March 14, 2006 - CEB Regular Meeting - Page 2 of 4 CODE BOARD ACTION Code Officer Hancock requested the withdrawal of Case #05-279 Anita Leverett from today's agenda. Code Officer Hancock stated notice of violation had been received September 27, 2005 and Code Officer Sterling had made contact but nothing had been done to bring the property into compliance. Member Montesi moved to find Case #05-247 Glowacki Family Enterprises in violation of Sec 30-43 Public nuisances and given ten days from receipt of notice to comply after that time a fine of two -hundred dollars per day would be imposed if property is not in compliance; seconded by Member Revels. Code Officer Hancock informed the board Case #05-217 is currently being fined ten dollars per day and the fine has accrued ninety days. Member Gamiotea moved Case #05-217 Geraldine Bertram had been under a fine for more than ninety days and to recommend City Council begin foreclosure proceedings; seconded by Member Irby. Betty Jo Curtis who lives at 905 SW 7' Avenue asked to address the Code Board. She stated the property located at 907 SW 7'h Avenue was continually being used as a dumping site for debris from other property owned by Geraldine Bertram. She said the garbage was being hauled in at all hours of the day and night and left there until Waste Management picked it up. After some discussion among the board, Member Irby moved to find Case #06- 041 Zollie Aldridge & Geraldine Bertram in violation of Ch 30 Sec 30-36 and impose a fine of two -hundred and fifty dollars to begin ten days from March 14, 2006 (March 24, 2006); seconded by Member Gamiotea. Worley - Yes Gamiotea - Yes Castorina - Yes Irby - Yes Montesi - Yes Revels - Yes Hancock - Yes Motion Carried, Code Officer Hancock gave testimony that the owner had been contacted and told Code Officer Sterling that it would be cleaned up but at this time it is not in compliance. Member Montesi moved to find Case #06-043 as a repeat violator of Sec 3040 and Sec 30-44 given five days from receipt of notice to comply after that time a fine of two -hundred and fifty dollars per day would be imposed; seconded by Member Gamiotea.
