a, Demonstrate that the proposed location and site is appropriate for the use,
The new courthouse will be located one block to the north of the historic courthouse, County
courthouses traditionally are located in the downtown area ofthe county seat. Maintaining all court
functions in the vicinity that has served this purpose for over 75 years is beneficial to the city and
to the county, noting the various businesses and professional offices that have located in the area
specifically to be near the courthouse,
b, Demonstrate how the site and proposed buildings have been designed so they are compatible
with the adjacent uses and the neighborhood.
The new courthouse will occupy an entire city block to the north ofthe historic courthouse, The area
is surrounded by commercial uses, generally comprised of businesses and professional offices that
chose to be located in the vicinity of the courthouse, The building has been designed to incorporate
some of the architectural features of the historic courthouse, forming a unified government and
judicial center.
c, Demonstrate any landscaping techniques to visually screen the use from adjacent uses,
The courthouse will not be screened from adjacent uses, as it is important for such a government
building to be a visible component of the downtown area, The building will be set back some
distance from the property lines, and landscaping will be employed throughout the grounds of the
judicial center.
d. Demonstrate what is proposed to reduce the impact of any potential hazards, problems,
public nuisance generated by the use,
A significant feature ofthe new courthouse is security, The new courthouse will incorporate security
screening of visitors to the building, and will provide separate and secure entrances for prisoners,
The addition of the prisoner sally port will enhance the safety of the general public and employees
of the Clerk ofthe Circuit Court, will ensure that prisoners and the general public do not intermingle,
and will minimize any possible traffic impacts by providing the separate vehicular transport
entrance,

e, Demonstrate how utilities and other service requirements of the use can be met,
All utilities are readily available in the downtown area, The county will grant easements to utility
providers where necessary to ensure the continued provision of utilities to the courthouse and the
surrounding area,
f Demonstrate how the impact of traffic generated will be handled off-site and on-site,
Court functions for Okeechobee County already occur in the historic courthouse in the downtown
area, Although the new courthouse will be more than 2 )Iz times larger than the historic courthouse,
the amount of traffic generated will not correspondingly jump upon the building's dedication, The
only new functions that will occur at the new courthouse are the activities associated with the offices
ofthe state attorney and public defender, both of which will be relocated from their present location
about 3 blocks away, The vehicle trips attributable to traveling back and forth between the
courthouse and the state attorney/public defender offices will be eliminated,
There has been a steady increase over the years ofthe caseload of the court system, and a slow but
steady increase in the number of employees required to carry out the related duties, Those increases
will continue, and a few additional employees may be necessary to operate in and manage a larger
building - notably a likely increase in personnel related to the provision of security, Similarly, the
increasing caseload brings with it a slowly but steadily increasing number of citizens that must visit
the courthouse, such as for civil and criminal proceedings and jury pools, In addition, a growing
community also means more activity in the records area of the courthouse, such as obtaining
marriage licenses, recording land transactions, and recording other documents required to be
maintained at the courthouse, All these activities will result in slowly increasing traffic in the
courthouse vicinity, likely comparable to an overall increase in traffic and activity that can be
anticipated in a thriving central business district.
Fortunately, the city has an excellent street system in the area, forming a traditional grid pattern,
Although most traffic associated with the courthouse eventually will be traveling along Parrott
A venue or Park Street, there are multiple side streets from both ofthese major arterial highways that
lead to the courthouse, Other than the provision of on-street parking that the county will construct
along with the courthouse, no street improvements are necessary, The existing street system can
adequately handle any increases in traffic that may be associated with the new courthouse,

Statement of Special Reasons and Basis for the Request
Okeechobee County intends to construct a new courthouse to replace the existing, historically
significant building, The existing courthouse will be renovated and likely will function as the
administrative center for county government.
Because the City of Okeechobee is the county seat, it is important that the new courthouse remain
in the downtown area, The new courthouse will be a three-story, state of the art facility that will
incorporate architectural features of the historic courthouse, The two buildings, each on an entire
city block, will form a judicial center for the county that will be unified by function, architecture and
landscaping,
The property on which the new courthouse is proposed to be located is zoned Commercial
Professional Office (CPO), A special exception is required in that zoning district for a government
facility, A special exception also is required to exceed the height limit of 45 feet established for the
district. The courthouse will reach a height of approximately 65 feet at the peak of the roof, stately
sitting in the center of the new courthouse square,
Intended use, nature of activities and development of property
A new, 72,922 square-foot courthouse is proposed to be constructed in the heart of the city's
business and office district. The new courthouse will house all of the court functions currently
operating from the historic courthouse, In addition, the offices of the state attorney and public
defender will be relocated from the current location at the County Annex on NW 5th Avenue,
The three-story building will be located in the center of an entire city block, one block to the north
of the historic courthouse, The property will be developed with on-street parking surrounding the
new judicial center, and landscaping throughout the area, Future plans include two more buildings
to be constructed on the east and west side of the block to house additional court operations,

