Code Officer Sterling stated Case #05-197 and #05-232 were both owned by Robert Saffold. He said Mr. Saffold had come in to talk to him today and he was in the process of getting a dumpster and having the property cleaned. Member Montesi moved to find Case #05-197 and #05-232 in violation and given until May 11, 2006 to bring the property into compliance, if property is not in compliance on May 12, 2006 a fine of $250.00 per day would be imposed; seconded by Member Castorina. Mr. O'Connor addressed the board stating his plans were to move all of his equipment to some property he owned north of town. However he had been unable to get an estimate to have the property fenced until February 2, 2006 and at that time he was told by Adron Fence Company the fence could not be started until May 22, 2006. He gave testimony that as soon as the fence was completed he would move his equipment. He requested an extension until May 28, 2006. Code Officer Sterling informed the Code Board that he had received a complaint of trucks coming and going early in the morning and late at night, but he had not received any complaints since February 22, 2006. He also reported that he had not seen any trucks parked there for a while, but the heavy equipment was still there. After a lengthy discussion among the board, Member Hancock moved to find Case #05-262 in violation of Ch. 54 Sec. 54-51 and impose a fine of $75.00 per day if not in compliance by June 7, 2006; seconded by Member Irby. Worley - Yes Castorina - Yes Irby - Yes Montesi - Yes Sweda - Yes Hancock - Yes Motion Carried 477 AGENDA 11. 2006 - CEB Regular Meeting - Page 3 of 4 CODE BOARD ACTION 406-020 Rebecca Marsh 705 SE 116` Avenue #05-136 Joe Louis Lawson, Sr 913 NW I& Street Ch 30 Sec 30-41 Disabled vehicles Fine has accrued over ninety days Code Officer Sterling gave testimony there was an old bus which was inoperable parked in the back yard. He told the board the notice of violation had been returned so he had posted notice on the property but no contact had been made with the property owner. Mr. Sterling said he had seen a for sale sign when he looked at the property today. He suggested he could contact the realtor and ask them to contact the property owner. Member Irby moved to find Case #06-020 in violation of Sec. 3041 and impose a fine of $50.00 per day to begin 14 days from Aprill 1, 2006 (April 25, 2006); seconded by Member Sweda. Code Officer Sterling gave testimony that Case #05-136 had been under a fine of $25.00 per day for over ninety days, however he had received a fax from Mr. Lawson requesting a thirty day extension to get the property cleaned. After some discussion in reference to extenuating circumstances due to illness and a death in the family, the board decided not to take any action at this time . Johnathan Brown, son of Johnny Mae Brown addressed the board in reference to Case #04-025 Joe & Johnny Brown and Case #04-026 Gloria & Mary Brown. He stated due to his mother's illness she was no longer able to take care of the property and he and his sister would now be responsible for keeping the property clean. He told the board a company had been contracted to do the initial cleaning sometime next week. Chief Smith addressed the Board stating he felt the board members did not realize the reason the Code Enforcement department appears to be complaint driven at times is due to the fact that our Code Officer only works sixteen hours per week. So he suggested the Code Board might recommend to City Council that more hours be given to the Code Enforcement Officer's position. AGENDA ADJOURNMENT - CHAIRPERSON WORLEY.
