The 15" diameter access culvert shall be inspected following asphalt paving to assure that blockage has nat resulted. Any blockage shall be rectified prior to demobilization by the cantractar. D. Asphalt parking shall be Installed with finished grades matching exIsting grades. It is Intended that a smooth transition between NW 2nd Avenue and the parking slots result. Any confusion should be cleared up with the engineer of record prior to Initiation of activity. EROSION AND SEDIMENT CONTROL NOTES Construction activities can result In the generation of sIgnificant levels af pollutants, which may reach surface and/or ground waters. One of the primary pollutants of surface waters is sediment in erosion. ExcessIve quantities of sediment, reaching water bodies, has been shown to adversely affect the physical, biological and chemical properties of receiving waters. Transported sediment can obstruct stream channels, reduce the hydraulic capacity. reduce the conve)'Once capacity of culverts and other conve)'Once facilltes and adversely Impact benthic invertebrate and fish species through slltatotlon. Excessive suspended sediments reduce light penetration and therefare reduce primary productivity within these receiving systems. MINIMUM STANDARDS: 1. Sediment basins, perimeter berms. erosIon control barriers and other measures, Implemented to trap sediment transport. shall be constructed as the first step in any land disturbing activity and shall be made functional before any land disturbance takes place. 2. All sediment control measures are to be ad)Jsted to meet field conditions at the time of construction and be constructed prior to any grading or disturbance of existing surface material. Perimeter sediment barriers shall be constructed to prevent sediment or trash from flowing, floating :>r blowing onto adjacent properties. 3. Permanent or temporary soli stabilization shall be applied to denuded areas within seven days after final grade Is reached on any portion of the site. Temporary soil stabilization shall be applied within seven days to denuded areas that may not be at final grade, but will remain undisturbed for longer thon 30 days. Permanent stabilization shall be applied to areas that are to be left undisturbed for more than one year. 4. During construction of the project, soil stockpiles shall be stabilized or protected with sediment trapping measures. The oppllcant is responsible for the temporary protection and permanent stabilization of all stockpiles maintained on-site. as well as, soli intentionally transported from the site. 5. A permanent vegetative cover shall be established on denuded areas, nat otherwise permanently stabilized. Permanent vegetation shall not be considered established until a ground cover Is achieved that, in the opionion of the R~vlewer, Is uniform. mature enough to survive and will function to inhibit erosion. 6. Stabilization measures shall be applied ta earthen structures such as dams, perimeter berms, dikes and diversions Immediately following installation. 7. Surface runoff from disturbed areas, that are comprised of fiow from drainage areas greater than or equal to one acre, shall be controlled by a sediment basin, The sediment basin shall be designed and constructed to accomodate the anticipated sediment loading from the disturbed area. The outfall device or desIgn sholl take Into account the total drainage area flowing through the device fram the disturbed area. a. Following any significant rainfall event. sediment control structures will be inspected for integrity and functionality. Any damaged devices shall be corrected Immediately. 9. Concentrated runaff shall not flow down cut or fill slopes unless contained within an adequate temporary or permanent channel or structure. 10. Whenever water seeps from a slope face, adequate drainage or other effective protection shall be provided. 11. Before swales are made operational, compactian and sodding of these areas shall be campleted in accordance with the plans. 12. Periodic inspection and maintenance af all sediment control structures must be provIded to ensure that the Intended purpose is accomplished. The developer, awner and/or contractor shall be continually responsible for all sediment leaving the . property. Sediment control measures shall be in working condition at the end of each working day. 13. Where construction vehicle access routes IntElliSect paved public roads, provlelons shall be made to minImize the transport of sediment by tracking onto paved surfaces. Areas where sedIment is transported onto a public road surfaces shall be cleaned regularly. Sediment shall be removed from the roads by shoveling or sweeping with tranport to a sediment control disposal area. Street washing shall be allowed only after sediment is removed In this manner. 14-. All temporary erosion and sediment control measures shall be removed within 30 days after final site stabilization or after the temporary measures are no longer needed, in the opinion of the reviewer. Disturbed soil areas, resulting from the disposition of temporary measures, shall be permanently stabilized to prevent further erosian and/or sedimentation. 15. PropertIes and waterways downstream from the construction site shall be protected from sediment deposition and erosIon. 16. Erosion control design and construction shall follow the requirements in Index No. 101, 102 and 103 of FOOT Roadway and Traffic Design Standards. 