Member Palmore then made a motion that Cindy Shreves is in vi lation of Ordinance #410, leash law and has been more than one time and she be fined $25.00 for past violations and the board give her till day light in the morning to take care of the situation as it stands now or face future fines of $50.00 per day for every day she is in violation. Seconded by member Ridley. Motion carried. Vice Chairman Kuhlewind informed Ms. Shreves there is a $25,03 fine to be paid in the City Clerk's office. DISMISSAL OF CASES Mr. Westbrook asked the following cases be dismissed bec. 107-84 Ronnie Watts 118-84 Inez Simmons - Unlawful use of motor home 4-85 James S. Cox - No above grade handicap parking s_ 12-85 Ronnie Watts - Unlawful use of travel trailer 90-84 Ramona McClellan - Junked vehicle on property 106-84 James D. Gillman - Junked truck body on premises Member Thompson moved to dismiss cases listed above. Second use they are in compliance. signs by member Ridley. Discussion: Member Kuhlewind asked Mr. Westbrook how was case 107-84 - unlawful use of travel trailer - in compliance. Mr. Westbrook stated the man is living inside the residence located where the trailer is parked. Kuhlewind: Is the travel trailer still hooked up. Mr. Westbrook: No, only the lights, they are having to use il for shaving. They still have to finish the plumbing in the bathroom in the residence. Member Kuhlewind stated this was right behind his house and i has been a problem for him for quite a while. He stated he couldn't go along with MR. Westb ook, and thinks something needs to be done about it. Member Kuhlewind advised the board he would step off the boar' and let the board decide what they want to do about it. Mr. Westbrook stated he has tried to locate Mr. Watts for abo t eight (8) months to serve papers on him, but the police couldn't find him and the certified mail came back. Just last week we found out when he would be at the residence where the trailer is setting. We had the police to serve the papers on him at that time. Chairman Jeffers asked Mr. Westbrook and Mr. Kuhlewind if they would continue this case instead of dismissing it. Mr. Westbrook stated what ever the board decide was fine with him. Mr. Kuhlewind stated he would rather not say anything and rather exempt his feelings on this motion. Chairman Jeffers asked member Thompson if she wanted to amend her motion to continue this case. Member Thompson moved to amend her motion to read to con inue case 107-84 and dismiss the rest of the cases. Seconded by member Ridley. Discussion en:ued. Motion carried. Member Kuhlewind exempted himself from voting. CASES TO BE PRESENTED 18-85 Denise Malone - Dogs running at large with no license or rabies tags. Mr. Westbrook stated he has talked to the Malones and they have pleaded that they are in direct violation of Ordinance #410 in that the dogs were running at large. He stated he would recommend a minimum fine of-:$25.00 and they sign an agreement between the City and themselves that the dogs either be penned up, that they may not run at large or remove from City limits. Gary and Denise Malone were present for this case. Chairman Jeffers asked the Malones if they want to make any comments. Mrs. Malone stated no, but she do keep her dogs tied up and feed them bef re she went to work and when she got home they were gone. Mrs. Malone was sworn in by the secretary. Chairman Jeffers asked Mrs Malone if her dogs were runninT at large. Mrs. Malone stated yes, they were loose when she came home from work. She stated they were gone, so they had to be running at large. She stated she would see about getting a pen for the dogs so they don't .get loose. Gary Malone was sworn in by the secretary. He stated he had the post to make a dog pen and wire seven feet high, which will keep the dogs substained. Chairman Jeffers asked how many dogs they have. Mr. Malone stated two (2) very valueable dogs and don't want to loose them. One is a blue doberman. hr. Malone stated as far as the up keep of the dogs he has the equipment and the stuff to maintain their grounds. Member Thompson asked if these were the same dogs that broke into a house. Mrs. Malone stated it was one of the dogs. Member Walker asked where the dogs were now. Mr. Westbrook stated in the dog pound and will remain there until this case is solved. Chuck Sunner from the Humane department came before the board to explain about dogs in heat. He stated the dogs are suppose to be confined to a building not just property, but a building where the odor of the female can not be smelled by any male dog in the area. Member Walker asked "if you have a secured dog pen in your own yard you still have to take them out of the pen and put them in a building?" Mr. Su ner stated in the City Ordinance it states you have to keep the dog in a building to keep male dogs away. Chairman Jeffers asked Mr. Westbrook what he recommended for this case also, stated since the dogs are confined can the board keep the dogs in the dog pound until Mr. Malone builds the pen. Mr. Westbrook asked Mr. Malone how long it will be before he can build the pen. Mr. Malone stated by the weekend. it was settled that the do s would stay in the pound until the pen is built. Chairman Jeffers stated that since Mr. Westbrook had the case handled there would be no action needed by the board, but would like the case continued until next meeting and have a report brought back to the board at that time. Mr. Westbrook stated he still recommend a $25.00 fine and the agreement be made. Member Scherrer made a motion to have a minimum fine and they do Sig papers stating the dog will be penned up or taken out of the City. Seconded by member Thompson. Motion carried. CONTINUED CASES Mr. Westbrook requested cases 23-85 and 24-85 be cont.inu d until next meeting. Member Walker so moved. Seconded by member Palmore. Motion 7arried. ADJOURNMENT There being no further business to come before the board member Walker moved to adjourn. Seconded by member Kuhlewind.
