Dear Reviewer:
Southeast Milk, Inc. is located in Okeechobee County has been in business since 1956
when it was originally called Independent Dairy Farmer's Association until 1987 when
the name was changed to Florida Dairy Farmer's Association which was then changed to
Southeast Milk, Inc. in 1998. They are planning to remodel the existing building onsite
by adding retail space to the north and add a storage building on the south side of the
parcel to improve the looks of the lot from State Road 70 from the north and to the south
by installing the storage building. The remodeling of the existing one story metal
building will consist of the addition of a retail expansion to the north.
Independent Dairy Farmer's Association purchased the land from Ridge Tanklines, Inc.
who used it as a milk tanker storage while waiting for transit. Southeast Milk, Inc. also
used this parcel to store milk tankers and in 1998 built the current milk tanker transit
facility east of town on SR 710 and 15B. They now use this parcel as a retail outlet and
storage for their products. They also wish to enhance the look of the parcel with these
additions.
Southeast Milk, Inc. thinks these additions will not only add needed retail and office
space and protect their merchandise from the elements but will significantly enhance the
look of the property. Due to the existing building onsite, variances will be required for
them to accomplish this project and are requesting a favorable response to their request.

Describe improvements on property, including number/type of dwellings and whether
occupied (if none, so state):
There is currently a mobile office on the property and a metal building used as storage.
Almost the entire site is paved since this site used to serve as a fuel tanker storage yard
and later a milk tanker storage yard. The Southeast Milk, Inc. is planning to add a retail
center to the front of the existing storage building and a metal storage building south of
the existing storage building. Please see the attached exhibit for a proposed layout of the
site after the improvements have been made. The existing buildings are currently being
used and occupied as a retail outlet for their customers.
Describe Variance sought:
The proposed improvements require a 20' encroachment on the east property line to
extend the existing building to add the retail frontage and office space which will give
Southeast Milk, lnc, the ability to remove the existing mobile building. The second
variance sought is to install the additional storage building on the south property line.
Describe physical characteristics of property that makes variance necessary:
This variance is required due to the location of the existing building. The existing
building was build on the east property line, so to extend this building and honor the 20'
setbackfrom the property line would make the expansion so small that it would not
feasible. The second variance for the storage area on the south property line precipitates
from the same issue that the existing building has an access on the south side of that
building that if the building was setback 20 'from the property line, it again would be so
small that it would not be feasible to build a building that small. The additional storage
building cannot be moved further to the west due to the traffic flow in the existing yard.
Did you cause or contribute to the characteristic? If so, describe:
After Southeast Milk, Inc. moved their trucking facility to 15-B, they turned the existing
2 bay truck depot into a storage area for their products by construction the existing
building onsite. It is unclear who or when the 2 bay truck depot was built.

This letter is to officially advise you that the Board of Adjustments (BOA) approvedyour Variance
Petition No. 07-001-V, at their June 21,2007 meeting. This variance changes the side setbacks
from eight to three feet and the rear setbacks from 10 to three feet within a Heavy Commercial
Zoning District (ref. Section 90-285(2)). For Lots 1 through 20 of Block 1, Southwest Addition
Subdivision. Enclosed herewith please find a copy of the Planning Board/Board of Adjustment and
Appeals minutes. This copy is for your records, should you require additional information please
do not hesitate to contact me.
Also during the process, additional fees in the amount of $834.42 were incurred which exceeded
the initial $250.00 Variance Petition fee. As stipulated by City Resolution No, 98-11, the City will
not incur fees to process applications initiated by any applicant or property owner. Enclosed

Introduction:
The applicant is requesting variances from Section 90-285 of the City of Okeechobee Land
Development Code for property within the CHV Zoning District. The applicant is proposing to
remodel and improve the existing building and construct another new metal building on the
southern portion of the subject property.
The application does not clearly identify the extent of the variances requested, However, it
appears the Applicant wants to extend the existing building northward continuing the
nonconforming or setback of zero (0) feet along loth A venue and providing only a 19,27 foot
setback from State Road 70, In addition, the Applicant is requesting to place a new metal
building along the property line on SW Park Street, thereby providing no setback from that
street.

