Mr. Brisson presented the Planning Staff Report, citing based on the analysis and findings; use not being contrary to the Comprehensive_ Plan, use being specifically authorized as a special exception use in the Commercial Professional Office (CPO) Zoning District, creatir no adverse effect on public interest, appropriate for proposed location, not adversely affect property values or living conditions, nc being a deterrent to the development of adjacent property, will not create a density pattern that will over burden public facilities, ar! not creating traffic congestion, flooding or drainage problems that otherwise affect public safety, Staff recommends approval. However the use may be required to be screened from surrounding uses. Jeb Acuff, representing Visiting Nurses Association of Florida, Inc. addressed the board regarding the Special Exception Petition. H distributed additional responses addressing City codes. 1 IV. Code Book Section 90- 193(3)) for property located at 315 and 317 Southeast 3rd Avenue. Legal description: Lots 7, 8, 9,10,11 and 12, Block 209 First Addition to Okeechobee, according to the plat thereof, as recorded in Plat Book 5, page 6, of the Public Records of Okeechobee County, Florida and is approximately 0.975 acre(s) - Planning Consultant. JULY 17, 2008 PLANNING BOARDIBOARD OF ADJUSTMENT AND APPEALS - PAGE 3 Mr. Acuff stated the residents of the ALF would be transported by the facility staff. The facility would be comprised of 31 units and 37 residents. Mr. Acuff responded to questions from the board regarding the type of residents that would be permitted in the facility. Mr. Acuff stated they will not be accepting Alzheimer patients. The board asked if security would be provided. He replied, yes. Vice Chair Hoover explained this is not a nursing home, but an ALF. This to assist persons who can basically care for themselves, but possibly cannot cook or need help with administering medication, or live in a safe living environment due to having no family to care for them. John Vanberschot, 210 Southeast 3rd Street expressed his concern over traffic congestion, semi - trucks, and commercial growth in a residential neighborhood. Karen Brass, 201 Southeast 3rd Street expressed her concems about traffic impact, semi -truck arrival and departure and privacy. The board inquired regarding the height of the building and the parking requirements. Mr. Brisson stated the height of the building was permitted through the codes and the parking would be addressed at site plan review. Board Member Burroughs moved to approve Special Exception Petition No. 08- 008 -SE to allow an assisted living facility within Commercial Professional Office (CPO) for property located on 203 Southeast 2nd Street with Technical Review Committee to take note of parking, delivery schedule time, landscaping as set forth in the City Ordinance and that the site plan is consistent with the size of the lot; seconded by Board Member Maxwell. HOOVER -YEA MAXWELL - YEA KELLER -YEA O'CONNOR - YEA Consider Special Exception Petition No. 08- 009 -SE submitted by Lisa Blackman on behalf of property owner Hospice of Okeechobee, Inc. to allow group homes within a Residential Multi - Family (RMF) Zoning district (Ref. Code Book Section 90- 1693(3)) for property located at 315 and 317 Southeast 3rd Avenue. Legal description: Lots 7, 8, 9,10,11 and 12, Block 209 First Addition to Okeechobee, according to the plat thereof, as recorded in Plat Book 5, page 6, of the Public Records of Okeechobee County, Florida and is approximately 0.975 acre(s). Mr. Brisson presented the Planning Staff Report of approval stating this use for group homes does qualify by both the state statute and the city code. The occupancy of 6 or more unrelated persons per group home is less dense should there be four single family homes on this parcel, which is the density that is allowed. IV. Consider and discuss requests for amendments to the City's Land Development Regulations - Chairperson. B. Election of Chairperson and Vice Chairperson, 10 month term ending May 2009. JULY 17, 2008 PLANNING BOARD/BOARD OF ADJUSTMENT AND APPEALS - PAGE 4 OF Each unit should be treated as Single Family for consistency, due to Future Land Use being Single Family. Marie Culbreth, representing Hospice addressed the board. She explained parking was being addressed by a volunteer to asphalt 1s parking spaces in the rear of the homes. She also stated the only way Hospice can compete in the job market is to offer housing. Karen Brass, 201 Southeast 3rd Street added if the occupancy was limited to staff there would be no problem. John Vanberschot, 210 Southeast 3rd Street stated the window of his bedroom is only 62 feet from the group home. He has talke previously with Lisa Blackman, director of Hospice of Okeechobee, concerning visitors to staff playing music too loud, being intoxicate( and blowing their car horns to announce their arrival. It was suggested that if the problem persists to contact the Hospice home office Board Member O'Connor moved to approve Special Exception Petition No. 08- 009 -SE to allow group homes within Residential Mull( Family(RMF) Zoning District to stay with the current property owner for property located at 315 and 317 Southeast 3rd Avenue; seconde by Board Member Burroughs. Election of Chairperson and Vice Chairperson, 10 month term ending May 2009. Chairperson Bill Ledferd addressed the board and reported he was resigning. He stated he would provide his letter of resignation t:: the Clerk's office July 18, 2008, he then opened the nominations. Board Member O'Connor nominated Board Member Maxwell to the Chairperson position, and Vice Chairperson Hoover for Vico Chairperson; seconded by Board Member Burroughs. 