PETITION FOR WRIT OF MANDAMUS

Plaintiffs, EUGENE POLLARD and BETTY POLLARD" sues De-
fendants, CITY OF OKEECHOBEE, FLORIDA; RICHARD SPRAY', Build-
ing Inspector, of the City of Okeechobee, Florida, and alleges:
1. The Plaintiffs are sui juris and are residents of
the city of Okeechobee, Florida.
2. Plaintiffs own certain real property within the city
limits of the City of Okeechobee, Florida, to-wit:
Lots 22 to 24 and the East one-half of
1..0 t 21, Block E, of the City of Okeechobee.
Previously located on th.3.t property was a mobile home
which served as the residential dwelling of the plaintiffs.
3. Plaintiffs wished to construct on the aforedescribed
real property a home and plaintiffs applied to the City of
Okeechobee and to Richard Spray, Building Inspector of the City
of Okeechobee for a building permit for said construction.
Said application was made in November, 1979. Plaintiffs were
advised that they would have t~o submi t in addition, a detail of
the building plans of the proposed construction. Plaintiffs
had said building plans prepared by Broome, Van Ostran and
Associates, Inc, of Okeèchobee, Florida at a cost of $350.00
to Plaintiffs.

4- Plaintiffs duly submitted a copy of said building
plans to the City of Okeechobee in connection with their pre-
vious application for a building permit and on November 11,
1979, the City of Okeechobee did issue a permit for construe-.
tion, permit number 1169 to plaintiffs for construction as .J;'
specified in the preyiously submitted copy of the building
#'
plans.
5. In December, 1979, the aforementioned mobile home
,
was sold by the plaintiffs and it was removed from the élfore-
described real property. About the time the mobile home was
sold and moved or shortly thereafter, plaintiffs began con-
struction in accordance with the aforementioned-building plans
by having the IIfooters" dug and started for the foundation.
6. After the aforedescribed construction was begun, the
,
plaintiffs were advised by and on behalf of the City of Okee-
chnbee that the permit had been issued in error an~ that the
.
permit was canceled and they must cease construction.
7. In accordance with said instruction, plaintiffs ceased
construction but has ~cured. financial expenses in obtaining
said permit and has and continues to suffer great and severe
hardships since in good faith reliance on the issue of the build-
ing permit they did sell and dispose of their mobile home.
WHEREFORE, plaintiffs request the court to take jurisdiction
herein and to issue a Writ of Mandamus directing the City of
Okeechobee and Richard Spray, Building Inspector of the City
of Okeechobee to reinstate the aforementioned building permit
.
and to allow plaintiffs to proceed with construction on the
construction plans in accordance with said plaos and permit.
If the court feels this petition makes a prima facie case,
plaintiffs request the court to issue an alternative Writ of
Mandamus or an order to show cause why an alternative Writ
should not be granted.

~ Also, Conlon stated Lipman is insisting that a rule called "Rule 33" requires that

each member of the Council sign all the interrogatories that have been prepared. If after
researching, this is found to be true, Conlon will try to work out some kind of compromise
where Council can sign an affidavit.
3) JOHNSON -vs- CITY
The City is being sued due to an automobile accident. The complaint has been turned
over to Aetna Insurance who in turn is providing the defense for the City. Accident having
occurred outside the City limits.
4) POLLARD -vs- CITY
Conlon recejved a court or'der entered by the judge on July 21, 1980. Case was dis-
1 t fulfill their administrative remedies. Attorney for
Pollard has chosen to appeal the decision of the Zoning Administrator to the Boar9_of
Adjustments and Appeals.
5) HARTFORD INSURANCE -vs- CITY
Hartford Insurance Company is suing the City and County for a half a million dollars.
Aetna Insurance has informed the City that this suit is in excess of the City's
coverage. Aetna recommends the City notify its excess carrier at once and acknowledge the
letter. Conlon sent copies of the letter to Berger Insurance.

The case involves the yellow flashing light at the Highway 70 East overpass.
6) TRIM BILL
The July 15, Budget deadline only applies to the counties and school boards. The
Florida League of Cities is sending out an update to all City Clerk's with a step-by-step
procedure for Budget.
Conlon noted the Council needs to pass a tentative budget as soon as possible and if
it does not increase taxes more than eight percent (8%) over last year's millage the City
will not have to pursue the Trim Bill advertising.
I 7) PROPOSED LAND LEASE
I Conlon reviewed the proposed land lease on the one hundred fifty-one (ISl) acres.
Attorney sees a need for a few more additional clauses, prior to becom'ing final.

