lying North of the North right of way line of State Road NO. 70, EXCEPT the
North 50 feet of the W~ of W~ of the SW~ of SE~ for road purposes; also EXCEPT
the following described property conveyed to the State of Florida:

Dear Mrs. Thomas:
This is to acknowledge receipt of your letter of October 8,
1981, along with its enclosure. Would you please pass on
these comments to the parties in charge.
I have no problems agreeing to give the City the 70-foot
right-of-way running north and south through my property
when the project has been completed. I have asked for the
property to be zoned commercial so that I can go forward
with commercially developing the property. I plan to follow
the rendering which I submitted to the City and build as the
economic policies of the City, County and State would allow.
As you know, I have no control over the economics of this
country and/or the county and state. I cannot be tied down
as to when I shall commence construction and complete con-
struction. These are out of my control.
If the City wants to give me my commerical zoning without
strings attached, I am agreeable to making a gift to the
City of the 70-foot right of way through my property when
the project is completed. I feel this is magnanimous on my
part since the City needs the right-of-way to get to its
property to the north of my property.
. Please advise if we can proceed along these lines.

After brief discussion with the public regarding this request, Councilman Chapman moved
Jpprove the request for rezoning of the L. M, Taylor property from Residential Single Family
\ nSF) to Commercial (C) for the purpose of construction of warehouses.
Councilman \.Jatford questioned the conditions that Here attached to this request by the
Planning and Zoning Board and whether these conditions should be in the motion.
Councilr:Iim Chapman withdrew his original motion until the matter is cleared.
Councilman Watfol'd moved to amend Section 4 of the proposed ordinance pertaining to the
:ffoctive date. The ordinance is to )1ead: "This ordinance shall become effective at the time
,llld upon the condition that the owner execute an agreement to comply with the Planning Board's

conditions and that the agreement must be executed within 60 days."

For the benefit of the public, Chairman Pro-Tern Burk read the eight (8) conditions of the
Planning & Zoning Board:
1) The rendering presented is made a part of the request for our official files.
2) That actual construction in accordance with the rendering is commenced within 180 days
from August 4, 1981.
3) That construction be based upon the proposed rendering and not material variance from it.
4) That construction will be completed within 365 days.
5) That the 70 foot right-of-way shown on the rendering be granted to the public within 180
days commencing construction.
6) That adequate drainage is provided for and certified by the City engineer
prior to any occupancy of the structure requiring drainage.
7) That the parking lot be paved and landscaped as presented in the rendering,
8) The board consider any extention of any of the times the hearing provided upon request.
Councilman Chapman seconded Councilman Watford's motion to amend the ordinance. Motion

Councilman Chapman moved to adopt the ordinance as amended. Seconded by Councilman

After brief discussion with Council members and the public on the rezoning request,

STREET LIGHTING AGREEMENT
WITH FLORIDA POWER AND LIGHT
Chairman Pro-Tern Burk explained the purpose of the high pressure sodium vapor street

Gentlemen:
This letter is to confirm that I have appointed Phil Berger
my agent to go forward in obtaining commercial zoning on
the approximately 20 acres which I own east of Taylor Creek
on the north side of Highway 70.
In addition, it is to confirm that I have agreed to give to
the City a 70-foot right-of-way running north and south
connecting with 10th Avenue contingent upon the City zoning
the approximately 20 acres commercial and the City, at its
expense, putting in the road within nine months from the
date of this letter, running north and south over the 70 feet
which Mr. Berger has informed me that the City requires.
In addition, the City is to have an easement to run water
and sewer on whichever side of the street that they decide
and the City shall agree that this water and sewer will be
run the length of the property which I am giving the City
at no expense to me as consideration for the 70 feet.
If you have any questions, Mr. Berger has the authority to
speak on my behalf.
Mr. Berger has informed me that the City is requesting an
artist's rendering showing the commercial area that is to
be developed and I am in the process of having same prepared.

Gentlemen:
This letter is to confirm that I have appointed Phil Berger
my agent to go forward in obtaining commercial zoning on
the approximately 20 acres which I own east of Taylor Creek
on the north side of Highway 70.
In addition, it is to confirm that I have agreed to give to
the City a 70-foot right-of-way running north and south
connecting with 10th Avenue contingent upon the City zoning
the approximately 20 acres commercial and the City, at its
expense, putting in the road within nine months from the
date of this letter, running north and south over the 70 feet
which Mr. Berger has informed me that the City requires.
In addition, the City is to have an easement to run water
and sewer on whichever side of the street that they decide
and the City shall agree that this water and sewer will be
run the length of the property which I am giving the City
at no expense to me as consideration for the 70 feet.
If you have any questions, Mr. Berger has the authority to
speak on my behalf.
Mr. Berger has informed me that the City is requesting an
artist's rendering showing the commercial area that is to
be developed and I am in the process of having same prepar
