STANDARDS FOR GRANTING A VARIANCE (Sec. 70- 374(b), page CD70:20 in the LDRs) Applicants are required by Sec. 70- 374(b) to address the following issues in his /her presentation before the Board of Adjustment. Staff strongly recommends that the Applicant include, in his /her application, materials that address each of these issues in order to allow Staff and the Board of Adjustment sufficient time to adequately consider the Applicant's request. 1. Demonstrate that the variance is needed to overcome a hardship caused by the unique physical conditions of the site [and not merely for economic reasons or the convenience of the applicant] . 2. Specify the minimum variance required including height, lot area, size of structure, size of yard, setback, buffer or open space. [Applicant should explain why the requested variance is the minimum necessary to overcome the hardship.] FINDINGS REQUIRED FOR GRANTING A VARIANCE (Sec. 70- 374(c) , page CD70:20 & 21 in the LDRs) It is the Applicant's responsibility to convince the Board of Adjustment that approval of the proposed variance is justified. Specifically, the Applicant should provide in his /her application and presentation sufficient explanation and documentation to convince the Board of Adjustment to find that: I. Special conditions and circumstances exist which are peculiar to the land or structure involved, and are not applicable to other land or structures in the same zoning district. 2. The special conditions and circumstances do not result from actions of the applicant. 3. Literal interpretation and enforcement of the Land Development Code would deprive the applicant of rights commonly enjoyed by other properties in the same zoning districts under the terms of the Land Development Code, and would work unnecessary and undue hardship on the applicant. 4. The variance, if granted, is the minimum variance necessary to make possible the reasonable use of the land or structure. 5. Granting the variance request will not confer on the applicant any special privilege(s) that is (are) denied by the Land Development Code to other land or structures in the same zoning district. 6. Granting the variance will be compatible with the intent and purpose of the Land Development Code, and the variance will not be injurious to the neighborhood or detrimental to the public welfare. The City staff will, in the Staff Report, address the request and evaluate it and the Applicant's submission in light of the above standards and required findings and offer a recommendation for approval or denial upon rates. 17. Approved and authorized the Chairman to execute the agreement with Advanced Data Processing, Inc., for Fire Rescue EMS billing and related services, subject to the County Attorney's approval. 18. Approved the purchase of five (5) capnography devices (devices that measure the build -up of CO2 in an intubated patient) from Medtronic Emergency Response Systems (sole source) at $4,274.50 each for a total of $21,372.50, installed. 19. Adopted Resolution 2007 -45 appointing Cindi Fairtrace, real estate professional, as one (1) regular member to the Affordable Housing Advisory Committee, term to expire September 13, 2009. 20. Rejected the bid from Coral Key Construction, LLC for the State Housing Initiative Program (S.H.I.P.) rehabilitation of the home of Martha Santa Cruz located at 881 SW 5th Avenue, Okeechobee, FL 34794 to correct several code violations. Description of the Requested Variance: The applicant is requesting a variance from Section 90-375(2) of the City of Okeechobee Land Development Code to allow for a zero setback from unimproved NW 4th Street for a concrete building housing an emergency generator and associated fuel storage in the Public Use (PUB) Zoning District. Background: The subject property is approximately 2.5 acres fronting on unimproved NW 4th Street. This is the site of the Okeechobee County Sherriff's Department and Jail facility. The new facility is intended to replace the 20+ year-old generator located elsewhere on the 1 Staff Report Variance Request mplicant: Okeechobee County Petition No.: 08-002-V property but which is no longer capable of providing for the needs of the facilities during a Toss of commercial power. Subject Site and Surrounding Area: The property on which the generator and fuel storage will be located is surrounded on three sides by other County -owned properties and facilities, with the ball park being located immediately south across unimproved NW 4th Street. All of these properties are also zoned public facilities. Only the lands to the west across unimproved NW 7th Avenue are owned by private entities and these are all zoned Industrial. The subject site, surrounding properties, and their zoning designations can be seen on the context aerial at the end of this report. The approximate location of the building (about 40' x 40') housing the emergency generator and fuel storage is between the existing "Sally Port" and the flag pole in front of the Sherriffs office (refer to site aerial at the end of this report). Discussion: After reviewing this application, Staff has determined that the request generally satisfies the criteria outlined below for granting the variance: A. Special conditions and circumstances exist which are peculiar to the land or structure involved, and are not applicable to other land or structures in the same zoning district. The Sherriffs Department and Jail were established nearly 20 years ago and the County had no way of contemplating the need for, and location of, a generator of this type at that time. B. The special conditions and circumstances do not result from actions of the applicant. Evolution of the nature of generators has resulted in specific locational require- ments that could not have been contemplated twenty years ago. In fact, need for and employment of such generators has only recently been considered necessary and feasible in the aftermath of the recent active hurricane seasons. 2 Staff Report Apil 111 lint: Okeechobee County Variance Request Petition No.: 08-002-V C. Literal interpretation and enforcement of the Land Development Code would deprive the applicant of rights commonly enjoyed by other properties in the same zoning districts under the terms of the Land Development Code, and would work unnecessary and undue hardship on the applicant. The County has a responsibility to protect its employees, inmates and others under its care. The County also has a fiduciary responsibility to its citizens and taxpayers to meet its responsibilities in a cost effective manner that does not adversely affect other nearby properties. In this instance, it would be impractical and inordinately expensive, and a drain on the resources of the citizenry, to locate the emergency generator in a location that would comply with setback requirements. D. The variance, if granted, is the minimum variance necessary to make possible the reasonable use of the land or structure. In order to place the generator in a safe location, within a practical distance of the source of fuel, and in an area wherein it can be physically accommodated, requires the possibility of a zero setback from unimproved NW 4th Street. E. Granting the variance request will not confer on the applicant any special privilege(s) that is (are) denied by the Land Development Code to other land or structures in the same zoning district. Given similar problems and limitations, it is not believed that other public uses on land similarly zoned would be denied the ability to locate a mechanical device essential to safety and well-being of employees and other persons working or housed in a public facility. F. Granting the variance will be compatible with the intent and purpose of the Land Development Code, and the variance will not be injurious to the neighborhood or detrimental to the public welfare.