1 1 V. NEW BUSINESS CONTINUED. Staff Report Special Exception Request Applicant's Name: VNA of Fla Petition No. 08- 008 -SE Description of the Situation: The subject property has a Future Land Use Map designation of Commercial and the City Council approved rezoning to the CPO Zoning District on the Official Zoning Map on June 3, 2008. Approval of a Special Exception is required in order to allow an assisted living facility on the property. The Applicant is requesting to construct a three -story assisted living facility on the subject property. The facility will provide care for up to 37 residents and will have about 18 employees. The facility will operate 24 hours -a- day, but deliveries will be limited to between the hours of 7 am and 7 pm. In addition to the general requirements and limitations applicable to all uses in the CPO district, the Applicant must comply with the supplementary regulations for adult family care homes and assisted living facilities set forth in Section 90 -695. Consistency with Land Development Regulations: Section 70 -373 (b) requires that the Applicant address, during his/her presentation to the Board of Adjustment, the following standards for granting a Special Exception. The Applicant has not submitted materials addressing these standards as part of the Appli- cation, and will need to make his case at the meeting. (1) Demonstrate that the proposed location and site are appropriate for the use. (2) Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood, or explain why no specific design efforts are needed. (3) Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual screening is necessary. (4) Demonstrate what is proposed to reduce the impacts of any potential hazards, problems or public nuisance generated by the use or explain how the nature of the use creates no such potential problems. (5) Demonstrate how the utilities and other service requirements of the use can be met. (6) Demonstrate how the impact of traffic generation will be handled off site and on- site. Page -4- Staff Report Applicant's Name: VNA of Fla Special Exception Request Petition No. 08-008 -SE When reaching a conclusion on a Special Exception request, the Board of Adjustment shall consider and show in its record the following findings as set forth in Section 70- 373(c). Following are the Staff comments pertaining to these findings: A. The use is not contrary to the Comprehensive Plan requirements. The property is designated Commercial on the Future Land Use Map and the proposed use is not contrary to any provision in the Comprehensive Plan. B. The use is specifically authorized as a special exception use in the zoning district. Section 90 -223 specifically authorizes adult family care homes or assisted living facilities (ALF) as a special exception use within the CPO Zoning District. C. The use will not have an adverse effect on the public interest. An assisted living facility will not have an adverse effect on the public interest as there appears to be a recognized need for such facilities in the community. D. The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. As can be seen on the aerial at the end of this report, the subject property is surrounded by nonresidential uses to the north, east, and west. Across SE 2nd Street to the south, there are four single- family dwellings and a multi - family building. The multi - family property is actually zoned CPO. It is clear from the pattern of recent rezonings and land use changes that the City Council envisions the possibility of commercial expansion within the area two blocks deep east of US 441, bordered by multi- family and single - family development. The proposed assisted living facility is appropriate for this location. It is reasonably compatible with adjacent uses and is not contrary or detrimental to urbanizing land use patterns. E. The use will not adversely affect properly values or living conditions, nor be a deterrent to the development of adjacent property. An assisted living facility should not adversely affect property values or living conditions in the area. However, Staff recognizes that such a facility will have some impact on the residential uses to the immediate south and perhaps other nearby residential uses. Therefore, care must be taken to ensure that parking is adequate to avoid overflow of parking demand into the nearby residential streets and ingress and egress points are located so as to minimize potential traffic impacts. The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. If the facility takes the form of a single, three -story structure, considerable berming and/or landscaping may be necessary to soften the appearance of the structure as seen from the residential uses to the south. Such factors will be considered by the Technical Review Committee during the site plan review phase of development. G. The use will not create a density pattern that will overburden public facilities such as schools, streets, and utility services. The number of clients served by the proposed facility is not expected to overburden public utility services and assisted living facilities have no impact on school facilities. Based on the 7th Edition, ITE Trip Generation Manual, an assisted living facility has an average trip generation rate of 2.66 trips per assisted living unit per day, with 0.22 trips/day at peak hour. Using these figures, a 37 -unit assisted living facility could be expected to generate about 98 trips per day and eight trips during the PM peak hour. Staff does not believe this level of traffic will either adversely affect the City's ability to maintain its adopted levels of service or result in traffic congestion in the area. However, as noted previously under item E, adequacy of parking and location of ingress and egress points must be carefully considered. H. