Item 2. Leonard and Patsy McCann request a rezoni4g of lots 11 and
12, Block 143, City of Okeechobee. These ¡two lots are located
at 311 N. E. 2nd Street. If granted the ~ezoning the present
house on these lots will be renovated and ¡turned into a flower
shop. The parcels already rezoned to co~ercial are of a soft-
core type and a flower shop would fit thi~ description.

Item 3. This item of a livestock ordinance has be~n discussed before,
the last time being when Dale Burk said t~e City Council was
putting such an ordinance in effect. At that time there was
some discussion as to whether they were o~ not and Member
Ferneau moved to table this item until thej results of the Council
were known. The City Council only amended! an ordinance in effect,
therefore, this item is again brought befo~e the Board. All
Members should have received livestock ord~nances pretaining to
other cities the size of Okeechobee. If yþu do not: have a copy

Chairman Kirk stated he had a couple of correctiolto the minutes. Under "Approval

Chairman Kirk stated this was all he found and aSk1d if anyone else had any cor-

OKEECHOBEE RESIDENTIAL SERVICES, INC. I
Chairman Kirk stated the next item on the agenda i~ Okeechobee Residential Services,
Inc. - Request for a Special Exception for a Group Home Ion Lots 10, 11, and 12, Block 204,

First addition to Okeechobee. These three lots are loctted on the N.W. Corner of the
intersection of S. E. 3rd Street and S. E. 4th Avenue.
Chairman Kirk asked if someone here was representifg Okeechobee Residential Services,
Inc.
Attorney Burton Conner stated he was representing ~keechobee Residential Services, In
He stated the Board should have received copies of the flans for the facility. He briefly
summarized to the Board that the facility would be a stfndard residential structure with

4 bedrooms, 2 baths (one bath between each 2 sets of befroomSJ. There would be 2 clients
in each bedroom for a total of 8 clients, plus house pa ents room, living room, dining
room, kitchen, garage and screened porch area. It will look like a standard residence
I
only a little bit larger. I
I
Clients that are presently being served by Okeecho ee Rehabilitation Facility dur-
ing the day, in the sense of working at the nursery or ttending programs there, will be
staying there at night. They will be paying room and ard for living at the facility.
Attorney Conner stated this facility will be finanfed by HUD and since the present
Ordinance of District Regulations does not allow for Gr~up Housing and before they can
get final approval by the City, the Ordinance will havk to be amended.

Okeechobee Residential Services, Inc. has filed aPflication for a Special Exception
realizing tha~ technically speaking as of this moment, I there is no provision under the
zoning ordinance but hopefully the Planning Board will *ake this recommendation to the
I
City Council that the zoning ordinance be amended to prfvide for group homes in the RG-1

and RG-2 classification. We are asking for approval of'the applications for Special Ex-
ception contingent upon the amendment to the ordinance ~eing adopted by the City Council.

Okeechobee Residential Services, Inc., intends to build 2 structures, 1 on the
N. E. corner of the old hospital which is county property zoned Governmental, no pro-
blem there. The one talked about tonight is at the corner of S. E. 4th Avenue and S.E.
3rd Street and is zoned Residential-General 2.
Attorney Conner asked if any Board Member had anr questions.
Member Altobello asked about the structure Northlof the old hospital.
Attorney Conner stated again it is to be a home 4lso to handle 8 clients. These

clients are being presently cared for by parents and 4s they (parents] become older or
disabled, who will provide for these clients. These ~omes provide facilities where
I

clients can be self supporting, yet have back up systefs with everyday needs. These are
not nursing homes with 24 hour care. I

Member Wright asked how many full time employees ~ould be in each of these bUildings?

Mr. Ellsworth, Director of Okeechobee Rehabilitat~on Serv., stated there will be

3 sets of house parents. Two there at all times, one fS a back up or rotating.
Chairman Kirk asked if anyone in the audience hadany comments either for or
against this request. I

Mr. Jim Boromei, owner of Lots 1 and 2, Block 204~ stated he was against it. He
asked why they didn't build this over on County land i4 government owned.
Attorney Conner stated it is going to be financed Iby HUD but will be owned by a
Non-Profit Corporation_ I

Mrs. Jim Boromei stated they had lived in the areal all their lives and didn't need
the extra noise, traffic, etc. and that it isn't fair tb have it zoned Commercial when it'
been residential.