NOTICE OF INTENTION TO AMEND CITY ZONING ORDINANCE #402
NOTICE IS HEREBY GIVEN that the Board of Adjustments and Appeals of
the City of Okeechobee, Florida, a municipal corporation, will consider
an appeal from a denial of a building permit and to amend accordingly
the Comprehensive Zoning Ordinance #402, clarified and adopted August 8,
1978, the following described real property, situate, lying and being
within the corporate limits of the City of Okeechobee, Florida, to-wit:
Lots 22 to 24 and the East one-half of Lot 21,
Block E, of the City of Okeechobee.

granting of the appeal would result in granting a variance so that a
residential dwelling can be built on above described property currently
zoned for mobile home residence only. A public hearing in relation
thereto will be held at 7:00 P.M. on the 2nd day of September, 1980, in
the City Council Room, City Hall, Okeechobee, Florida, at which time all
parties in interest and citizens shall have an opportunity to be heard.

APPEAL TO THE BOARD OF ADJUSTMENT
OF THE CITY OF OKEECHOBEE
RE: ZONING VARIANCE OR SPECIAL EXCEPTION
EUGENE POLLARD and BETTY POLLARD, his wife, by their
undersigned attorney, files this their Notice of Appeal to the
Board of Adjustment of the City of Okeechobee, Florida, for a
zoning variance or special exception to an existing zoning
ordinance, and would show:
1. Petitioners own certain real property within the city
limits of the City of Okeechobee, Florida, to-wit:
Lots 22 to 24 and the East one-half of Lot
21, Block E, of the City of Okeechobee.
2. Petitioners applied to the City of Okeechobee for a
building permit to construct upon said property a residential
dwelling. Petitioners were advised that it was necessary for
them to submit a surveyors detailed plan of the specifications
of the proposed construction. This petitioners complied with
and subsequently a building permit for construction was issued.
3. The aforedescribed real property is currently zoned
for mobile home residence only, but none the less, the con-
struction permit was issued and construction on the proposed
building was begun within the required time for construction
under the appropriate ordinance.
4. That after construction was begun, the petitioners
were advised that the permit had been issued in error and that
the permit was forthwith canceled and they must cease construc-
tion. To the best knowledge of the undersigned, the aforemen-
tioned notice was given verbally by a member of the zoning
department of the City of Okeechobee.

WHEREFORE, it is respectfully requested that the Board
of Adjustment, pursuant to the appropriate ordinance, fix a
reasonable time for the hearing of this appeal, after giving
all appropriate notice, and to grant a variance or special
exception to the petitioners for the construction of the pro-
posed residential dwelling.

PETITION FOR WRIT OF MANDAMUS

Plaintiffs, EUGENE POLLARD and BETTY POLLARD" sues De-
fendants, CITY OF OKEECHOBEE, FLORIDA; RICHARD SPRAY', Build-
ing Inspector, of the City of Okeechobee, Florida, and alleges:
1. The Plaintiffs are sui juris and are residents of
the city of Okeechobee, Florida.
2. Plaintiffs own certain real property within the city
limits of the City of Okeechobee, Florida, to-wit:
Lots 22 to 24 and the East one-half of
1..0 t 21, Block E, of the City of Okeechobee.
Previously located on th.3.t property was a mobile home
which served as the residential dwelling of the plaintiffs.
3. Plaintiffs wished to construct on the aforedescribed
real property a home and plaintiffs applied to the City of
Okeechobee and to Richard Spray, Building Inspector of the City
of Okeechobee for a building permit for said construction.
Said application was made in November, 1979. Plaintiffs were
advised that they would have t~o submi t in addition, a detail of
the building plans of the proposed construction. Plaintiffs
had said building plans prepared by Broome, Van Ostran and
Associates, Inc, of Okeèchobee, Florida at a cost of $350.00
to Plaintiffs.

4- Plaintiffs duly submitted a copy of said building
plans to the City of Okeechobee in connection with their pre-
vious application for a building permit and on November 11,
1979, the City of Okeechobee did issue a permit for construe-.
tion, permit number 1169 to plaintiffs for construction as .J;'
specified in the preyiously submitted copy of the building
#'
plans.
5. In December, 1979, the aforementioned mobile home
,
was sold by the plaintiffs and it was removed from the élfore-
described real property. About the time the mobile home was
sold and moved or shortly thereafter, plaintiffs began con-
struction in accordance with the aforementioned-building plans
by having the IIfooters" dug and started for the foundation.
6. After the aforedescribed construction was begun, the
,
plaintiffs were advised by and on behalf of the City of Okee-
chnbee that the permit had been issued in error an~ that the
.
permit was canceled and they must cease construction.
7. In accordance with said instruction, plaintiffs ceased
construction but has ~cured. financial expenses in obtaining
said permit and has and continues to suffer great and severe
hardships since in good faith reliance on the issue of the build-
ing permit they did sell and dispose of their mobile home.
WHEREFORE, plaintiffs request the court to take jurisdiction
herein and to issue a Writ of Mandamus directing the City of
Okeechobee and Richard Spray, Building Inspector of the City
of Okeechobee to reinstate the aforementioned building permit
.
and to allow plaintiffs to proceed with construction on the
construction plans in accordance with said plaos and permit.
If the court feels this petition makes a prima facie case,
plaintiffs request the court to issue an alternative Writ of
Mandamus or an order to show cause why an alternative Writ
should not be granted.