17. The reviewer may approve modifications or alter the plans for these erosion control criteria due to site specific conditions. {PROJECT NUMBER 1 198 *~~~ d-7-~()Ol Loris C. Asmussen, P.E. Consider Petition No, 06-003-SE: Ted Kelchner is the applicant on behalf of property owner K Builders, Inc. The subject property is located at 1306 Southwest 2nd Avenue. The purpose for the request is to allow a metal enclosed storage building within a Light Commercial Zoning District (Ref. LDR' s Sec. 90- 253(11)). Board Member Burroughs motioned to approve Petition No. 06-003-V, submitted by Randy G. Whaley on behalf of property owners Ernest and Ella Whaley, to allow a single family dwelling to be built on a lot, 50 feet wide and 6,650 square feet of area; seconded by Board Member Maxwell. (Note for clarification: due to information provided by Mr. Maxwell as discussed above, this motion is not necessary since a variance is not needed). VOTE HOOVER - NAY KELLER - NAY LEDFERD - YEA MAxWELL - YEA MCCOY - NAY BURROUGHS-YEA JOHNS - YEA MOTION CARRIED. Mr. LaRue briefly reviewed the Staff Report as follows: Planning Staff Report Discussion: (A) The enclosed storage for the professional office is not contrary to the Comprehensive Plan. (B) Section 90-253(11) of the Land Development code includeo. enclosed storage as a special exception use. (C) A service will be provided as this is for storage. (D) The use is appropriate and compatible with adjacent uses. It should be determined whether or not separate parking should be allocated for the storage facility. It is assumed that the shed is for internal use only, not for a separate commercial/storage use which would require separate parking. (E) This use will not be a deterrent if the property is properly landscaped. (F) This is a possibility, but the location as shown probably does not require this precaution. (G) Density is not an issue. (H) Public safety will not be an issue. Planning Staff Report Recommendation: Based on the above Special Exception findings and on the condition that the storage is restricted for owner use only, the request should be approved. Should there be any aesthetic requirements for this storage facility, they can be imposed as conditions of approval. There was a brief discussion. :JlO IV. NEW BUSINESS CONTINUED. B. Consider Petition No. 06-003-SE continued. c. Consider Petition No. 06-004-SE: Malissa Morgan is the applicant on behalf of property owner A Child's World Childcare and Preschool, mc. The subject property is located at 702 and 704 Southwest 7th A venue. The purpose for the request is to allow a Day Care Center within a Residential Multiple Family Zoning District (Ref. LDR's Sec. 90-193(4)). Board Member Maxwell moved to approve Petition No. 06-003-SE submitted by Ted Kelclmer on behalf of property owner K Builders, Inc. to allow a metal enclosed storage building within a Light Commercial Zoning District (Ref. LDR's Sec. 90-253(11)), with the special conditions that the storage building be used for applicants use only and landscaping be added; seconded by Board Member McCoy. VOTE HOOVER - YEA KELLER - YEA LEDFERD - YEA MAxWELL - YEA McCoy - YEA BURROUGHS-YEA JOHNS-YEA MOTION CARRIED. Mr. LaRue briefly reviewed the Staff Report as follows: Planning Staff Report Discussion: (A) Should the applicant's request for the RMF Zoning be approved, then the proposed use would not be contrary to the Comprehensive Plan requirements. (B) Se<;tion 90-193(4) allows a day care center as a Special Exception use in the proposed RM Zoning District. (C) Public interest will not be adversely affected by this day-care facility as it will provide needed services to the community. (D) The use is appropriate for the proposed location and will provide reasonable compatibility with adjacent uses. The property is bordered on two sides by residential uses with a public school across the street. The proposed special exception use will relate well with surrounding land uses. (E) The proposed use will not adversely affect adjacent property. (F) The property must meet the City's landscaping requirements to provide suitable buffering. (G) The proposed use is not expected overburden facilities. (H) Staff does not view this is an issue because traffic flow will be based on ingress/egress and the hours of operation. Planning Staff Report Recommendation: Based on the findings contained in this report it is recommended for approval. It shall also be a condition of approval that the parking for employees and drop-off be approved by the City Engineer. tit 1375 Jackson -,t, Suite 206 Fort Myers, FlolWfa 33901-2845 Phone: 239-334-3366 Fax: 239-334-6384 Email: larue-planning@att.net LaRue Planning & Mana ement Services, Inc. The use is not contrary to the Comprehensive Plan requirements. The enclosed storage for the professional office is not contrary to the Comprehensive Plan. Page -1- . -- Applicant's Name: K-Builders, Inc. Petition No. 06-003-SE Staff Report Special Exception Request B. The use is specifically authorized as a special exception use in the zoning district. Yes, Section 90-253(11) of the Land Development Code includes enclosed storage as a special exception use. C. The use will not have an adverse effect on the public interest. No, a service will be provided as this is for storage. D. The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. Yes, the use is appropriate and compatible with adjacent uses. It should be determined whether or not separate parking should be allocated for the storage facility. It is assumed that the shed is for internal use only, not for a separate commercial/storage use which would require separate parking. E. The use will not adversely affect property values or living conditions, nor be a deterrent to the development of adjacent property. No, this use will not be a deterrent if the property is property landscaped. F. The use may be required to be screenedfrom surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. This is a possibility, but the location as shown probably doesn't require this precaution. G. The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. No, density is not an issue. H. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. No, public safety will not be an issue. Page -2- e Applicant's !e: K-Builders, Inc.
