Variance # 1
Variance to construct 18' by 9' spaces plus 2' of overhang verses the required 20' by 9'
spaces per City of Okeechobee Code;
"Based on City of Okeechobee criteria, parking spaces must have a paved dimension of
20' x 9'. The proposed site plan includes a vehicular use area that includes seventy-two
(72) new parking spaces.
Nine (9) of the new parking spaces are located along a proposed 5' wide sidewalk on the
entrance side of the proposed funeral home entrance (east perimeter of the parking area).
These spaces are proposed with an 18' x 9' asphalt area. These spaces will be bound
lengthwise by a 5' sidewalk. There will be a 6" drop from the sidewalk to the parking
space, therefore, the sidewalk acts as a wheel stop, preventing cars from encroaching
more than 2' across the sidewalk.
Typically, a concrete wheel stop is positioned 2' from the end of a parking space. In the
case of the City ofOkeechobee, the wheel stop would be positioned such that the 20'
length is broken down into 18' with a wheel stop, then an additional 2' of paved
overhang.
The proposed nine (9) parking spaces along the East perimeter of the parking area will
include 18' of asphalt and will overhang 2' into the proposed sidewalk. 20' of total
length is provided as intended by the City criteria.
The proposed site plan can be modified to propose 20' with a wheel stop, however, the
adjacent sidewalk would then have to be reduced to 3'. We feel these proposed 18'
parking spaces meet the intent of the City criteria and allows construction of a 5' wide
sidewalk for pedestrian traffic path, which would serve the site better than a 3' wide
sidewalk.

Thirty-five (35) of the proposed parking spaces are located along the north, west and east
perimeters of the proposed parking area. These spaces are proposed with a 18' length,
then a 6" high FDOT Type D curb, then a 2' overhang into the proposed detention area.
As stated above, the typical City 20' parking space consists of 18', then a wheel stop,
then a 2' paved overhang. We feel the proposed thirty-five (35) spaces described above
meet the intent of the City criteria, allows more previous area coverage and less storm
water runoff.
Variance # 2
Variance to allow construction of the driveway into maintenance garage;
"Based on the City of Okeechobee Code, no parking space can back directly out into a
City street. The proposed site plan includes a maintenance garage, which is separated
from the City Street by approximately 40'. Vehicular use of the proposed garage would
be afforded 40' of pave driveway to negotiate the ingress/egress into N.E. 2nd Avenue.
Therefore, we feel the proposed garage and the 40' driveway meets the intent of the City
criteria established to prohibit direct access to City streets.
City staff has suggested construction of a circular driveway at this location. We have
studied this possibility, however, it appears the 72" oak tree, located just South of the
proposed garage, would have to be destroyed".

Dear Jim:
We offer the following information in response to the Staff Report — Site Plan Review dated
8/2/05. The numbers below correspond with the numbers of your report:
1) The set back proposed for the new building is 8 feet on the north side. The applicant
plans to use this side of the building as an employee entrance. The actual front of the
new building will face Highway 441. In fact, the proposed building has already been
assigned a new address by the city (410 Highway 441 North). Therefore, since the
neighboring property on the north side of NE 5th Street is occupied by a bank
(commercial) the minimum required set back should be 8 feet.
2) The proposed 18' x 9' parking spaces have already received a variance and we do not
understand why this is being questioned once more.
3) We have attached a copy of a letter we received from Waste Management indicating that
the dumpster may remain where it is. If either Waste Management or the applicant have
concerns regarding the placement of the dumpster in the future, it can be moved to a
location inside of the proposed fenced area.
4) Upon completion of the new building and site improvements, there will be no hearses
backing onto NE 2nd Avenue. The hearses will enter the property from NE 4th Street and
head north through the old alley and turn left (east) and pull into the existing metal
building. Once the caskets are unloaded, the hearse will pull out onto NE 2nd Avenue.
Please note that the city has already approved the existing concrete parking pad in the
right-of-way along NE 2nd Avenue behind the metal building. The asphalt driveway
located in the right-of-way at the corner of NE 2nd Avenue & NE 5th Street is no longer
used. In fact it can be removed and should not cause a concern.
5) The only area where the City may desire to vacate the right-of-way would be for the
concrete driveway behind the metal building. As indicated in Item #4, the old asphalt
area is no longer used.
6) The forcemain and lift station have already been permitted, constructed and cleared for
use by all applicable agencies.
7) We have received a D.O.T. drainage permit.

