STANDARDS FOR GRANTING A SPECIAL EXCEPTION
(Sec. 70- 373(b), in the Land Development Regulations)
Applicants are required by Sec. 70- 373(b) to address the following issues in his/her presentation before the
Board of Adjustment. Staff strongly recommends that the Applicant include, in his/her application, materials
that address each of these issues in order to allow Staff and the Board of Adjustment sufficient time to
adequately consider the Applicant's request.
1. Demonstrate that the proposed location and site are appropriate for the use.
2. Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses
and the neighborhood, or explain why no specific design efforts are needed.
3. Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual
screening is necessary.
4. Demonstrate what is proposed to reduce the impact of any potential hazards, problems or public nuisance generated
by the use; or explain how the nature of the use creates no such potential problems.
5. Demonstrate how the utilities and other service requirements of the use can be met.

Statement Addressing the Standards for Granting a Special Exception
1. Demonstrate that the proposed location and site are appropriate for the use.
The property is currently zoned Residential Multi Family and lies within the Multi Family
future land use designation of the adopted comprehensive plan. The RMF zoning district
specifically provides for a special exception for a house of worship on less than 5 acres.
In addition, the property has operated as a house of worship for many years and has
created no negative impacts to the area. The small church has blended harmoniously into
the neighborhood and will continue to provide a benefit to the community.
2. Demonstrate how the site and proposed buildings have been designed so they
are compatible with adjacent uses and the neighborhood, or explain why no
specific design efforts are needed.
The existing site and building appear to have been designed so they are consistent and
compatible with adjacent residential uses and the general neighborhood. As the site is
presently developed there is no evidence to suggest that further design efforts are needed
to make the current use more compatible with adjacent uses.
3. Demonstrate any landscaping techniques to visually screen the use from
adjacent uses; or explain why no visual screening is necessary.
The continued use of the subject property as a church should not require additional
screening. The use of the property has not changed, only the ownership. The new owners
will provide any additional screening as deemed necessary.
4. Demonstrate what is proposed to reduce the impact of any potential hazards,
problems or public nuisance generated by the use; or explain how the nature
of the use creates no such potential problems.
Considering the use of the property is not changing, no potential hazards, problems or
public nuisances are anticipated. Although the property has operated as a church for
many years, a recent change in ownership brought to light the need for a special
exception. The proposed special exception would address the existing nonconformity and
bring the property into compliance with the current City regulations.
5. Demonstrate how the utilities and other service requirements of the use can
be met.
Adequate utilities and the like exist and appear to be sufficient to support the existing
building and use.
6. Demonstrate how the impact of traffic generated will be handled, off site and
on site.
Ingress to and egress from the property will be provided from a driveway located on NW
2nd Street which appears to adequate for the proposed use. There appears to be sufficient
area on -site to accommodate traffic flow and parking for the proposed use.

Statement Addressing Findings Required for Granting a Special Exception
1. The use is not contrary to the Comprehensive Plan requirements.
The subject property is located in the Multi - Family future land use classification of the
adopted comprehensive plan. This classification allows for a variety of uses, virtually all
of which exist in one form or another near the subject property. The continued use of the
property as a house of worship would not be contrary to or have an adverse effect on the
comprehensive plan.
2. The use is specifically authorized as a special exception use in the zoning
district.
The Residential Multi Family zoning includes a provision for a special exception to allow
a house of worship, on a lot less than 5 acres. The property has operated as a house of
worship for many years. The special exception, if granted, would bring the property into
compliance with the City's current regulations.
3. The use will not have an adverse effect on the public interest.
The continued use of the property as a house of worship should contribute to the well
being of the surrounding area. Granting of the requested special exception would provide
for an open nondenominational outreach ministry that will benefit the surrounding
community, therefore an adverse effect on the public interest is not anticipated.
4. The use is appropriate for the proposed location, is reasonably compatible
with adjacent uses and is not detrimental to urbanizing land use patterns.
Considering the subject property has operated as a house of worship for many years, the
use appears to be appropriate for the site and is reasonably compatible with adjacent uses.
As presently developed there is no evidence of adverse economic impacts on adjacent or
nearby properties, and no suggestion that the requested use would create an adverse
impacts or be detrimental to urbanizing land use patterns.
5. The use will not adversely affect property values or living conditions, nor be
a deterrent to the development of adjacent property.
The proposed special exception would make conforming a currently non - conforming
property in terms of the comprehensive plan. The continued use of the property as a
house of worship will not adversely affect property values or living conditions in the
adjacent area nor would it be a deterrent to the improvement or development of adjacent
property or properties in the general area in accord with existing regulations.
6. The use may be required to be screened from surrounding uses to reduce the
impact of any nuisance or hazard to adjacent uses.
The subject neighborhood is largely residential in nature. The adjacent uses are deemed
sufficiently distant that any noise from the use of the proposed facility as well as any glare
from any proposed lighting, should not be a factor of significant detrimental impact. It is
unlikely that any additional screening of buffering would be necessary.
7. The use will not create a density pattern that will overburden public facilities
such as schools, streets, and utility services.
The proposed special exception would address a current nonconformity, and by itself
would not change or create a density pattern that would overburden public facilities.
8. The use will not create traffic congestion, flooding or drainage problems, or
otherwise affect public safety.
The continued use of the property as a small house of worship will not create or
excessively increase traffic congestion or otherwise affect public safety. It is unlikely that
the continued use would create flooding or drainage problems.

Brief Narrative Addressing Proposed Land Use Action
Dick B. and Martha D. Morse recently purchased the First Pentecostal Holiness Church
located at 912 NW 2'd Street. Although the names have changed the property has
continuously operated as a house of worship for many years. The applicants have leased
building space for a number of years and hope to establish a permanent location for
Freedom Outreach Ministries. The applicants intend to offer spiritual comfort and
enrichment to members of the church and members of the community. In accordance
with the City's Unified Land Development Code, a special exception will be required to
allow a house of worship on less than acres.
The subject property is currently zoned Residential Multi Family (RMF) and lies within
the Multi Family future land use classification of the adopted comprehensive plan. The
proposed use is consistent with the City's Land Development Code, adopted
comprehensive plan and the general area.
Dick and Martha Morse respectfully request that the Planning Board grant the request for
a special exception to allow a house of worship on less than five (5) acres.