3) JOHNSON -vs- CITY
The City is being sued due to an automobile accident. The complaint has been turned
over to Aetna Insurance who in turn is providing the defense for the City. Accident having
occurred outside the City limits.
4) POLLARD -vs- CITY
Conlon recejved a court or'der entered by the judge on July 21, 1980. Case was dis-
1 t fulfill their administrative remedies. Attorney for
Pollard has chosen to appeal the decision of the Zoning Administrator to the Boar9_of
Adjustments and Appeals.
5) HARTFORD INSURANCE -vs- CITY
Hartford Insurance Company is suing the City and County for a half a million dollars.
Aetna Insurance has informed the City that this suit is in excess of the City's
coverage. Aetna recommends the City notify its excess carrier at once and acknowledge the
letter. Conlon sent copies of the letter to Berger Insurance.

The case involves the yellow flashing light at the Highway 70 East overpass.
6) TRIM BILL
The July 15, Budget deadline only applies to the counties and school boards. The
Florida League of Cities is sending out an update to all City Clerk's with a step-by-step
procedure for Budget.
Conlon noted the Council needs to pass a tentative budget as soon as possible and if
it does not increase taxes more than eight percent (8%) over last year's millage the City
will not have to pursue the Trim Bill advertising.
I 7) PROPOSED LAND LEASE
I Conlon reviewed the proposed land lease on the one hundred fifty-one (ISl) acres.
Attorney sees a need for a few more additional clauses, prior to becom'ing final.

NOTICE OF INTENTION TO AMEND CITY ZONING ORDINANCE #402
NOTICE IS HEREBY GIVEN that the Board of Adjustments and Appeals of
the City of Okeechobee, Florida, a municipal corporation, will consider
an appeal from a denial of a building permit and to amend accordingly
the Comprehensive Zoning Ordinance #402, clarified and adopted August 8,
1978, the following described real property, situate, lying and being
within the corporate limits of the City of Okeechobee, Florida, to-wit:
Lots 22 to 24 and the East one-half of Lot 21,
Block E, of the City of Okeechobee.

granting of the appeal would result in granting a variance so that a
residential dwelling can be built on above described property currently
zoned for mobile home residence only. A public hearing in relation
thereto will be held at 7:00 P.M. on the 2nd day of September, 1980, in
the City Council Room, City Hall, Okeechobee, Florida, at which time all
parties in interest and citizens shall have an opportunity to be heard.

APPEAL TO THE BOARD OF ADJUSTMENT
OF THE CITY OF OKEECHOBEE
RE: ZONING VARIANCE OR SPECIAL EXCEPTION
EUGENE POLLARD and BETTY POLLARD, his wife, by their
undersigned attorney, files this their Notice of Appeal to the
Board of Adjustment of the City of Okeechobee, Florida, for a
zoning variance or special exception to an existing zoning
ordinance, and would show:
1. Petitioners own certain real property within the city
limits of the City of Okeechobee, Florida, to-wit:
Lots 22 to 24 and the East one-half of Lot
21, Block E, of the City of Okeechobee.
2. Petitioners applied to the City of Okeechobee for a
building permit to construct upon said property a residential
dwelling. Petitioners were advised that it was necessary for
them to submit a surveyors detailed plan of the specifications
of the proposed construction. This petitioners complied with
and subsequently a building permit for construction was issued.
3. The aforedescribed real property is currently zoned
for mobile home residence only, but none the less, the con-
struction permit was issued and construction on the proposed
building was begun within the required time for construction
under the appropriate ordinance.
4. That after construction was begun, the petitioners
were advised that the permit had been issued in error and that
the permit was forthwith canceled and they must cease construc-
tion. To the best knowledge of the undersigned, the aforemen-
tioned notice was given verbally by a member of the zoning
department of the City of Okeechobee.

WHEREFORE, it is respectfully requested that the Board
of Adjustment, pursuant to the appropriate ordinance, fix a
reasonable time for the hearing of this appeal, after giving
all appropriate notice, and to grant a variance or special
exception to the petitioners for the construction of the pro-
posed residential dwelling.
