Would you please pass on these comments to the parties in charge. I have no problems agreeing to give the City the 70-foot right-of-way running north and south through my property when the project has been completed. I have asked for the property to be zoned commercial so that I can go forward with commercially developing the property. I plan to follow the rendering which I submitted to the City and build as the economic policies of the City, County and State would allow. As you know, I have no control over the economics of this country and/or the county and state. I cannot be tied down as to when I shall commence construction and complete con- struction. These are out of my control. If the City wants to give me my commerical zoning without strings attached, I am agreeable to making a gift to the City of the 70-foot right of way through my property when the project is completed. I feel this is magnanimous on my part since the City needs the right-of-way to get to its property to the north of my property. . Please advise if we can proceed along these lines. M, Taylor property from Residential Single Family \ nSF) to Commercial (C) for the purpose of construction of warehouses. Councilman \.Jatford questioned the conditions that Here attached to this request by the Planning and Zoning Board and whether these conditions should be in the motion. Councilr:Iim Chapman withdrew his original motion until the matter is cleared. Councilman Watfol'd moved to amend Section 4 of the proposed ordinance pertaining to the :ffoctive date. The ordinance is to )1ead: "This ordinance shall become effective at the time ,llld upon the condition that the owner execute an agreement to comply with the Planning Board's . . conditions and that the agreement must be executed within 60 days." .' Third Avenue Okeechobee, Florida 33472 Gentlemen: This letter is to confirm that I have appointed Phil Berger my agent to go forward in obtaining commercial zoning on the approximately 20 acres which I own east of Taylor Creek on the north side of Highway 70. In addition, it is to confirm that I have agreed to give to the City a 70-foot right-of-way running north and south connecting with 10th Avenue contingent upon the City zoning the approximately 20 acres commercial and the City, at its expense, putting in the road within nine months from the date of this letter, running north and south over the 70 feet which Mr. Berger has informed me that the City requires. In addition, the City is to have an easement to run water and sewer on whichever side of the street that they decide and the City shall agree that this water and sewer will be run the length of the property which I am giving the City at no expense to me as consideration for the 70 feet. If you have any questions, Mr. Berger has the authority to speak on my behalf.
