her 25, 2001 - Board of Adiustment - Pa2e 2 of 3 II' AGENDA II ACTION - DISCUSSION - VOTE II IV. NEW BUSINESS. • A. Consider Variance Petition 01-004-V by John W. and Kim E. Burnett. The purpose of the variance is to have a three-foot, eight -inch side setback rather than the required ten -feet in a Residential Multi -Family (RMF) zoning district. (Exhibit 1). Jock Robertson, City Planning Consultant described the petition and gave a brief background of the property. The subject property is currently zoned as Residential Multi -Family (RMF). There are special conditions that exist which are peculiar to the structure involved, and are not applicable to other land or structures in the same zoning district. The existing garage was built prior to the current code adoption and does not meet current setbacks. This request is to allow the construction of a carport to be uniform with th existing garage, which will not additionally encroach on the adjacent property. Mr. Julian Leggett, adjacent property owner, had concerns for how the carport will look when completed. He felt it would not flow with the surrounding properties. Mr Leggett also had concerns for the survey submitted as part of the application. He had a survey from the same surveyor and they both were inconsistent he wanted the Board to recognize this to settle a civil disagreement. Attorney Cook informed Mr. Leggett that the Board of Adjustment is only to consider the variance request that was submitted and whether or not it is consistent with the codes. There was no further discussion. Board Member Mueller made a motion that Petition 01-004-V as presented be approved based on the findings in the staff report. Board Member Jones seconded the motion. Consider Petition 01-006-SE: Corporation of the Presiding Bishop, The Church Jock Robertson, City Planning Consultant described the petition and gave a brief background of of Jesus Christ of Latter Day Saints, property owner; Bob Kapherr, is the the property. The subject property is currently zoned as Residential Multi -Family (RMF) and is applicant. The property is located at 310 S.W. 6" Street. The purpose of the consistent with the Land Development Regulations as well as the Comprehensive Plan. Staff request for a special exception to allow a satellite antenna within a Residential recommends granting approval of Petition 01-006-SE. Multi -Family (RMF) Zoning District. ADJOURNMENT - Chairman ACTION - DISCUSSION - VOTE Mr. John Abney, Sr., agent/contractor, explained that he will be doing the concrete work prior to the installation of the satellite antenna. He noted that the neither the Church nor himself were aware that this request needed a special exception approval prior to submittal of the building permit application. The purpose for the antenna is to allow the Church online communication with Salt Lake City, which is the main office for all of The Church of Jesus Christ of Latter Day Saints, to allow for genealogy services for the Church and it is possible that in the future available to the public. Both the Church and the contractor do not foresee a problem if the Board requests buffering. The Church feels that the green fiberglass antenna will blend with the green shrubbery surrounding the proposed location. Member Mueller moved to approve Petition 01-006-SE based on the findings in Staffs Report including buffering should it be required. Member Keller seconded the motion. This is due to the small size of the dish compared to the lot. F. The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. and that the facility shall not be inhabited on a year round basis, exceptthat singe individual or family may occupy the facility year round if they act as caretakers under a contract therefore with the owner. d The facility shall not house a number of persons in excess of dwelling unit densities for affordable housing set out in Section 306 of these Regulations. f No migrant facility shall be located closer than one (1) mile from any other licensed migrant facility, and no migrantfacility shall be located within one thousand (1,000) feet of any church, or school. g Any migrant facility shall comply with all other Regulations and land use Regulations for density, set backs or other requirements of this zoning classification. 353 CUSTOMARY ACCESSORY USES Each permitted principal use and special exception use is also permitted to have the customary accessory uses for that use. 354 LOT AND STRUCTURE REQUIREMENTS Except where further restricted by these Regulations for a particular use, minimum requirements shall be: Minimum Lot Area a Single family dwelling and Zero lot line single family dwelling: Area 6,250 square feet Width 50 feet b Two family dwellings: area 6,250 square feet for each dwelling unit Width 100 feet c Multiple family dwellings: Area 4,356 square feet for each dwelling unit Width 100 feet d Other permitted uses: Area 10,000 square feet Width 100 feet 2 Minimum Yard Requirements Except where a greater distance is required by these Regulations for a particular use, minimum yard setbacks shall be as follows: a Single family dwelling, Front 25 feet and Two Family dwellings: Side 10 feet Rear 10 feet Zero lot line single family dwelling: Side 15 feet and 0 feet 39 b Multiple family dwellings, Front 25 feet and Other permitted uses: Side 20 feet Rear 20 feet 3 Maximum Lot Coverage by All Buildings Maximum Coverage Maximum Impervious Surface a Residential uses: 40 percent 60 percent b Other permitted principal uses: 30 percent 60 percent 4 Maximum Height of Structures Except where further restricted by these Regulations for a particular use, maximum height shall be as follows: All uses: 45 feet, unless a special exception is granted 355 ADDITIONAL REGULATIONS Additional Regulations which shall apply to all uses include but are not limited to: 1 Concurrency Regulations 2 Parking and loading Regulations 3 Landscaping Regulations 4 Sign Regulations 5 Accessory use Regulations 6 Supplementary use Regulations 7 Environmental and stormwater Regulations 8 Utilities Regulations 40 3 An accessory apartment or servants quarters shall be attached to, or located within, the principal structure, and shall not alter the appearance as a single family dwelling. 4 Such accessory use shall not exceed 25 percent of the total floor area of the principal structure. 5 Such accessory use shall not be used as a rental unit. 654 AMENITIES Any development shall be permitted to provide amenities for the use of their employees or residents subject to the following Regulations: Amenities include: Accessory dining room, snack bar, community or recreation center, fitness center. 2 Such facilities shall not be open to the general public. 655 ANTENNA An accessory antenna shall be permitted subject to the following Regulations: Dish antennas larger than 2 feet in diameter shall require a special exception use petition. 2 A drawing prepared by the manufacturer, an architect or engineer, shall be submitted showing the antenna, the foundation or method of attachment to the building. 3 Antennas attached to multiple family structures exceeding 2 stories, commercial or industrial buildings shall require a certificate of structural integrity that they are designed to withstand a wind load of 120 miles per hour, issued by an architect or engineer. 4 Antennas shall not be installed in the front yard, and shall not be closer than 5 feet to a property line. 656 ANTENNA FOR SINGLE FAMILY AND DUPLEX BUILDINGS The following additional Regulations shall apply to single family and duplex dwellings: Antennas shall not be used for a commercial purpose, and shall be limited to two per residential lot. 2 Antennas requiring a permit shall not be installed on a roof, and shall have a maximum dimension of 12 feet;