A map showing the location and zoning of the subject property and surrounding properties
follows. We have also included an aerial photograph of the site and nearby properties, and an
illustration showing the locations of the existing and proposed structures on that part of the
property associated with the requested variances.
Background:
The subject property is approximately 1.5 acres fronting on North Park Street. The building has
public utilities and the adjoining property uses are as follows:

LOC Requirements:
Setbacks: While the subject property fronts on public roadways on all four sides, only the
frontage along SR 70, SW Tenth Avenue, and SW Park Street are germane to the Applicant's
request.
Sec, 90-447 on page CD90:31 of the LDC states a yard adjoining a street shall be considered a
front yard and the second front yard setback shall be 75% of the minimum required setback. The
minimum front yard setback for a building in the CHV district is 20 feet [Sec. 90-285 (2)].
Therefore, the Applicant is requesting the following variances:
1. A variance for the extension of the existing building northward, which will result in a
setback of only 19,27 feet from State Road 70 rather than the required 20'.
2. Variances for the northward extension of the existing building to continuation of the 0'
setback from SW Tenth Avenue for a portion of the extension and to allow only an 8.2'
setback for the northernmost portion of the extension, This would be considered the second
front yard and the required setback is 15',
3, A variance from the required 20' setback to allow a new ISO-foot wide metal building to
be place directly on the southern property line along SW Park Street (a 0' setback), across
from residentially zoned property on the south side of SW Park Street.
Separation between buildings: It should be noted that the Applicant has modified his original
submittal to shorten the new proposed metal building along SW Park Street from 175 feet to 150
feet, thereby providing a separation of 23 feet. Staff, at the time of this report, is waiting for the
revised drawing, The required separation would be 16 feet, twice that the minimum required
side yard, which is 8 feet in the CHV district.

Discussion: -
After reviewing this application, Staff has determined that the request does not satisfy the criteria
outlined below for granting the variance:
A. Special conditions and circumstances exist which are peculiar to the land or
structure involved, and are not applicable to other land or structures in the same
zoning district.
The original building was a 2-bay truck depot which was constructed prior to the
applicant's ownership. This building was built right on the property line. The
applicant or prior owner has since added onto this building which appears to have
further aggravated the problem, It is difficult to see how this request can be seen
as a result of special circumstances peculiar to the land or structure. Adding to a
structure and continuing the non-setback is a convenience, not the result of a
special circumstance. Furthermore, the construction of the new metal building on
the Southern portion of the property hasn't been substantiated by special
circumstances peculiar to the land or structures.
B. The special conditions and circumstances do not result from actions of the
applicant.
According to the documents submitted, after Southeast Milk moved the trucking
facility to the site, the existing structure on the site was a 2-bay truck depot. The
applicant turned the truck depot into a storage area by constructing the building
which is now occupying the property. The new requests definitely are actions by
the applicant that are adding further to the variance situation. Unfortunately,
these circumstances are applicant created, not extreme hardship as the result of
the land configuration or similar reason,
C. Literal interpretation and enforcement of the Land Development Code would
deprive the applicant of rights commonly enjoyed by other properties in the same
zoning districts under the terms of the Land Development Code, and would work
unnecessary and undue hardship on the applicant.
The enforcement of the Code in this case would not deprive the applicant of the
rights commonly enjoyed by others in this Zoning District. To begin with,
certain setbacks were ignored in this situation and the design of the building and
parking took advantage of that. Further encroachments ignore the rules and
compound the original situation.

D. The variance, if granted, is the minimum variance necessary to make possible the
reasonable use of the land or structure.
No, this situation is compounded by needing a variance for past encroachments
plus new requests.
E. Granting the variance request will not confer on the applicant any special
privilege(s) that is (are) denied by the Land Development Code to other land or
structures in the same zoning district.
Yes, it would, Granting the variances seems to make setback regulations
meaningless,
F, Granting the variance will be compatible with the intent and purpose of the Land
Development Code, and the variance will not be injurious to the neighborhood or
detrimental to the public we([are.
No, it would enable future applicants to feel that the setback regulations are not
important.
Recommendation:
Staff recommends denial of the request to allow a variance from the setback regulations and for
the applicant to further encroach into them. In essence, the requests if approved would allow
expansion of a nonconforming use (structure)(*Sec, 90-39(a) page CD90:7), which in itself is a
violation of the land development regulations,
*Section 90-39(a): Extension of nonconforming structure. A nonconforming structure may be
enlarged, improved, or be brought up to current codes without concern as to whether the existing
nonconformity deals with lack of off-street parking, or on-site water retention, excessive floor
area, height or landscaping, as may be otherwise required of a new structure in these regulations,
so long as such development does not create a nonconforming use in that district; does not create
a new nonconformity as to property line set-backs; and would not cause or create a significant
impact as to drainage, or parking and loading requirements.

Does this verbiage work for the ad?
The proposed improvements require two variances from the setback requirements in Section 90-285 of
the City of Okeechobee 's LDR. The first variance requested is to reduce the required 8' side setback to
a 0 fiJot setback along the east property line beginning approximately 28. 3 feet from the northwest
property corner to the south for 16.5 feet. This portion of the variance will allow the front expansion to
line up with the existing building. The second variance is to reduce the required 10foot rear setback
(20 foot adjacent to residential, however, since there is a road between the two parcels the 10 foot
setback is prevailing) to a 0 foot setback beginning approximately 75. Ofeet from the southeast property
corner westfor 175feet.