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. As noted in item G, traffic congestion is not expected as a result of the location of an assisted living facility at this location. Given sound drainage and stormwater management one would not expect flooding or drainage problems. These issues will be specifically addressed by the TRC during its review of the project's site plan. Recommendation: Based upon the foregoing analysis and findings, Staff recommends that Petition No. 08- 008-SE be approved. Submitted by: James G. Located at 411 SE 4th Street in Okeechobee, our hospice residence has been extending a special kind of caring to the residents of Okeechobee for the past twenty three months. During that time we have cared for one hundred and fifty six patients in the home. Some patients called the residence their "home" for several months, while others stayed for only two days. All received the compassionate, skillful care that Hospice of Okeechobee is known for. Their final time on this earth was spent in the warm homelike surroundings of The Hamrick Home, where they were given comfort care by the hospice nurses and nurse's aides. Hospice of Okeechobee opened The Hamrick Home in the midst of a well - publicized national nursing shortage. The organization was blessed to have inherited the property next to The Hamrick Home upon the death of Frieda Hamrick. This property is already zoned for multi - family use. Offering housing to staff members helps to attract / hire top notch professionals — both nurses and nurse's aides. Operating The Hamrick Home without additional funding from the government has proven to be a financial drain on Hospice of Okeechobee. Offering staff housing allows hospice to employ top quality professionals without having to offer overly high salaries, which the organization could not afford. It is important to note that the occupants of the proposed staff housing will be medical professionals: quiet, respectful neighbors that will blend in well to the existing neighborhood. A typical example would be a single nurse, who works the night shift at The Hamrick Home while enjoying the luxury of living close to her job. In summation, by approving this project you will be assisting Hospice of Okeechobee in providing a community service. Nationally, it is most unusual for a small rural community to enjoy the benefit of having a hospice residence located in their community. Petition No. 08-009 -SE Description of the Situation: The Applicant wishes to provide housing for its staff of medical professionals who work at the Hamrick Home (411 SE 4th Street). The Hamrick Home is run as a hospice group home by Hospice of Okeechobee and is located immediately to the east of the subject property on just over two acres. The subject property is comprised of two lots of just about equal size with the whole parcel totaling about 0.98 acre. The westernmost lot fronting on SE 3rd Avenue contains two residential structures. One is a previously permitted two - story structure with four bedrooms; the second is a one -story structure which is being expanded to accommodate up to five bedrooms, for a total of nine bedrooms. There is also a metal storage building located along the eastern prop- erty line. The easternmost parcel, located directly across from the Hamrick Home, is vacant and is generally used for parking during various events. The City has determined that the requested staff housing qualifies as a group home as characterized in the following definition in the Land Development Regulations: 'A building designed or used as permanent or temporary living quarters for six or more unrelated person in which individual cooking facilities are not provided. Included in such designation, but not limited to, are such facilities as residential facilities and comprehensive transitional education programs under F.S. ch. 393; domestic violence centers under F.S. ch. 415; community residential homes in excess of six persons under F.S. ch. 419; and such similar facilities as authorized by law, and for which licensing is first required by law, and for which licensing is first required by the state department of children and families and/or the agency for health care administration, or other state or federal agency." Discussion with the Applicant indicates that while there will be nine rooms that could be considered bedrooms, only eight are expected to be used in this manner. One room is expected to be used more as a meeting room. Occupancy is expected to be limited to one person per room. The Applicant envisions that there will usually be