Legislature which directs and authorizes the State Auditor or his assista~*

within the State of Florida; and directing said State Auditor to promulgate
Rules and regulations requiring s~id municipalit,_s to establish and adopt
uniform systems of accounts and records as promulgated by said State AuditœT
and to require the enforcement of such Rules and regulations and prescribing
penalties for their violations, and authorizing the Government to emplQY

fairs of said City can be best administered by local citizens instead of a

under the provisions of sa.id Bill, of Forty Thousand Dollê.rs is a useless

The City Council of the City of Okeechobee, Florida, met in
regular session on the above date, liJ.t 8:30 P. M. liJ.t the City Hill, with
the following present: H. H. Hancock, Mayor, O. L. Hunt, President of
City Council, Councilmen Coleman, Domer, Raulerson, and Singletary,

Minutes were adopted as rea.d.
Mrs. John Padgett appeared before Council in regards to City
exempting her water reat, in as much as she is a widow. Matter was reffer4
to Water committee.
D. B. McCarthy appeared before Council in regards to water rates.
J. W. Walston appeared before Council in regards to his water bill. Matter
was reffered to Water commitee.
Nathan Zelmenovitz appeared before Council in regards to water
services. Matter was referred to Water committee.

AN ORDINANCE INPOSING LICENSES AND OTHER TAXES, PROVIDING FOR
THE PAYMENT AND COLLECTION THEREOF AND PRESCRIBING PENALTIES FOR DOING
BUSINESS WITHOUT LICENSE OR OTHER FAILURE TO OOMPLY WITH THE PROVISIONS
THEREOF.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
OKEECHOBEE? FLORIDA.
Section l.
Th~t in addition to the licenses imposed under the provisions of
Ordinance #126 of the City of Okeechobee, Florida, the following licenses
are hereby required:
ITINERANT MERCHANTS - Cash bond in the 8mount of Five Hundred
($500.00) Dollars in addition to license fee as prescribed in Ordinance
#126 of the City of Okeechobee, Florida.

representing business houses outside of the City of Okeechobee, Florida,

Section 2.
No license shall be issued to æny person, firm, association, co-
partnership and/or corporation for any business, profession or occupation
under this Ordinm~ce IDlless and until the applicant for such license sh~ll
hav:~ paid ¡Ill person8~ property t8_xes, vb ich have been assessed by the City
of Okeechobee, Florida, against the property to be used in said business,
profession or occupation, and in the event such business, firm, associ~ticn
co-partnership 8~dlor corporation shall not have paid personal property
taxes for at least one year prior to the issuance of such license, such
person, firm, association, co-partnership and/or corpoeation, shall prior
to the issuance of said license furnish the T8Ã Collector of the City of
Okeechobee, Florida, with a cash bond payæble to the said City of Okeechoœe
. in the sum of Five Hundred ($500.00) Dollars ~1d conditioned upon the pay-
ment of personal property taxes for that period of time in said fiscal year
during which such person, firm, association, co-partnership and/or corpor-
I ation shall do business.
Section 3.
All licenses issued IDlder the provisions of this Ordinance shall
be payable, and sha~l be issued, at the time and in the manner specified in
Ordinance #126 of the City of Okeechobee, Florida.
Sectlbon 4.
Any person, firm, association, co-partnership and/or cOrpoEation
operating any of the business above specified in the City of Okeechobee who
shall f~il or Eefuse to pay the license herein set forth shall be punishable
by fine not exceeding -.$150.00 or by imprisonment not exceeding sixty days or
by both such fine or imprisonment, in the descretion of the Mayor.
Sect ion 5.
All Ordinances or parts of Ordinances in conflict herewith by,
and the slme are hereby repea~ed, PROVIDED HOWEVER, that this Ordinance is
supplementary to Ordinance #126 of the City of Okeechobee and repeals only
such parts of said Ordinance as are in conflict herewith.

CHOBEE, FLORIDA.
SECTION 1.
Before any person, firm or corpor~tion shall sell or be engaged in
the business of selling in the City of Okeechobee, Florida, goods, wares,
merch.~dise or other personal property, such sales being advertised as bank-
rupt, insolvent, insurance, assi~1ee, trustee, testator, executor, adminis-
tr~tor, receiver, auction, syndic~te, rlilroad or other wreck, whloesa18 or
manufacturer's or closing out sale, or as goods d8maged b; smoke, fire, water
or otherwise, such person, firm or corpora~on shall file an application with
the Tax Collector of the City of Okeechobee, Florida, for a license, which
application shall be accompanied by an affidavit stating all the facts, re-
lating all the reasons for and the character of such sales so advertised and
represented, and including the statement of the names of the persons from
whom the goods, wa,res e.nd merchandi se or other persona_l property wa.s obtainai
the date of delivering to the person applying for such license, and the place
from which said goods, wares and merchandise or other personsl property waS
last t~ken or brought, end 811 details necessary to exactly locate and fully
identify the said goods, wares and merchandise or other personal property, and
shall further pay to the Tax Collector of said City as a license for the pri-
vilege os selling such gQOds, wares, merchandise or other personal property,
the sum of Two Hundred Fifty Dollaxs ($250.00) for each sale; and upon the
filing of such application and affidavid and payment of said sum, the Tax
Oollector shall issue A license to each applicant, but the provisions Whereof
shall not apply to bona fide sales of general assignees for the benefit of
creditors or bo~ fidetr~tees sell1ng =der po"r of sele in ~ ~ed of trd
or mortgage-or lien, executors and aAministrators selling goodS of their
decendents or to any officer selling the property under legal process, or to
regularly licensed auctioneers selling bona fide at public outcry in the
usual course of their business, or bona fide merchants in selling or dispos-
ing of stocks or merchandise who were the original OID1ers of said stock or
stocks of merchandise and a license having already been paid by the merchant
prior to the bankruptcy proceedings.
SECTION 2.
Every person, firm or corporation, including principals a~d their
agents, servants or employees ~o,shall sell or engage in the business of
selling goods, wares, merchandise or other personal property without having
first co~li.d with Section 1 of this Or~n~e Mall, ~on conviction, be I
fined not less than One H=dred DolluB ($100.00) or more thw T~ H=dred I
Fifty Dollars ($250.00) or imprisoned not more than sixty days in the City
Jail, or both such fine or imprisonment,
SECTION 3.
Each day or part of day that such person, firm or corporation shall
sell or be engaged in the business of selling goods, w~~es, merchandise or
other personBl property in violation of this Ordinance shall be taken, con-
sidered and construed as a distinct 3~d separate offense and violation of th~s
Ordinance.
SECTION 4.
If any section, sentence, clause or phrase of this Ordin8nce shall
be held to be invalid or unconstitutional, the S8me shall in no way effect any
other section, sentence, clause or phrase of this Ordinance.
SECT ION 5.
That nothing h.rein provided shall be construed to repeal any I
license tax now i.posed by Ordinance as this Ordinance is intended to sup- '
plement the Ordinance now in force.
SECTION 6.
This Ordinance shall become effective upon its passage in the
manner prescribed by the Charter of said City of Okeechobee, Florida, and
the laws of the State of Florida.
