'M. and the following were present: Mayor H. H. Raulerson, W. R. ~age, President of the Council, Councilmen Raifsnider, Roe, McMullen and Raulerson with Alma Sherman, City Clerk, T. W. Conely, Jr., City Attorney, N. 0., Stewart, Fire Chief and O. O. McOain, Water Supt. in attendance. Minutes of the meetings held April 7,9, 17 and May 1 were read and adoptee as read. Tho Street Committee reported that it was necessary to purchase a truck for municipal purposes for tho sum of $385.00, and requested the Cow1cil to approve ~ of said purchase. ~on oot1on by Co=c1~an Roe, seconded ~ Co=ilm~ ~clersen ~ c~r1ec, 0 the action of the Committee was approved. Upon motion of Councilman Roe, seconded by Councilman McMullen and carried the purchase of a Lawn Mower for City Parks was authorized. Upon motion by Ootfficilman Raifsnider, seconded by Councilman Raulerson and carried, the ptœchase of 30 tons of filter sand was authorized. I." BE IT ORDAINED BY THE CITY OOUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: 1. That the proposed letter agreement with Florida Power & Light Company, which is hereinafter set fórth in form in Section e hereof, be and the same is hereby approvød as to form and substance. 2. That the Mayor and the City Clerk, of and on behalf of the City of Okeechobee, Florida, be and 1ney are hereby authorized and directed to execute and enter into with Florida Power & Light Company the said proposãd Letter Agreement approved in Section 1 4IÞ hereof, and hereinafter set forth in form as follows: Okeechobee, Florida May 5, 1941 I City of Okoochoboo Okeechobee, Florida Gent lemen: This relates to that certain Municipal Street Lighting. Agreement now in effect between us dated the 13th day of September, 1938, and to all supplemental agreements thereto. In order to help you solve your street lighting problem, we hereby agree, at your request, that as of the 8th day of May, 1941, we will make the following street lighting rearrangements in the City of Ükeechobee: (1) Install two (2) additional 100 CP, OHB type, company owned streot lights, Which will make a total of seventeen (17) 100 OP, OHB type, company owned stroot lights to be served by us under the said agreement. (2) Discontinue seven (7) 75 watt, White Way Underground, City,owned street lights, which willloa.ve thirty (30) 75 Watt, white Way Underground, City owned street lights in operation under said agreement and fifty- four (54) 75 Watt, White Way Underground, I City owned street lights not in operation under said agreement. In view of this change, Section l-A of Article 111 of the said Municipal Street Lighting Agreement shall be 4IÞ amended to read as follows: .. "Section l-A. That the said fifty-four (54) 75 Watt, I Whi t e Way I Underground, City owned street lights which are not now in operation, shall not be paid for by Consumer while the same are not in operation and remain dis- continuød. At any time, or from time to time, during the term of this agreement, at the re- quest and expense of Oons~~er, the Company will restore to service any or all of the said street lights which are sefviceable and not now in operation and, after such restoration to aofvice, the OompwlY will bill Consumer and Consumer will be required to pay for such street lights restored to service in " accordwlce with the terms and provisions 8 of this a~ocmem.' In view of the fact that the City owned White way under- ground street lighting system is in bad repair, we hereby agree to place the same in good operating condition, putting in new cable and joints where necessary so that the said thirty (30) lights may render good service to the City, and install the said two (2) ORB type, Company owned street lights mentioned above for a total cost of Six Hundred Ninety-One and no/lOa Dollars ($6~1.OO), said amount of Six H~ldred Ninety-one and no/lOO Dol~ars (~691.00) to be paid to Company in two (2) equal pay- r ~ ~ 642 ' monte of Three Hlmdred Forty-five and 50/190 Dollars (~345.50) each, during November, 1941, and November, 1942. It is further \.U1derstood and agreed that except as O. expressly provided herein, the said M\.U1icipal street Lighting Agreement and all supplemental agreements thereto shall remain in full force &1d effect between us. If you agree to the foregoing, kindly so indicate by causing this letter and the attached copies to be executed by your duly authorized officials, under your corporate seal, in the spaces provided below for that purpose.
