DECEMBER 14, 1981 MINUTES OF THE OKEECHOBEE MUNICIPAL CODE E FORCEMENT BOARD Hearings of Municipal Code violations were held by th Okeechobee Municipal Code Enforcement Board in City Council Chambers, Monday, Decemb r 14, 1981 . Chairman Gordon e V. Leggett called the meeting to order at 7:00 P.M. The following members were present: Jim Attaway, Mic ael McArthur, Jerry Walker and Lloyd Jeffers. Others present were Building and Zoning Administrator Mallette Westbrook; City Attorney, David Conlon; and Deputy Clerk, Mary Ann Holt. Chairman Leggett informed the Board, Member Amadio had requested permission to be late due to a Hospital Board meeting. Member Amadio arriv P.M. APPROVAL OF MINUTES On the recommendation of Chairman Leggett, Member ers moved to dispense with the reading of and approve the minutes of the November 9th mee ing. Seconded by Member McArthur and carried. DISMISSAL OF CASES On the recommendation of Administrator Westbrook, Mem er McArthur moved to dismiss the following cases: 92-81 Ben Smith Paid Bill 103-81 Tanglewood Apartments Cleaned propert 117-81 Eli's Department Store Purchased Build 'ng Permit 113-81 Thomas W. A. Thomas Cleaned propert 105-81 Bobby Sweat Removed vehicle 85-81 Bass & Company Paid Bill 111-81 Shirley Anderson Cleaned propert 108-81 D. & M. Motion carried. CONTINUANCE OF CASES Administrator Westbrook recommended the following ca es be continued to January 11, 198; 91-81 Ben Smith 88-81 Reva Wells 87-81 Sam Lane 86-81 Clint Bass 125-81 Deara Thompson 98-81 Richard VanDell 99-81 Edison Walker 81-81 L. S. Weeks Member McArthur moved to continue these cases until anuary 11, 1982. Seconded by Member Jeffers. Motion carried. Administrator Westbrook noted Case No. 81-81, L. S. eeks should be dismissed, not - continued. Member Attaway moved to dismiss Case No. 81-81. Sec nded by Member McArthur. Motion carried. 2 CASES TO BE HEARD 123-81 Russell Smith - Dog running loose in neighborhood Administrator westbrook informed the Board he had dis ussed the case with Mr. Smith and had been assured the dog would be kept tied. Administ ator Westbrook recommended the case be dismissed. 41 Member Jeffers moved to dismiss Case No. 123-81. Sec nded by Member Walker and carried. 121-81 Phillip S. Brown - Dog running loosein neighborhoo After discussing the case with Mr. Brown, Administrat r Westbrook recommended dismissal. Member Jeffers moved to dismiss Case No. 121-81. nded by Member Walker. Motion carried. 118-81 Lorraine LaRose - Dog running loose in neighborhoo Administrator Westbrook informed the Board Miss LaRos had been fined $30.00 at the November 9th meeting for the same violation and the dog wa picked up by the Humane Officer the next day. Miss LaRose paid a $10.00 fee to the Humane Society and the dog was returned to her. Chairman Leggett ruled as evidence a copy of the rece'pt to Miss LaRose for $10.00 from the Humane Society ruling this as City's Exhibit #1. Lorraine LaRos~ after being sworn in by the ted that she had purchased a chain to secure the dog but it was too large and got loose. Humane Officer, Randy Whipple, was sworn in rk and stated that he did again pick up the dog belonging to Lorraine LaRose. William H. Jackson was sworn in by the Clerk. stated there is a German Sheperd in the area causing problems, but the owner dog has not been brought be- fore the Board, therefore, the problem has not been reso1 After further questioning of La Rose, Whipple and Ja by Board Members, Member McArthur moved to find Lorraine LaRose in violation of Seconded by Member Attaway. Motion carried. Member Jeffers moved to fine Lorraine LaRose $33.00 Seconded by Member Amadio. Motion carried. MEMBERS OF THE AUDIENCE TO ADDRESS BOARD Several members of the audience addressed previous cases and cases being dismissed before being heard. The consensus of the Board was to state on a resolution could be dis- cussed with Administrator Westbrook at least 48 scheduled hearing. ADJOURNMENT There being no further discussion, Member Attaway to adjourn the meeting. Seconded by Member Jeffers.
