Statement of Interest - Variance Application
(Intended to address items #2, #10, and #11 of the checklist)
I am the owner of property in the City of Okeechobee. The property was originally used
as a residential home. The property received a zoning change from RSF-1 to Heavy
Commercial in April, 2002. The positioning of the structure on the lot has created quite a
site plan challenge, which has taken several months to try and work out. In order to
proceed with a final site plan, I must ask for a variance.
Several site plans have been proposed to create a parking area allowing the six required
off-street parking spaces, along with associated drainage. After several issues were
raised along the way, we have now designed a parking area that addresses the
concerns of all of the site plan review committee members, however, the plan does call
for a variance to the western property line (rear property line), allowing for a set-back
reduction from 10 feet to 3 feet.
In doing so, adequate visibility at the intersection of SE 2nd Avenue and SE 5th Street can
be provided, as well as adequate access from SE 5th Street. The design allows for the
required 6 spaces, as well as proper onsite maneuvering within the parking lot area.
The set back variance will affect the property line between my office use, and a fast food
restaurant. There is an existing privacy fence already screening the intense restaurant
commercial use from a less intense office use. The restaurant has parking along their
side of the property line. Therefore, reducing the setback allowing parking on my side
will still conform to the existing uses.
Several plans have been presented and/or discussed up to this point, wherein the best
design still requires a variance to the western property line; however, this design also
allows for a 26 foot front buffer to better serve the intersection. Therefore, with support
from the site plan committee and city council, I am respectfully requesting a variance for
a reduction to the rear set back from 10 feet to 3 feet along the western property line of
my property to allow for off-street parking.
