Consider Petition 06-001-SE: Simon Glazer is the applicant on behalf of property
owner(s) Whidden Enterprise, Inc. The subject property is located at 221
Northeast Park Street. The purpose for the request is to allow for an outdoor
vehicle sales lot (Ref. LDR 90-313 (11)) within a Central Business District
(CBD) Zoning District.

Board Member Whidden stated for the record that he would participate in the discussion on this
matter but he would be abstaining from the vote as he has a conflict of interest being that he is the
President of Whidden Enterprises, Inc., property owner.
Chairperson Ledferd stated that there was still a quorum of voting members.
Mr. Jim LaRue, City Planning Consultant, briefly reviewed the Staff Report as follows:
Planning Staff Report Item Before the Board of Adjustments: The matter for consideration
by the City of Okeechobee Board of Adjustment is an application requesting a Special Exception
in the CBD Zoning District for property located at 221 Northeast Park Street/Highway
70/Northeast 3rd Avenue, legal description being: Lot 12 of Block 153, Okeechobee. The petition
was submitted by applicant Simon Glazer, on behalf of property owner Whidden Enterprise, Inc.
Planning Staff Report Discussion: When reaching a conclusion on a Special Exception, the
Board of Adjustment shall consider and show in its record the following findings: (A) The use
is not contrary to the Comprehensive Plan requirements. (B) The use is specifically authorized
as a special exception use in the zoning district. Section 90-313(11) of the Land Development
Code includes an outdoor vehicle sales lot as a special exception use. (C) The use will not have
an adverse effect on the public interest. (D) The use is appropriate for the proposed location, is
reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns.

(E) The use will not adversely affect property values or living conditions, nor be a deterrent to the
development of adjacent property. (F) The use may be required to be screened from surrounding
uses to reduce the impact of any nuisance or hazard to adjacent uses. (G) The use will not create
a density pattern that will overburden public facilities such as schools, streets and utility services.
(H) The use will not create traffic congestion, flooding or drainage problems, or otherwise affect
public safety. The applicant will be required to properly design the site in order to prevent traffic
congestion in terms of ingress/egress.
Planning Staff Report Recommendation: Move that Petition No. 06-001-SE be approved with
adequate provisions given for ingress/egress, available parking and landscaping. These conditions
should be examined during the site plan review phase.
Attorney Cook recommended that if the Special Exception was granted, it be granted with the
special condition that it be granted to this applicant only, the Special Exception would not follow
the land.
There was a lengthy discussion between the Board and Staff regarding the application meeting the
special exception criteria. Specially, that the proposed location is not appropriate for this use within
a Central Commercial Business Zoning District. That the impact of traffic generated on and off the
site could not be handled appropriately. That the size of the parcel (two lots) was too small to
support this specific use. The consensus was that the application was not in the best interest of the
public nor in harmony with the requirements to be met for a special exception.
Mr. Whidden explained that he met with Public Works Director Robertson regarding on-street
parking, and that the City would strip the parking, clearing defining the area, that it would be either
parallel or angled, which would control the traffic situation on and off the site. Committee Member
Hoover responded that stripping the on-street parking would not eliminate the potential traffic
problems due to the location of the site.
Board Member McCoy motioned to deny Petition 06-001-SE allowing an outdoor vehicle sales
lot within a Central Business District (CBD) Zoning District; seconded by Board Member Hoover.
