Member Kuhlewind stated he felt the people should live in peace; also he felt
Mr. Nipper has made a good attempt to keep the dog tied up. He would like the board
to propose something in the form of a warning and if it com s back before the board,
this case be used against him providing it was his dog. -
Member McArthur stated Mr. Nipper has tried to be corp rative and he didn't
feel there was enough proof of guilt, so he would move for dismissal.
Member Thompson stated she felt the family is responsi the pet, and for
the witness to call the humane society to come get the they were bothered any
more. That would make sure which dog it was bothering
Member McFarland stated she felt the people were afrai of the dog. Mr. Nipper
has made an effort. She further stated the people should c 11 the humane society;
also call Mr. Nipper and let him know they are afraid of th dog and they don't want
it at there house.
Chairman Leggett stated the chair would entertain a mo ion. Member McArthur
moved to dismiss Case No. 40-83. Seconded by Member Jeffer . Motion carried.
Case No. 40-83 dismissed.

There being no further business before the Code Enforc ment Board, Member McArthur
moved to adjourn. Seconded by Member Walker. Meeting adjourned at 8:20 P.M.

Hearings of the municipal code violations were held by th Okeechobee Municipal Code
Enforcement Board in Council Chambers at City Hall on Monday, ril 11, 1983. t
Vice Chairman Jeffers called the meeting to order at 8:45 P.M.
ROLL CALL
Vice Chairman Jeffers asked secretary Castorina to call t roll with the following
results:

Others present were: Code Enforcement Officer, Mallet e Westbrook; City Attorney,
David Conlon; Secretary Beatrice Castorina.
APPROVAL OF MINUTES
Vice Chairman Jeffers asked if everyone had received t e minutes of March 14, 1983
meeting. he stated if the Board have found the minutes cor ect and had no questions, the
chair would entertain a motion, the minutes stand approved s presented. Member Thompson
so moved. Seconded by Member Walker. Motion carried.
PRESENTATION OF CASES
Vice Chairman Jeffers asked Code Enforcement Officer, allette Westbrook to present
his cases.
DISMISSAL OF CASES
Mr. Westbrook requested the following cases be dismiss d because all are in compliance.
50-83 Larry Cabor
52-83 Anna Cole
Member Thompson moved to dismiss Case 50-83 and Case 5 -83. Seconded by member
Kuhlewind. Motion carried.
CASES TO BE HEARD
4-83 Lee Bailey -
Junk truck on premises.
Mr. Westbrook stated Mr. Bailey called him about three weeks ago for an extention of
time to move the truck, but he hasil t moved it yet. He d Mr. Bailey was not present.
Mr. Westbrook presented the board with two photographs e truck still on the property.
Vice Chairman Jeffers told secretary Castorina to enter the two (2) photos as evidence
in case 4-83.
Attorney Conlon asked if he took the photos. Mr. rook stated yes, about 4:45
this afternoon. Attorney Conlon asked if that was the rty of the complaint and the
pictures accurately defect what they show and he is in tion. Mr. Westbrook stated
absolutely. Member Kuhlewind asked where the property was ocated. Mr. Westbrook stated
507 S.E. 12th Avenue. Discussion ensured. Member Thompson stated she thought Mr. Bailey
wa subject to a fine to get his attention.
Member Kuhlewind stated it was not right for Mr. Baile to let the violation go.
He stated he didn't understand why Mr. Bailey didn't heed . Westbrook's call about
getting the junk truck cleaned up. Member Kuhlewind stated he was apprehensive
about a fine; only not knowing what else in the City to be cleaned. He stated he
didn't want it to appear the board was picking on this one 'ndividual, although Mr. Bailey
does't seem to heed Mr. Westbrook's coments concerning the iolation.
Attorney Conlon stated he had never seen any evidence f Mr. Westbrook picking on
anyone individual.
e After discussion Member Walker moved to fine fifty dollars ($50.00) .
Seconded by Member Thompson. Motion carried.

