is worthy of commendation, and our thanks go to all the men and women who
took part in this effort and made it the successful event it was. So many people contributed to the
success; the Fire Fighters who braved the heat to fill the boot, the coordinators who worked tirelessly
and you for caring enough to make a difference. It was a pleasure working with you and the Fire
Fighters of Okeechobee City.