Request for Reduction of Parking Space Requirements in Commercial Districts
Okeechobee County intends to construct a new courthouse in the downtown area of the City of
Okeechobee, The new courthouse will replace the current courthouse for all court functions and all
other administrative and official duties of the Office of the Clerk of the Circuit Court,
Description of the New Okeechobee County Courthouse
The current, historic courthouse is situated in the center of an entire city block and has a footprint
of 13,269 square feet. The total gross floor area ofthe building is 28,233 square feet. When vacated
by the various court and Clerk functions, the building will be renovated and likely serve as the
administrative center of Okeechobee County government.
The new courthouse will occupy the block to the north ofthe current courthouse, The portion ofNW
3rd Street between the two courthouse blocks has been vacated by the City, allowing for a unified
governmental/judicial district. The new courthouse will have a footprint of28,058 square feet.
The interior of the new courthouse will be approximately 76,273 square feet. Of that total are
several areas found only on the ground floor that are external to the main structure, These include
the security lobby that comprises the front entrance, and the prisoner sally port, generator room, and
electrical and fire pump rooms to the rear, The front security lobby and the rear prisoner sally port
usually would not be found in a government building, but are provided to ensure security for the
unique functions of a courthouse, Areas such as the unoccupied electrical and fire pump rooms
sometimes are located within a building, but have been located outside of the main structure for
safety and architectural reasons, Other mechanical areas are located within the building on each
floor.
Subtracting the area of the ground floor external appurtenances, the result is a working gross area
of 72,922 square feet for the three-story building,
City Parking requirements
City of Okeechobee regulations require 1 parking space for each 200 square feet of gross floor area
for a government office, Using the gross area of 72,922 square feet, a total of365 parking spaces
are required,
Parking provided
Of the required 365 parking spaces, 33 will be provided on-site to the rear of the courthouse,
Another 69 will be provided off-site, as the County intends to construct a parking lot on vacant land

on an adjoining block owned by the First Methodist Church, That total of 102 off-street parking
spaces leaves a deficit of 263 spaces,
A review of on-street parking in the area indicates that a substantial number of spaces are available,
all within one block of the new courthouse, All ofthe spaces along the two east-west streets to the
north or the south of the courthouse block already exist or just need to be striped, A number of
additional spaces are proposed to be constructed on the two north-south avenues that run along each
side of the courthouse block.
A total of 159 parking spaces in the one-block radius already exist, and 142 could be constructed,
Allowing for use of some on-street parking spaces by businesses in the area, 272 on-street parking
spaces would be available for use by courthouse patrons, leaving 29 on-street spaces for the
businesses in the area that rely primarily on on-street parking for their customers and employees,
Altogether, 374 on-street and off-street parking spaces would be available for the courthouse, leaving
a small surplus over the 365 parking spaces City regulations indicate should be provided, A more
detailed description of the available on-street parking spaces follows,
Request for Reduction of Parking Space Requirements in Commercial Districts
Okeechobee County is requesting that City Council grant a reduction in the number of off-street
parking spaces required based on the availability of surplus on-street parking in the immediate
vicinity,
Section 454 of the City's land development regulations allows for a reduction of parking space
requirements in commercial districts, A provision ofthis section states that there must be a surplus
of on-street parking in the immediate vicinity that is not required by other uses, A review of parking
currently available or that will be constructed in association with the courthouse project indicates
that there will be a surplus of272 on-street parking spaces within one block ofthe courthouse, That
includes an allowance for businesses in the area that rely on on-street parking for all or part of their
parking needs,
City regulations allow for a reduction in off-street parking of up to 80% in the Central Business
District, and up to 20% in other Commercial districts, Using the CBD allowance, up to 292 of the
required 365 parking spaces could be accommodated by surplus on-street parking, with a minimum
of 73 off-street spaces required.
Upon completion, the new judicial center will sit on 2 city blocks, with additional county property
occupying one-half ofthe block to the south, The block that will house the new courthouse is zoned
Commercial Professional Office (CPO), The block that houses the existing courthouse and the half-
block to the south are zoned Public Use (PUB), Properties to the north, west and east of the
courthouse blocks are zoned CPO, Properties to the south, west and east of the adjoining county
property are zoned Central Business District (CBD).
The presence of the courthouse is what establishes the City of Okeechobee as the seat of county
government. The courthouse is an integral part ofthe City, and also functions as an anchor to the
business district. Governmental offices by their nature bring in people to the area, and accordingly

