Disposition of Cases presented by Code Officer Sterling: No. 07-054 Code Officer Sterling reminded the Board Case 07-054 had been postponed at the last meeting to allow the property owner Ventura Arroyo. 911 NW 51h Street time to come into compliance. City Engineer, Oscar Bermudez, testified he had told the owner the structure was not sound Ch 70: Sec 70-302 Permit and could be a safety hazard. He stated he had informed property owner it needed to be taken down. However, there was some confusion when the owner attempted to get a permit at the building department. Mr. Francisco Santibanez and his daughter addressed the Board on behalf of Ventura Arroyo stating they had come in to get a building permit and were told by the building department staff they did not need a permit for a chicken pen. Therefore, they did not remove the structure. Member Montesi moved to dismiss Case 07-054 until proper instructions from the building department are given to the property owner; no second was made. Motion failed. Chairperson Worley specifically asked Code Officer Sterling if the property was in non compliance and Code Officer Sterling testified it was in non compliance at this time. Vice Chairperson Gamiotea moved based on testimony to find Case 07-054 in non compliance with no fine being assessed. Motion was withdrawn. Vice Chairperson Gamiotea moved based on testimony to find Case 07-054 in violation of Ch 70 Sec 70-302 and assess a fine of twenty dollars per day beginning thirty days from receipt of notification; seconded by Member Irby. (Member Sweda requested Code Board staff send letter to property owner explaining what needs to be done in order to avoid further confusion.) However, he had not come in to apply for the building permit. Member Sweda moved to find Case 07-090 in violation of Ch 70 Sec 70-302 imposing a ten dollar per day fine beginning the day after receipt of notification; seconded by Member Montesi. James Sweat addressed the Board testifying he had never dumped concrete on the parcel of land between his property and the railroad. He said he had received permission verbally from Donnie Robertson in the public works department to break up the concrete and push into a pile on what he believed to be the city right of way. He admitted there was a small amount of concrete on his property which he removed and piled with the concrete on the property in question. Mr. Sweat's wife, Alice, testified they had never dumped concrete on the property, it was already there. Next, Attorney Cassels came forward on behalf of his clients Leonard McCann (former owner of the property in question) and Jim Davis (current owner of the property in question). He stated both of his clients were present to give testimony as well as Keith Tomey (former Fire Chief/Code Officer). First, Leonard McCann spoke stating he had owned the property for twenty seven years. He said there had been some concrete on the property, but the pile of concrete had grown larger without his consent or knowledge as to how it got there. Then, Jim Davis spoke testifying he had bought the property in November of 2006. He said Mr. Sweat had talked to him and told him the concrete was there and he had broken it up and put it into a pile. Mr. Davis stated the pile was approximately 10 ft. high, 20-30 ft. wide and 130 ft. long. He said he had gotten two estimates of $11,000 and $13,000 to have it removed. After his clients testimonies, Attorney Cassels summarized stating Mr. Sweat never had consent from the property owners. At this point, Keith Tomey who was the the City Code Officer at the time the original violation was cited, spoke on behalf of the property owner. He testified Mr. Sweat had told him he planed to haul the concrete away and asked for permission to temporarily leave it on the McCann/Davis property until he had accumulated enough concrete to sell it for a profit. Mr. Sweat denied he had made any agreement to that effect. Attorney Cassels asked the Board to evaluate the conflicting testimonies and consider what is worthy of belief. In conclusion, Chairperson Worley specifically asked Mr. Sweat while he was under oath, if he had at any time brought in more concrete in addition to what was already there. Mr. Sweat testified saying he had not. Member Irby moved to find in violation imposing a fine of fifty dollars per day beginning thirty days from today; no second was made. Motion failed. Member Montesi moved to find Case 07-107 in violation of Ch 30 Sec 30-37 imposing a fee of twenty-five dollars; seconded by Member Revels. Member Montesi amended motion to include adminstrative fees; seconded by Member Revels. At 8:30 pm Chairperson Worley called for a five minute recess. Code Board meeting was called back to order at 8:35 pm by Chairperson Worley. Marvin Brantley. 1811 S Parrott Avenue Attorney Cook advised the Board since this case had gone to court and the lien was the result of a final judgement in a civil Request for fine reduction ($68,662.23) lawsuit the Code Board's only responsibility is to make a recommendation to the City Council. Steve Brantley addressed the Board on behalf of his father, Marvin Brantley. He told the Board the sell of this property would be a huge asset to the City. He requested the fine be dropped in order for the money to be used to finish cleaning the property. Chairperson Worley reminded the Board the only enforcement power they have is to impose a fine and if the Board sets a precedent of continually reducing fines it erodes the enforcement power. Attorney Cook added when the lien was paid a satisfaction and dismissal of the lawsuit had to be filed. After further discussion, Member Irby moved in the matter of Marvin Brantley to recommend to City Council that no action be taken at this time to reduce the amount of the civil judgement until all parcels of the property have closed; seconded by Member Revels.
