Statement Addressing Land Use Requested (Variance)
Beverley B. Martin owns Lots 7, Block 58, City of Okeechobee
located at 803 North Parrott Avenue. Thomas W. Roach owns the
billboard and leases a portion ofthe above referenced property. The
applicant wishes to replace the existing billboard. The existing
billboard measures 12' x 25' and is very low to the ground and is too
close to the street. The proposed billboard measures 10' x 20' and will
be relocated back 15' from the sidewalk and will be approximately 23'
high. The property owner intends to maintain ownership of the
building and lease space to Thomas W. Roach for the billboard. In
accordance with the City of Okeechobee Unified Land Development
Code a variance will be required.

request for a variance to replace the existing billboard.

Statement of Planning Assumptions
A. Project description;
The applicant is proposing to replace the billboard located at 803 North Parrott Avenue. The
existing billboard measures 12' x 25' and is very low to the ground and is approximately 4'
from the front property line. The proposed billboard measures 10' x 20' with a single pole and
will be placed approximately 15' from the front property line. The billboard will be about 23'
high.
B. Projected residential population, age group and family type;
Not applicable.
C. Projected commercial and industrial activities, number of employees, hours of
operation;
Not applicable.
D. Proposed density, by building type and use area;
Not applicable.
E. Proposed ownership type, ownership and maintenance organization for open spaces
and recreation facilities;
The applicant intends to maintain ownership of the proposed billboard. The applicant further
intends to be responsible for maintenance and upkeep of the billboard.
F. Projected sequence of construction phases and development schedule;
A phasing and development schedule is not proposed for this project. The project will be
completed in one phase.
G. Proposed engineering systems: water supply, sanitary waste disposal, storm water
retention and outfall, solid waste disposal, emergency services, and utility supplies.

Lessor consents and grants to Lessee the right of ingress and egress to and from said
site; the right to provide or establish electrical power to said site and place
incidental equipment thereon; the right to sublet said site or sign structure(s) or to
assign this lease.
It is agreed that all structures, equipment, materials and fixtures placed upon said site
shall remain the property of Lessee and Lessee is granted a reasonable time to remove the
same after the termination of this agreement. It is further agreed that Lessee shall be
entitled to an apportionment on the basis of the value of its leasdhold interest of any
awards or compensation received in connection with any legal action or proceeding or
compromise settlement made pursuant to any governmental agency requirement for the removal
of said sign structure(s).
Lessor shall not cause or permit any advertising sign structures other than Lessee's to be
erected or placed within a radius of 100 feet of Lessee's sign structure(s) nor cause
or permit said signs to be or become obscured from the highway.
In the event that (a) Lessee is unable to secure a required permit or license from the
appropriate governmental authority, or (b) federal, state or local statute, ordinance,
regulation, or other governmental action shall preclude or materially limit the use of said
site for advertising purposes. Lessee shall have the right to terminate this lease upon 15
days notice in writing to Lessor, and Lessor shall refund to Lessee any rental payment paid
in advance for the remainder bf the unexpired term. It is acknowledged by the parties
hereto that the payments required hereunder are predicated on monthly rates, and in the
event the provisions of this paragraph becomes operative, or the term hereof commences on
some date other than the first day of a month, all payments required hereunder shall be
prorated based upon a thirty day month.

In the event of any potential change in ownership of the property herein demised, Lessor
agrees to notify Lessee of such a potential change at least thirty (30) days prior to any
closing consummating said change in ownership and to include the name and address of any
and all prospective purchaser(s). Lessor further agrees to give and deliver to any and all
such prospective purchaser(s) formal, written notice of the existence of this Lease at
least thirty (30) days prior to such a closing and agrees to grant to Lessee an
unconditional right of first refusal to purchase said property, said right to be exercised
by Lessee no later than thirty (30) days after receipt of written notice of said potential
change.
This lease may be renewed by Lessee for a period of 10 years, and from year to year
thereafter, for a maximum of 5 one-year renewals, upon the same terms and conditions, by
Lessee delivering notice of such renewal to Lessor no later than 60 days prior to the
expiration of each term.
This lease shall be binding upon the heirs, executors, personal representatives,
successors and assigns of the parties hereto.
This contract shall not obligate PAC in any way or payment of lease is not due until
accepted and signed by an executive officer of PAC ADVERTISING, at the executive offices of
PAG ADVERTISING, and lessor shall not claim that any of the terms of the agreement have been
waived or modified in any way, except insofar as they may have been modified in writing by
lessor and by an executive officer of PAC ADVERTISING.
