MUNICIPAL CODE ENFORCEMENT BOARD
CITY OF OKEECHOBEE
MARCH 11, 1986
Hearings of the municipal code violations were held by the Municipal Code Enforcement Board
in the Council Chambers at City Hall on Tuesday, March 11, 198 .
Vice Chairman Thompson called the meeting to order at 7:0 O'Clock and asked the
secretary to call the roll with the following results:

APPROVAL OF MINUTES
Vice Chairman Thompson asked if everyone have received thE minutes of February 10, 1986
meeting. She stated if the board found the minutes correct anc had no questions, the chair
would entertain a motion the minutes stand approved as presented. Member Scherrer so moved.
Seconded by member Walker. Motion carried.
PRESENTATION OF CASES
Vice Chairman Thompson asked Code Enforcement Officer, To ey to present his cases.
DISMISSAL OF CASES
Code Enforcement Officer Tomey asked that the following cases be dismissed because they
are in compliance.
116-85 Annette White
120-85 Bobby Sweat
Member Scherrer moved to dismiss cases 116-85 and 120-85. Sec nded by member Ridley. Motion
carried.
CASES TO BE PRESENTED
12-86 Jeff Fadley - 1000 S.W. 5th Street - Dog running at large.
Mr Fadley stated his dog had gotten loose in December. He was out of the country in West
Africia and his wife could not put the dog back on the chain. He stated he didn't know about
it until he returned home about the 1st of January. He stated since January his dog had
been tied up. He stated there is a red doberman across the str et, and he comes into his

Code Officer tomey advised the board he had been to 1000 S.W. 5th street four (4)
or five (5) times and he have never seen a doberman in th neighborhood.
Member Walker moved to dismiss case 12-86 for lack o evidence. Seconded by member
Clements. Motion carried.
13-86 J.A. Castille - 608 S.E. loth Avenue -
Chuck Sunner of the Humane department issued the vio'

Deborah Lamb was in the audience to tesyify that the

killed the ducks. She stated she had a bunch of ducks and ne morning at 3:00 A.M. at 1100
S.E. 7th Street in February the husky dog killed the ducks. She stated they had told the
owner about the dog coming over into their yard and killing the ducks, but they didn't
confine the dog. She stated her yard was fenced in but t e dog got in anyway.
Attorney Bryant asked Mrs. Lamb if she saw the dog in her yard. Mrs. Lamb stated yes.
Attorney Bryant asked her if she saw the dog kill the ducks. She stated she did.
Mr Sunner stated he haven't had any contact with thelCastille's because there is a
chain length fence around the property with a lock on it and he couldn't get in. That is
why he left the code violation and didn't talk to anyone.
Attorney Bryant asked if someone identified the dog to him. Mr. Sunner stated Mr.
and Mrs. Lamb positively identified the dog to him. He stated the dog has been on a chain
since the violation. Attorney Bryant advised the board tat Mrs. Lamb needed to be sworn
in and asked her if the evidence she just gave was the troth. Mrs. Lamb stated yes.
Mr. Castille was sworn in and he stated he didn't know what was going on because
he left for work early in the morning around 4:30 A.M. ani when he got the summons to the
Code Enforcement Board he didn't know what it was for. H stated he knew the dog got out
but he wouldn't bite. He also stated he had seen a duck in the Lamb's yard one morning
but it was alive while his dog was there. He stated he c lled the dog and ran him home and
he stayed there. That's the only thing he knew about the dogs and the ducks.
Vice Chairman Thompson asked Mr. Castille if he thought t is was his dog or if he was denyin
this was his dog that killed the ducks. Member Walker as ed Mr. Sunner if he said Mr.
Castille's yard was fenced also. Mr. Sunner stated it wai a standard four foot fence.
Vice Chairman Thompson asked Mr. Castille how did he think the dog gets out. Mr.
Castille stated under the fence because he can't get over the fence.
Vice Chairman Thompson asked Mr. Castille if he had any objections to paying Mrs. Lamb
for her ducks. Mr. Castille stated no. Mr. Castille and Mrs. Lamb stated they would get

together and come to terms between themselves concerning the ducks. Mr. Castille also
stated the dog is chained in the fence so he couldn't getlout.
Member Walker moved to dismiss this case and let Mr.ICastille and Mrs. Lamb come
to terms on the ducks. Seconded by member Palmore. Motion carried.
ADJOURNMENT
There being no further business to come before the board, member Scherrer moved to
adjourn. Meeting adjourned.