only four to six persons in residence. Staff Report Special Exception Request Applicant's Name: Hospice of Okeechobee, Inc. Petition No. 08- 009-SE Consistency with Land Development Regulations: Section 70 -373 (b) requires that the Applicant address, during his/her presentation to the Board of Adjustment, the following standards for granting a Special Exception. The Applicant has submitted. brief statements addressing these standards as part of the Application. These are repeated herein for ease of review by the Board (1) Demonstrate that the proposed location and site are appropriate for the use. The proposed location and site are adjacent to the current hospice group home facility for patients. The zoning is multi - family and there fore within the Comprehensive Plan requirements." (2) Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood, or explain why no specific design efforts are needed. (3) "To the East is existing Hospice group home facility that houses hospice patients. To the North is an existing multi - family building. Martha's House is one block to the North (which allows short term group living)." Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual screening is necessary. "Landscaping existing on the property to remain. If staff or city requires more we would be willing to entertain the request." (4) Demonstrate what is proposed to reduce the impacts of any potential hazards, problems or public nuisance generated by the use or explain how the nature of the use creates no such potential problems. (5) "None foreseen." Demonstrate how the utilities and other service requirements of the use can be met. "Existing utility connections are adequate for proposed use. No modifications proposed at this time." (6) Demonstrate how the impact of traffic generation will be handled off site and on -site. "No adverse traffic anticipated. Special Exception Request Petition No. 08-009 -SE When reaching a conclusion on a Special Exception request, the Board of Adjustment shall consider and show in its record the following findings as set forth in Section 70- 373(c): A. The use is not contrary to the Comprehensive Plan requirements. Although the current zoning is RMF, the property is designated Single - family on the Future Land Use Map (FLUM), with a maximum allowable density of four units per acre. The two structures currently on the property represent a density of just two units per acre. Each structure is proposed to be used as a residential use without separate cooking facilities for individual group home occupants. There are four bedrooms in one structure and five in the other and each is designed to operate as the functional equivalent of a family. Because the subject property is designated Single - family on the FLUM, Staff believes that a group home in the Single- family land use category should be limited to a maximum of six occupants, thus ensuring that the character of the home is similar to that of a single - family use. This is a limitation commonly imposed on group homes in single - family areas by other communities in Florida and ensures compatibility with the intent of the Single- family future land use category in the Comprehensive Plan. B. The use is specifically authorized as a special exception use in the zoning district. Section 90- 193(3) allows group homes as a special exception in the RMF zoning district. C. The use will not have an adverse effect on the public interest. Staff can foresee no adverse impacts upon the public interest resulting from staff housing for professional employees of the nearby hospice operation. D. The use is appropriate for the proposed location, is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. A group home is generally considered by the State to be an appropriate use in areas zoned either single - family or multi- family. The proposed use is compatible with the surrounding single - family homes and is particularly complimentary to the nearby hospice facility as it ensures convenient access to the facility by its professional staff. The use will not adversely affect properly values or living conditions, nor be a deterrent to the development of adjacent property. The proposed group home should not adversely affect property values or living conditions in the area as it is considered an appropriate location for such a use and is compatible with surrounding uses. F. The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. The scale and intensity of the use is not expected to require special screening and should present no nuisance or hazards to adjacent uses. G. The use will not create a density pattem that will overburden public facilities such as schools, streets, and utility services. No, the impacts to public facilities will be minimal and no greater than those associated with uses that could otherwise be developed on the property. H. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. Traffic congestion is not expected as a result of the location of a group home with a maximum occupancy of nine residents, particularly in Tight of the fact its close location to the hospice facility is intended to provide affordable housing within walking distance of the place of employment. Any changes in drainage and stormwater management resulting from structural expansion or increased parking will be specifically addressed during the site plan review by the TRC.
