RE: Special Exception Request for Outdoor Vehicular Display and Sales

To whom is may concern;
No Regrets, LLC, d.b.a. NR Brand Sales is the prospective lessee of the above referenced property owned
by Mr. George Goodbread. It is our intention to utilize the property for outdoor display and sales of
automobiles.
Upon site plan approval, we intend to install a modular office unit that will be enhanced with a facade to
create a "country / cowboy" look. We also intend to have a covered area on the site to perform preparation
work and detailing to get the cars ready for sale. We do not intend to have a commercial repair facility on
the property.. The balance of the site would be used for vehicular display. We expect minimal noise
generation with only vehicular display and detailing to be performed outdoors. Minor mechanical or
bodywork necessary to prepare the cars for sale would be performed under cover, indoors or offthe
premises.
At present we anticipate a maximum of five (5) employees. Hours of operation are expected to be 8:00 am
to 6:00 pm with occasional sale days with longer hours. In accordance with Department of Motor Vehicle
regulations, a sign visible from 50 yards we be installed at the site. We anticipate the use of some
permanent banners and streamers.
With regard to the use of this particular piece of property, we believe it is an ideal location for an
automobile sales lot. Obviously it has appeal in that it is a vacant lot with frontage on a state highway and
offers high visibility. The use of this lot also has a potential benefit to the City as it represents infill
development. In our opinion, the proposed use in not out of character for the area. It has historically been
used as a vehicular sales lot. It is adjacent to an automotive repair facility and just up the street from a
outdoor golf cart sales and automotive repair facility,
The requested use is permissible within the Central Business District zoning subject to your granting the
requested special exception and is consistent with the Commercial future land use designations for the
property. We look forward to your favorable review of this request and will be available both before and
during the public hearing to answer any questions that may arise.

property is located at 203 South Parrott A venue. The purpose for the
request is to allow for an outdoor vehicle sales lot within a Commercial
Central Business (CBD) zoning district, LDR Section 90- 313 (11) -
Exhibit 1.

Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows:
Planning Staff Report Background: The subject property is approximately 1.102 acre(s) fronting
on Parrott Avenue which is subject to this Special Use Exception petition. The applicant intends
to develop the property as an outdoor vehicle sales lot. North - Commercial Hotel, East -
Residential Single Family and Residential Multiple Family, South - Commercial, West -
Commercial.
Planning Staff Report Consistency with Land Development Regulations: When reaching a
conclusion on a Special Exception, the Board of Adjustment shall consider and show in its record
the following findings: (A) The use is not contrary to the Comprehensive Plan requirements. (B)
The use is specifically authorized as a special exception use in the zoning district. Yes, this use is
specifically authorized by Section 90-313(11) of the Land Development Code. (C) The use will
not have an adverse effect on the public interest. No, the use will not have an adverse effect on the
public interest. (D) The use is appropriate for the proposed location, is reasonably compatible with
adjacent uses and is not detrimental to urbanizing land use patterns. Yes, the use is appropriate for
