Chp 30 Sec 30-44 General Cleaning and Beautification Discussion regarding use of citations for certain types of violations There were no requests for addition, deferral or withdrawal of items on today's agenda. Chairman Worley advised the board the based on the City attorney's determination that the property owners were not cited correctly the existing fines were in error. Member Gamiotea moved that Case 01-0074 and 401-0075 have the fines of $215.00 on each property removed due to improper notification of the owner; seconded by Member Irby. Worley - Yes Irby - Yes Gamiotea - Yes Weisser - Yes Castorina - Yes Motion Carried. Case 903-119 was withdrawn from the agenda because the property owner had not received the notice of hearing. Code Officer Hancock gave the board a status report on Case 901-0084, he stated a lot of work had been done as of December 1, 2003 and it would be up to the board to decide if the property was in compliance. After some discussion Member Irby moved Case #01-0084 was in violation but has now come into substantial compliance as of December 1, 2003 and to leave the accrued fine in the amount of $470.00 as it stands; seconded by Member Castorina. Code Officer Tomey questioned whether the Board would consider allowing Code Officer Hancock to issue citations for certain types of violations that required a more expedient means of enforcement, such as businesses operating without an occupational license or repeat violators. Chairperson Worley felt it should be the responsibility of the Code Board to mediate each case and determine what should be issued a fine and what is not. E, I December 9, 2003 - CEB 3 of 394 II AGENDA III CODE BOARD ACTION ___jI Status Report from Attorney Cook ADJOURNMENT - CHAIRPERSON WORLEY. PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Tapes are for the sole purpose of backup for official records of the department. Mack Worley, Jr., Ch ' erson ATTEST: Sue Christopher, Secretary Attorney Cook informed the board that Marvin Brantley had paid his fine and has no pending issues before the City at this time. He also stated that an omission had been made in the new Code of Ordinances which pertained to non- conforming junk yards. The attorney is in the process of writing an ordinance to put these stipulations back into the Code of Ordinances and it should be approved by the City Council by the middle of January. There being no further items on the agenda, Chairperson Worley adjourned the December 9, 2003 meeting at 8'. 10 p.m. The next regular Code Board Meeting is scheduled for Tuesday, January 13, 2004.