act as a catalyst for the development and maintenance of a variety of retail, professional office and
service activities in the vicinity,
The county properties include PUB and CPO zoning, but are adjacent to and extend into the city's
central business district. Noting the location and nature ofthe existing and proposed courthouses,
this government complex functions as a natural part ofthe central business district, helps define the
north boundary ofthe CBD, and serves as a transition from the CBD to the city's professional and
business office district. Therefore, it is reasonable to consider the courthouse complex as part ofthe
CBD for purposes of determining on-street parking allowances,
Summary
The County ofOkeechobee requests that the City ofOkeechobee find that there is a surplus of275
on-street parking spaces in the immediate vicinity of the proposed Okeechobee County Judicial
Center; that the City of Okeechobee find that the Judicial Center is located such that it is an
extension of and should be considered a part ofthe city's Central Business District, and that the City
ofOkeechobee grant a reduction of80% of the off-street parking spaces required for the new Judicial
Center because of the availability of surplus on-street parking in the immediate vicinity,

Discussion of parking spaces to be provided for the new Okeechobee County Courthouse.
Ofthe 365 parking spaces required in association with construction ofthe new Okeechobee County
Courthouse, 33 will be provided on the courthouse site, and 69 will be provided less than one block
away at an off-street parking lot to be constructed by the county on property owned by the First
Methodist Church, Providing these 102 parking spaces leave a deficit of 263 spaces that still must
be provided,
As part of the courthouse construction project, on-street parking will be constructed adjacent to
Block 125, the block on which the courthouse will be located, On-street parking contiguous to
Block 125 will consist of27 spaces to be constructed on the east side ofNW 4th Avenue, 27 spaces
to be constructed on the west side ofNW 3rd Avenue, and the use of 17 spaces that currently exist
on the north side of the block. These additional 71 spaces provide a total of 173, with a deficit of
192 spaces,
To the east of the courthouse, all of Block 139 is owned by the First Methodist Church, and all of
Block 124 is owned by the Episcopal Church, Because oftheir hours of operation, on-street parking
adjacent to the church properties will be available during business hours of the courthouse,
Accordingly, on-street parking on both sides ofNW 3rd Street between NW 3rd Avenue and NW 2nd
Avenue will be available for use, as well as parking on the south side ofNW 4th Street between NW
3rd Avenue and NW 2nd Avenue, In addition, the County will construct on-street parking on the east
side ofNW 3rd Avenue between NW 3rd Street and NW 4th Street. Allowing for some driveways,
a total of 76 parking spaces will be available, bringing the total to 249, with a remaining deficit of
116 spaces,
Continuing north along NW 3rd Avenue, the County will construct on-street parking between NW
4th Street and NW 5th Street. The east side of the street is occupied by Okeechobee Rehab and
Dunklin Rest Home, neither ofwhich have need of parking along NW 3rd Avenue, On the west side
of the avenue are a business and a house, which also would have no need for parking along the
avenue, The existing parking along the north side ofNW 4th Street between NW 2nd Avenue and
NW 3rd Avenue, (the south side of the Okeechobee Rehab property) also is available for use, as
Okeechobee Rehab has on-site parking and parking available along NW 2nd Avenue, Altogether,
another 57 parking spaces will be available, further reducing the deficit to 59,
To the north and west of the new courthouse site are several homes and businesses, This area
includes NW 4th Street between NW 3rd Avenue and NW 5th Avenue, NW 3rd Street between NW
3rd Avenue and NW 4th Avenue, and NW 4th Avenue from NW 3rd Street to NW 5th Street. All ofthe
homes in this vicinity have a driveway and park off-street, while some businesses use off-street
parking and others use on-street parking, Some of the on-street parking already exists, and
additional parking could be constructed along parts ofNW 4th Avenue, Allowing for driveways and
the parking needs of the businesses in the area, a total of 99 on-street parking spaces could be
available, Making an allowance of 29 parking spaces to be used by businesses in the area, the
available surplus on-street parking in this area is 68 spaces, resulting in a total of 374 spaces
available for the courthouse, or a surplus of 9 spaces,