8) OUA has already accepted the forcemain in its current location. There are no planned
changes for the east side of the metal building, therefore, no further agreements are
necessary.
Jim, we respectfully request that you reconsider the various issues stated in your report based on
the information provided above. In addition, if necessary, the applicant will request a variance
for the reduction in the set back for the east (rear) side of the proposed building from 20 to 15
feet. This will allow for the proposed building to be in line with the existing metal building.
The applicant, Paul Buxton, is very anxious to begin the construction of the new funeral home.
Since his previous facility was destroyed by a hurricane, he has been without a permanent chapel
facility for nearly a year. Paul has asked us to assist him in this site plan review process. If we

the low volume of traffic in this area. Waste Management will also not be held liable for

Jim LaRue briefly explained the applicants request. He reminded the Board that to approve a
variance, the applicant has to show that there is a hardship.
Chris Close, agent, and Mike Oliver, Landscape Architect, demonstrated a drawing of the site.
They explained that Variance No. 2 has been addressed, as shown on the drawing, because the
funeral cars will enter through the courtyard, enter into the back of the garage, in turn be able to
pull out of the garage onto NE 2nd Avenue in a forward motion. There was a brief discussion
regarding posting no parking signs in front of the garage.
Mr. Oliver explained that the applicant does have a hardship for the parking space size of Variance
No. 1. There are actually two sections of the parking lot that this reduction applies to, the parking
spaces that are along the edge of the parking lot and the parking spaces that abut the building. He
explained that the water drains across the parking lot, into the drainage areas in front of the parking
spaces that are along the edge of the parking lot. The tire stop would block the flow of water and
actually act as a trap for debris. The proposed set up of the parking lot, drainage flow, and having
the 18 x 9 parking space size with no tire stop will actually increase the drainage and open space
in the parking lot. The curb will be the tire stop and the front end of the car will overhang onto the
mulch of the landscaping buffer.

ACTION - DISCUSSION - VOTE
The parking spaces that abut the building actually have a hardship as well. The tire stop with a two
foot overhang would be a hazard for tripping to the guests of the funeral home. The proposed
drawing shows that these parking spaces will have the curb as a tire stop, and the car will overhang
two feet onto the sidewalk. The sidewalk is currently proposed to be 5 foot wide, so even with the
car hanging over onto the sidewalk it is still 3 feet wide. There was a brief discussion about the
width of the sidewalk.
Board Member Ledferd motioned to approve Variance No. 1 to allow for a reduction in parking
space dimensions to 18 x 9 fee, including the widening of the sidewalk to seven feet from five feet;
seconded by Board Member Keller.

The applicant is requesting a variance from the parking space requirements of the City of
Okeechobee Land Development Code to allow for less than full length parking spaces in the
Heavy Commercial Zoning District. Also, on North East 2nd Avenue, the applicant is requesting
a variance for three parking bay spaces that open directly onto that street.
1. 90-511(b) "The minimum parking space shall be 9'x20'.
2. 90-511(e)(2) "each parking or loading space shall open directly onto a driveway that is
not a public street..."
Background:
The subject property is approximately 2.07 acres fronting on NE 5th St. The applicant intends to
build onto the existing buildings to enlarge his business. The business has public utilities and the
adjoining property users are as follows:

In the new parking area, there are seventy -spaces shown with forty-four being 9 x 18 and 28
being 20 x 9.
Discussion:
After reviewing this application, Staff has determined that the request generally does satisfy the
criteria outlined below for granting the variance:
A. Special conditions and circumstances exist which are peculiar to the land or
structure involved, and are not applicable to other land or structures in the same
zoning district.
The applicant maintains that there are circumstances, in terms of the location of
the building, that prevent full compliance with the City's requirements. However,
there are no existing conditions to the land that are peculiar and not applicable to
other land or structures in the same zoning district.
B. The special conditions and circumstances do not result from actions of the
applicant.
The design of the parking layout by the applicant has been the primary factor for
the need of the variances. With regard to the bays opening on to 2nd avenue, this
also is derived from a design preference.
C. Literal interpretation and enforcement of the Land Development Code would
deprive the applicant of rights commonly enjoyed by other properties in the same
zoning districts under the terms of the Land Development Code, and would work
unnecessary and undue hardship on the applicant.
It would seem that enforcement of the Code would not deprive the applicant of
rights enjoyed by other properties. In reference to the opening of the parking bays
onto 2nd Avenue, there is a public safety concern.
D. The variance, if granted, is the minimum variance necessary to make possible the
reasonable use of the land or structure.
The applicant maintains that the parking size variance request represents the
minimum variance necessary for reasonable use of this land when trying to
modernize the existing situation. Staff however, thinks that the parking area can
be redesigned in order to meet the City's requirements without shrinking the
sidewalk next to the building.

E. Granting the variance request will not confer on the applicant any special
privilege(s) that is (are) denied by the Land Development Code to other land or
structures in the same zoning district.
It is difficult for staff to see that special privileges would not be granted if these
variances were approved. There seems to be enough of a drainage area that could
be decreased slightly in order to enlarge the parking areas. This would
accommodate the proper length of spaces.
F. Granting the variance will be compatible with the intent and purpose of the Land
Development Code, and the variance will not be injurious to the neighborhood or
detrimental to the public welfare.
Unless the Land Development Code is revised there are reasons to maintain the
size of spaces as required. The opening of parking spaces directly onto a street
should be prevented as it can be detrimental to public safety concerns.
Recommendation:
Staff recommends denial of the variance request to allow nine by eighteen foot parking spaces
and to allow parking bays to open directly onto S.E. 2"d Avenue. If the Board of Adjustment
determines that a hardship exists for the size of the parking spaces, staff feels the variance should
be limited to the nine spaces that are mentioned by the applicant.