45-83 John Holman -
Junk and Overgrown weeds in yard
Mr. Westbrook review the case of John Holman, with the results that he cleaned at it,
but he didn't do a very good job of it. He stated he had t ken pictures of where Mr.
Holman had taken the debris from a pile in the weeds ttered it over the yard. t
Vice Chairman Jeffers asked secretary Castorina to ent r the two photos of the
Holman property into evidence in case 45-83.
Vice Chairman Jeffers asked the witness to come up and be sworn in. Norma Hartwick
was sworn in by secretary Castorina.
Norma Hartwick stated she lived at 1101 S.W. 10th Dr. nd Mr. Westbrook was at
her house this afternoon and she observed and showed him property next door.
It had automobile parts and etc. laying about the yard. stated the property
belonged to John Holman and she is scared of snakes. She a so stated it looked
better before he started cleaning it up. He has pulled the debris out of the grass
and threw it allover the yard, and it looks like a junk pi e.
Attorney Conlon asked if anyone knew why he pulled the debris out of the lawn
if you couldn't see it. Norma stated yes, because he was rning the wood. A lot
of it was wood so he set a fire. She stated she told him would have to haul it
to the dump and he told her he wasn't hauling it anywhere. stated it has
been laying there every since the Police come out and stope him from burning.
Member Walker asked if anyone lived in the house. a stated yes, but the
mess is John Holman's; it was there when he moved out.
Member Thompson stated she had friends living next to r. Holman's property and
she goes over there to visit. She stated the property was mess.
Member Thompson moved to fine Mr. Holman fifty dollars ($50.00). After a brief
discussion Member Kuhlewind seconded the motion. Vi ce Chai man called for a vote.
Motion carried.
The board members thanked Mrs. Hartwick for coming bef re the board to testify.
51-83 Richard VanDell -
Junk and weeds on premises.
Mr. Westbrook stated Mr. VanDell was not present; also he hadn't cleaned up his
property. He stated he had warned Mr. VanDell, if he didn' clean up the property,
he would bring him before the Board. Mr. Westbrook showed he Board two (2) photo-
graphs of the VanDell property.
Vice Chairman Jeffers asked secretary Castorina to ent r the photographs as evidence
in case # 51-83.
Member Walker moved to fine Mr. VanDell fifty dollars ($50.00). Mr. Westbrook
stated he had a complaint from the lady that owns the prope ty next door to Mr.
VanDell, and wanted her to testify, but she had togo outof own and couldn't be here.
Mr. Westbrook stated he tried to get in touch with her to g on her property to take
a picture of the back yard because she told him it looks wo sethan the front did. It
had old refrigerators, stoves and other debris in it.
Member Kuhlewind asked when Mr. VanDell was first Mr. Westbrook stated
eights months ago. Discussion ensured among Mr. Westbrook the board members with
Member Kuhlewind seconding the motion. Member Thompson sta the board should let the
people know they are serious in their actions. t
Vice Chairman Jeffers asked for a vote. Motion . Case #51-83 $50.00 Fine.

APRIL 28, 1983
A special meeting of the Code Enforcement Board to ele t a chairman and vice
chairman was held, Thursday, April 28, 1983, at 7:00 P.M., n the Council Chambers
at City Hall.
Members present were: Michael McArthur, Deara Thompso , Lloyd Jeffers, Blair
Kuhlewind, Jerry Walker, and new member Cecilia Miller.
Others present were: Code Enforcement Officer, Mallet e Westbrook; Secretary,
Beatrice Castorina.
Code Enforcement Officer, Mallette Westbrook called th meeting to order.
Mr. Westbrook explained the procedures of the Code Enf rcement Board to the
new member.
After discussion the board members decided to change t e meeting day to the
3rd, Tuesday of each month. The Board changed the meeting ime to 7:30 P.M. for
the summer months.
Mr. Westbrook asked the Board members for nominations or a chairman. Member
Thompson nominated Lloyd Jeffers for chairman. Seconded by member Kuhlewind.
Member Walker moved to close the nominations. Seconded by ember McArthur. Mr.
Westbrook called for a vote to elect Lloyd Jeffers chairman. Vote carried.
Member Walker nominated Michael McArthur for vice chai Seconded by
Member Jeffers. Member Walker moved to close the nominatio vice chairman.
Seconded by member Jeffers. Mr. Westbrook called for a vote to elect Michael McArthur
as vice chairman. Vote carried.
