Code Officer Hancock stated that Case# 03-045 was in compliance as of March 6, 2004 and the structure had been boarded up until it can be removed, Member Gamiotea moved to find Case #03-045 in compliance as of March 6, 2004 and stop the fine from accruing as of that date (total amount of fine is $1,120.00); seconded by Member Irby. Code Officer Hancock informed the Code Board that Case# 03-096 was not in compliance and had been listed with a realtor for sale. Code Officer Hancock added that due to his wife's illness, Mr. Parsons could not leave Georgia to take care of the property. Member Irby moved to find Case# 03-096 not in compliance and to instruct Attorney Cook to file a lien in the amount of $1,120.00; seconded by Member Gamiotea. Motion was amended to change the amount of lien to $1,150.00; seconded by Member Gamiotea. Code Officer Hancock gave testimony that he had spoken with the owner of the disabled vehicle a couple of times and he had agreed to remove it. Since nothing had been done a notice of hearing was hand delivered to him to appear before the Code Board, but there has been no response from the owner and the car is still there. There was some discussion as to whether the property owner should have been notified as well as the owner of the vehicle. Member Gamiotea moved to find Case# 03-113 in violation of Sec 30-41 and impose a fine of $25.00 per day upon receipt of notification; seconded by Member Montesi. PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Tapes are for the sole purpose of backup for official records of the department. There being no further items on the agenda, Chairperson Worley adjourned the March 9, 2004 meeting at 7:45 p.m. The next regular Code Board Meeting is scheduled for Tuesday, April 13, 2004.
