The matter for consideration by the City of Okeechobee Board of
Adjustment, is a Special Exception application by Murphy Oil for property
located at 2101 South Parrott Avenue, Okeechobee, Florida 34974. The
applicant is requesting an automotive service station to be located on
property zoned Heavy Commercial.
The subject property is approximately 0.57 acres located at the northeast
corner of the Wal Mart entrance and Parrott Avenue.
The applicant intends to build an automotive service station with fuel
pumps and a mini -mart on property that will be leased from the Wal Mart
Superstore. The property has public utilities, and the adjoining property
users are as follows:
North: Vacant
East: Commercial
South: Commercial
West: Commercial
When reaching a conclusion on a Special Exception, the Board of
Adjustment shall consider and show in its record the following findings:
1. The use is not contrary to the Comprehensive Plan requirements:
The subject property is allowed in an area currently designated
Commercial on the Future Land Use Map and Heavy Commercial
on the Official Zoning Map. In the Heavy Commercial Zoning
District, automotive service centers are allowed by Special
Exception, provided that the land use designation is commercial.
This request is consistent with the Comprehensive Plan.
2. The use is specifically authorized as a special exception use in the
Zoning District:
As stated earlier, the subject property is designated Commercial on
the Future Land Use Map and is zoned Heavy Commercial on the
Official Zoning Map. Auto service stations with fuel pumps are
allowed by special exception on the Heavy Commercial Zoning

District. Under the special exception regulation, the minimum lot
area required is 20,000 square feet with a minimum frontage of
140 feet. The maximum lot coverage is 25% excluding fuel
storage tanks. All structures including fuel tanks are required to
maintain the minimum setback requirements: 25 feet front yard; 20
feet side yard and rear yards except, except when abutting
residential zoning districts which require 50 foot setback.
3. The use will not have an adverse effect on the public interest:
The site being proposed is commercial. It is not unusual to see
properties such as Wal Mart with auto service stations and fuel
pumps as an ancillary use. Considering that the parcel is located on
an arterial road, service stations would be a consistent use with this
type of traffic.
The applicant will be complying with all requirements of the City
of Okeechobee building requirements. Stormwater drainage shall
be contained on site and shall be shared with the retention area that
Wal Mart currently has for its structure. Since there are no
residential uses adjacent to the subject property or within the
surrounding area, it does not appear that the proposed request will
adversely affect the public interest.
The site plan shows that all traffic shall be conducted internally.
No additional curb cuts will be needed to accommodate the
proposed development. The entrance to the proposed development
shall be at the main entrance to the Wal Mart Superstore and shall
follow the traffic circulation pattern shall follow the design created
by the Wal Mart development. Based upon the existing traffic
patterns, the proposed development does not appear to impact the
public adversely.
4. The use is appropriate for the proposed location, is reasonably
compatible with adjacent uses, and not detrimental to urbanizing
land use patterns:
The adjoining uses are commercial, with the exception of the
property that is immediately north of the site which is vacant. That
particular property is zoned Commercial, and therefore,
commercial uses that are consistent with the Heavy Commercial
zoning classification, would be appropriate for the site. The
proposed location for the automotive service station with fuel
pumps is reasonably compatible with the adjacent uses. As stated
earlier, traffic circulation will be internal and no additional curb
cuts will be necessary. Therefore, this will not be detrimental to the
public.
In essence, the site plan would promote the urbanization of the

southern portion of the City of Okeechobee. Commercial
development has increased along the Parrott Avenue corridor in
the past 3 years. The proposed development at this site would be
consistent with infill development occurring in the area.
5. The use will not adversely affect property values or living
conditions, nor be a deterrent to the development of adjacent
property:
The property values in the area have increased moderately in the
past year. This trend will only continue as commercial
development increases. Furthermore, the Wal Mart store has
provided a catalyst for the development and other adjacent
properties.
6. The use may be required to be screened from surrounding uses to
reduce the impact if any nuisance or hazard to adjacent uses:
Under the Heavy Commercial Zoning District, additional
regulations are required in conjunction with the special exception.
As an example, the minimum non-residential landscape buffer
requirements include:
a width of 10 feet along the street frontage with at least 1
tree and 3 shrubs for each 300 square feet of required
landscape buffer
trees can be planted in clusters, but cannot exceed 50 feet
on centers that abut streets
the remainder of landscaping buffers are required to be
landscaped with grass or some other landscape material.
Other requirements are for parking areas with more than 1 access
lane. The landscape standards are as follows:
at least 18 square feet of landscape area for each required
parking space
at least 1 tree for each 72 square feet of required landscape
area
shade trees should be planted at no more than 20 feet on
centers near the intersection point of a parking space
the minimum dimensions for any required landscape area
with a parking area shall be 4 feet and the remaining of the
landscape area be landscaped with some form of
landscape material or grass.

7. The use will not create a density pattern that will overburden
public facilities such as schools, streets, and utility services;
The utility services are currently provided on-site. Since the subject
property is not residential in nature, schools will not be a factor in
the development of the proposed property. Streets and traffic flow
patterns will be consistent with the Wal Mart development, as
stated earlier. No new curb cuts will be provided for this project to
Parrott Avenue. The existing curb cuts that are on Parrott Avenue
shall serve both this development and the existing Wal Mart
development.
8. The use will not create traffic congestion, flooding or drainage
problems, or otherwise affect public safety;
The traffic volume that will be created by the proposed
development should not cause the LOS on Parrott Avenue to fall
below the adopted LOS of C. as part of the site development
process, the applicant would need to substantiate that the
development would not create traffic congestion.
In regards to flooding and drainage, the site will use the Wal Mart
retention pond for its stormwater management system. Other
public safety issues will be addressed as part of the on-site site
plan review process.
Based on the above Special Exception findings, Staff recommends
approval of the request to allow an automotive service station with fuel
pumps at 2101 South Parrott Avenue in the City of Okeechobee.
Move that Petition No. 99 -002 -SE be approved based on the findings
contained in the Planning Consultant's report dated May 17, 1999.