Attorney Conner informed Mn. Boromei it would not t" rezoned Commercial.
Mrs. Lottie Raulerson stated that when the applica ion was made 3 years ago to HUD
offices, the County agreed they could build both houses Ion the old hospital property.
After someone from HUD came down and looked over the pr4perty they were informed they
could only put one house on that property. It would ha e been less expensive to build
2 homes there, but governmental red tape said no only o~e house in that area and that's
the reason they had to go elsewhere. I

Further discussion ensued with Mr. and Mrs. Jim Borþmei, Russell Heiderman, Mae
Cooper and Gloria Boromei all expressing their reasons wPy they didn't want this
in their neighborhood. The consensus being this is a on~ family residential area.

Louise Gore and Connie Johnson, both stated they ar~ for this project. Ms. Gore
I
stated she has a son who would be living in this structufe.
Attorney Conner pointed out that Residential-Genera4 2 classification permits multi-
family dwellings or apartment complexes. They did not i~tend to go to this degree of
density. He also stated it is a violation of State and ~ederal laws to discriminate

against developmentally disabled people. He further sta~ed no doubt about it, the Zoning
Ordinance is going to have to provide for Special Exceptirn for Group Hames. There's not
too many choices of where to permit Special Exception for Group Homes and RG-2 classifi-

cation seems a logical place for it. I
Mr. Ed Ellsworth then stated he wished to clarify a few things. First, that Okee-
chobee Residential Services, Inc. is an affiliate corpora1:0n of Okeechobee Rehabilitation
Facility. It's not a governmental unit but a private cor, ration.

He also stated this home is badly needed. What wou14 be your concern if you had a
retarded person? Where would you want your child to be if something happened to you?
Mr. Ellsworth stated they hadn't had any problems with an~ of the clients in the last 10
months. He also stated there are probably more people wit~ developmental disability than
the Facility or School System even know about in the commurity.

Yr. Bill Shea, an emplQyee Q~ µRS who works with group homes, stated this home has
mQre than adequate space and certainly can't detract from the Community.
Chairman Kirk then asked the Board Members if they had any questions.
Member Wright asked Mr. Ellsworth since he had stated they had no disruptive
problems in the past 10 months, had there been problems prior to that time.
Mr. Ellsworth stated he was new at the Facility an~ could not say.
Mrs. Lottie Raulerson stated she's been Chairman of the Board for 12 years or so

and there has never been any prQblem as far as disruptite behavior. Now and then a
i
client has had an epileptic seizure if they didn't takf their medication, usually new
clients. when this became known to the Facility they m~de sure the medication was taken
and that has taken care of the problem.
Member Altobello stated he has?ì~operty directly açross the street from the Facility
fQr eigþt years and he has never had one problem. Thes~ people have worked around his

pr9perty and never any problems. They only need a chanþe to live a normal life. Everyone
has been nice and polite.
Chairman Kirk asked what constitutes a group home?
Bill Shea stated a group home is 4 to 8 people. A foster home is 1 to 3 people.
Chairman Kirk stated if there are no more comments the Board would go over the
findings for Special Exception.
After the findings were complete and all in accordr Chairman Kirk stated the chair

would entertain a motion subject to the Planning Board'f recommendation to amend Ordinance

#402 and the City Council's enacting such an Ordinance.!

Member Altobello moved to grant a Special Exceptior for a group home on Lots 10,

11 and 12, Block 204, First addition to Okeechobee, contingent on Amendment of Ordinance

#402 to allow group housing in RG-2 classification Seçonded by Member Ferneau. All

DEPT. OF TRANSPORTATION - REQUEST 6 MO. EXTENSION
Chairman Kirk stated the next item on the agenda i$ a letter of request from the

Department of Transporation for a 6 month extension to ~llow project engineer's construc-
I
tion trailer to remain within the City limits. I

Chairman Kirk stated Mr. Westbrook had something oþ this and asked Mr. Westbrook to

advise the Board. I

Mr. Westbrook explained that about a year ago he hfd written letters to people who
I
had mobile units in the area, where it was allowed. On~ was Indian River Community
I
one was the Driver's License Office and one was the DePf' of Transportation. We allowed
them a year to move them. The year has expired and D.OfT. has written asking for a 6
i
month extension until they get the project finished. I

