Request for Variance from Section 504: Non-Residential Landscape Buffer Regulations
. Variance Sought: The applicant requests relief from the Section 504 regulation that requires a
non-residential development to provide a 10 foot landscape buffer along street frontage.
The proposed development is located at 312 SW ih Ave in Okeechobee, FL.
Demonstrate that the variance is needed to overcome a hardship caused by the unique
physical conditions of the site: A parking area exists to the east of an existing CBS building.
The applicant proposes to keep the existing building, use the existing parking area, and add the
additional required parking spaces adjacent to those existing.
· The existing parking is approximately 2 feet from the east property line.
· The available space between the sidewalk and the property line is 46 feet, which can
accommodate the required 20-foot parking stalls, the required 24-foot travelway, and a 2-foot
buffer.
· No other areas of the site are available for parking.
· The applicant is further restricted by DEP regulations regarding minimum setbacks and
spacing of buildings and propellant tanks and cannot adjust the proposed location of new
buildings to accommodate the landscape buffer requirement.
Minimum requirement = 10 foot buffer.
Applicant can provide a 2 foot buffer.

Dear Sirs:
Thank you for meeting with us on July 9th, 2001, regarding the permits necessary to begin our
project to build an aerosol filling facility at 312 S.W. 7'h $If. We wanted to take this opportunity
to clarify the company who will complete the project. Loumax Development Inc. will build the
facility and Ecotec Manufacturing will actually produce the aerosols when the project is
complete. On July 9th, 2001, our initial meeting, the site plan incorrectly listed Ecotec
Manufacturing, we have amended the site plan as of this date to read Loumax Development Inc.
We apologize for any inconvenience this may cause; however, we have made this change at
the request of Bank of America.
A.V.W. Inc currently owns the land located at 312 SW 7'h ~l. Loumax Development will build
the aerosol filling facility. Ecotec manufacturing will run the aerosol plant. Mr. John Abney of
Abney & Abney Construction is appointed as the authorized agent for A.V.W. Inc, Loumax
Development Inc. and Ecotec Manufacturing Inc.
Loumax Development is applying for a land variance for its proposed parking lot. Currently there
is an existing parking lot in front of the existing building. The new parking lot would only be an
extension of the existing parking lot. This parking lot is set back 2 feet from the North Eastern
property line, according to the previous code. According to the new code the set back has been
changed to 10 feet from the property line. The reason for this setback requirement was for
beautification purposes and to allow enough room from the street to the parking lot. This
particular piece of property has sunk in drenches separating the lot from the street. This drench
is about 20 feet wide and allows significant footage from the road to the parking lot.
We have tried to move the buildings around in order to accommodate the new code of ten feet.
We have not been successful. The approximate square footage of the entire property is 66,000
sq. ft. In the aerosol filling business there are Federal guidelines regarding the positions of the
buildings. Before we do anything we lose 50 feet around the perimeter of the property or
approximately 35,000 sq.ft. The current parking lot in the front is two feet from the property line.
We would simply like to extend this parking lot to accommodate this addition.. It would create
undue hardship on Loumax Development if they were not able to continue the parking lot two
feet from the boundary line.
After carefully reviewing several different site plans for this location we have found that the only
way to set up an aerosol filling facility would be to extend this parking lot. Also, Loumax
Development plans on putting attractive shrubs and bushes surrounding the front of the parking
lot. We are submitting blue prints of the manufacturing facility for your review.

Landscaping and landscape buffers shall be indicated on a site plan and provided in accord with the following
Regulations.

501 RESIDENTIAL TREE PLANTING LANDSCAPE REGULATIONS
Following are the number of trees required:
Multiple Family 1 bedroom
Multiple Family 2 to 4 bedrooms
Mobile Home Park or Subdivision
Adult/Assisted Uving Facilities, Nursing Home
2 trees per dwelling
3 trees per dwelling
2 trees per dwelling
1 tree per 2 units or bedrooms
502 NON-RESIDENTIAL TREE & SHRUB PLANTING LANDSCAPE REGULATIONS
Following are the number of trees and shrubs required to be planted:
1 Landscaping material required under this section may be used to satisfy the standards for landscape
materials listed under Parking Area and Landscape Buffer Planting Standards.
2 At least 1 tree and 3 shrubs shall be planted for every 3,000 square feet of non-residential lot,
excluding areas of existing vegetation which are preserved.
503 NON-RESIDENTIAL PARKING AREA LANDSCAPE REGULATIONS
Parking areas with a single access lane do not need to be landscaped. Parking areas with more than one
access lane shall be landscaped as follows:
1 At least 18 square feet of landscaped area for each required parking space.
2 At least 1 tree for each 72 square feet of required landscaped area.
3 Shade trees shall be planted at no more than 20 feet on centers near the intersection point of parking
spaces.
4 Minimum dimension for any required landscaped area with a parking area shall be 4 feet.
5 Remainder of a parking landscape area shall be landscaped with grass, ground cover, or other
landscape material.
504 NON-RESIDENTIAL LANDSCAPE BUFFER REGULATIONS
Landscape buffer areas shall be required within required setbacks and landscaped as follows:
1 Minimum width of buffer along: Street frontage: 10 feet. Other property lines: 2 feet.
2 At least 1 tree and 3 shrubs for each 300 square feet of required landscaped buffer.
3
Trees may be planted in clusters, but shall not exceed 50 feet on centers abutting street.

4 Remainder of a landscape buffer shall be landscaped with grass, ground cover, or other landscape
