CODE BOARD ACTION March 11, 2003 Code Enforcement Board meeting was called to order at 7:07 p.m. by Chairperson Worley. Before the vote was taken Member Gamiotea stated he felt the minutes were inaccurate in reference to Case #02-0216 Evelyn Dasher Estate, Therefore Member Weisser and Member Irby withdrew the motion and second. Member Gamiotea moved to have the secretary review the tape and amend the minutes to accurately reflect what action was taken; seconded by Member Montesi. Motion carried unamiously. Motion carried unamiously 02-0402 BDEIR Investments Inc. Chp. 8 Sec. 8-8 Disabled Vehicle Don Smith gave testimony that the car was supposed to be picked up by Faith Farm, but the title had 1007 SW 4th Street been lost, therefore they had applied for a new title and as soon as it came in the car would be moved. Member Gamiotea moved to find Case #02-0402 in violation of Sec. 8-8 and allow three weeks from date of notification before imposing a fine of $10.00 per day; seconded by Member Weisser. Worley - Yes Sweda - Yes Gamiotea - Yes Weisser - Yes Irby -Yes Castorina - Yes Montesi - Yes Motion Carried 01-0127 Geraldine Bertram Chp. 8 Sec. 8-8 Disabled Vehicle Code Officer Tomey gave testimony that the fine in Case #01-0127 came to a total of $10,760 at the 1302 S. Parrott Avenue Request for reduction of fine. time of compliance. Member Montesi moved to find Case #01-0127 was in violation, but is now in compliance and to reduce the fine to $2,500; seconded by Member Castorina. After some discussion Member Irby moved to proceed with the foreclosure; Status Report/Code Board Discussion seconded by Member Montesi. Dasher Estate Chp. 8 Sec. 8-10 Public Nuisances Attorney Cook advised the Board they could recommend that the City Administrator take action to 818 SE 1 Oth Street have the property cleaned up if it was found to be a threat to the health and safety of the community. Code Officer Tomey gave testimony that Case #02-0216 was a threat to the welfare of the community. Member Montesi moved to find Case #02-0216 in violation of Sec. 8-10 Public Nuisances and 373 March 11, 2003 - CEB - Paae 3 of 3 AGENDA 02-0042 Kirit & Dipika Shah Clip. 8 Sec 8-10 Public Nuisances 515 S. Parrott Avenue CODE BOARD ACTION recommend to the City Administrator that the property be cleaned and the house boarded up with the cost billed to the estate and impose a fine of $30.00 per day upon receipt of notification due to it being a public nuisance and a safety hazard; seconded by Member Weisser. Before the vote was taken there was some discussion as to whether the fine should be more than $30.00 per day. Member Montesi amended her motion to increase the fine to $50.00 per day; seconded by Member Weisser. Worley - Yes Gamiotea - Yes Irby - Yes Montesi - Yes Motion Carried. Sweda - Yes Weisser - Yes Castorina - Yes Code Officer Tomey gave testimony that as of this afternoon Case # 02-0042 was in compliance. Member Montesi moved to find Case #02-0042 was in violation of Sec. 8-10, but has come into compliance; seconded by Member Sweda. Worley - Yes Sweda - Yes Gamiotea - Yes Irby - Yes Montesi - Yes Motion Carried. Weisser - Yes Castorina - Yes Chairperson Worley reviewed the list of cases that are currently under a fine and asked Chief Tomey to check on the status of Case #02-0063 Joe Louis Lawson, Sr. Chief Tomey agreed to check on this. 11 Member anno ea movea to actjourn, ADJOURNMENT - CHAIRPERSON WORLEY PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be /asfor thesole purpose of backup for official records of the department.