Discussion ensued as to whether the Board could grfnt the extension without adver-

tising. i

Member Ferneau moved to table this item until furt~er study was made. Seconded

Chairman Kirk called the Planning Board into session.
APPROVAL OF MINUTES
Chairman Kirk asked if any of the Members had any çorrections or additions to the
minutes and if not, the chair would entertain a motion FO accept the minutes as

PROPOSED AMENDMENT TO ZONING 9RDINANCE #402
Chairman Kirk stated the next item on the agenda wFs a proposed amendement to
Zoning Ordinance #402, District Regulations, Residentia~ General 1 and 2 and Commercial,
Professional, Offices Districts to allow group housing y Special Exception.
Chairman Kirk inquired if we were going to do thisl in CPO district also.
Mr. Westbrook stated this was just a rough draft aþd it could be scratched if the

Board wanted, but we had to start somewhere. :
Member Ferneau stated his feelings on the matter a~e a group houme is for RG-l and
RG-2 areas and pllowing in RSF and CPO would be a mista e and he moved to scratch CPO.
Member Miller, being a new member, asked Why scratþh the CPO?

Chairman Kirk stated that group housing does fit -1 and RG-2. He stated this
classification allows building row houses, townhouses apartments and he didn't think
this type housing should be wedged between two professi offices.
After further discussion concerning the rough draf of the amendment, Member Ferneau
moved to propose to City Council an amendment to allow, by Special Exception, group
housing in RG-1 and RG-2 areas only. Seconded by Membe Wright. Vote unanimous.

Discussion ensued concerning the definition of grOfP housing. A group home can be
4 to 16 people, but anything over 16 would be getting i to a mini institution.
Member Wright suggested with more than 10 it could cause a potential problem and
would be easier to control with just 10 people. I
After polling the Board, the consensus was 8 clienps and 2 house parents to be the
best. !
Attorney Conlon read the definition for Group HOUS~ng to be:

"Group Housing is defined to be residential in {Jature with no
more than 10 unrelated persons per unit, incluting full time
staff persons residing thereon".

Member Wright moved to accept this definition for roup Housing. Seconded by Member
Ferneau. Motion carried.
Attorney Conlon inquired if the Board wanted to re uire a shrubbery zone.
Chairman Kirk and Member Wright both stated they f el this isn't necessary. Member
Wright also stated after seeing the plans for the home e didn't think it was needed and
he felt a cases by case requirement would be sufficient Member Miller agreed.
Chairman Kirk state~ then they would leave it as i is and all agreed.
Attorney Conner and the Okeechobee Rehabilitative ervices people thanked the Board
and left the meeting.
MOSE JOINER -
Chairman Kirk stated the next item on the agenda w~s Mose Joiner's request for re-
zoning from RG-2 to Commercial on Lots 1 and 2, Block 1~3, City of Okeechobee. This
item tabled from meeting of August 3, 1982. Granting of request would allow Mr. Joiner
to build three and possibly four retail stores on this nroperty.

Chairman Kirk asked Mr. Joiner if he had anything to say to the Board.
Mr. Joiner stated he was asked to redraw the plans with different parking spaces
by the Board and he had done so, and gave the plans to Mr. Westbrook and Mr. Westbrook
stated they looked O.K.
The Board discussed the parking area and decided tarking appropriate.
Chairman Kirk asked if anybody else had any comme ts. As there were none, the
Board reviewed the findings for rezoning.
Following the findings and all members in accord, Member Wright moved to grant
request for rezoning from RG-2 to Commercial on Lots 1 and 2, Block 163. Seconded by
Member Altobello.
At this point, Member Altobello inquired if Lizzi~ Kersey, who had objected at the
August 3rd meeting, had been notified the meeting was c~anged from September 7th to August

31st. He was informed that she hadn't been notified. I

Member Wright withdrew his motion to grant rezonilg and Member Altobello moved to
strike all findings from the record and to table this 'tem until September 7th and to
notify Ms. Kersey of the meeting. Seconded by Member right. Motion carried_
Member Ferneau pointed out that a time limit Shoutd have been placed on the
Special Exception for completion. Although this is n.t mandatory it is a good idea.
