Introduction:
The applicant is requesting a variance from Section 90-511(e)(2) of the City of
Okeechobee Land Development Code to allow the applicant to continue using parking on
the east side of the structure which requires cars to back out into NE 3rd Avenue. The
subject property is located within the CHV Zoning District.
Background:
The subject property is approximately 0.162 acres fronting on State Road 70. The
applicant intends to change the use of the property from a pawn shop to a restaurant. The
dwelling does have public utilities and the adjoining property users are as follows:

Discussion:
After reviewing this application, Staff has determined that the request generally does satisfy the
criteria outlined below for granting the variance:
A. Special conditions and circumstances exist which are peculiar to the land or
structure involved, and are not applicable to other land or structures in the same
zoning district.
There are no special conditions or circumstances which are peculiar to the land or
the structure to warrant this variance. The parking required for the property has
existed in a non -conforming status for a pawn shop. However, the requested
continuance would not be suitable for a restaurant because the backing out onto a
street intensifies if a use is changed.
B. The special conditions and circumstances do not result from actions of the
applicant.
Yes, the special conditions and circumstances would result from the applicant's
actions. Staff can reasonably validate that the proposed use would create a
condition that would be the result of the applicant's actions
C. Literal interpretation and enforcement of the Land Development Code would
deprive the applicant of rights commonly enjoyed by other properties in the same
zoning districts under the terms of the Land Development Code, and would work
unnecessary and undue hardship on the applicant.
No, literal interpretation and enforcement of the Land Development Code would
not deprive the applicants of any rights enjoyed by others within this zoning
district. In fact, the enforcement of the Code in this case is protecting the public
from any unsafe conditions that might result from allowing this variance request.
D. The variance, if granted, is the minimum variance necessary to make possible the
reasonable use of the land or structure.
No, this request by the applicant is not the minimum variance necessary to make
possibile the reasonable use of the structure. The applicant simply does not have
enough space for a restaurant. If allowed, however, the site would create
hazardous conditions that are specifically denied by the Land Development Code.

Jim LaRue explained that the applicant had come before the Technical Review Committee at their
March 16, 2005 meeting. At that time the Technical Review Committee recommended to the City
Council to approve a twenty percent reduction of parking for the proposed restaurant. The
reduction of parking request will be considered by the City Council at their April 5, 2005 meeting.
The applicant then submitted a letter withdrawing his Variance Petition.
This petition was not considered, as it was withdrawn by the applicant.
There being no further items on the agenda, Chairperson William Ledferd adjourned the meeting

Planning Staff Report Discussion, continued: (F) Granting this variance would be incompatible

John Whidden, applicant, briefly explained the request to the Board Members. He explained that
he is proposing to have three parking spaces along the eastern side of his building that open directly
onto the City Street. Mr. Whidden also explained that he has an agreement between himself and
the Newman's allowing him to use five of the parking spaces at their unoccupied building located
next door. Mr. Whidden stated that he had come before the Technical Review Committee last
week and they requested that he add some landscaping, and a use of alley agreement from the City.
Mr. Whidden provided a copy of the revised plan, including the landscaping. He also noted that
he was working with Lane Gamiotea, City Clerk, regarding the Use of Alley Agreement.
Board Member McCoy questioned whether the parking spaces would be long enough?
Mr. Whidden explained that the spaces were 25 feet in length.
Chairperson Ledferd questioned whether there would be a problem with the parking spaces backing
onto a side street so close to Highway 70. Mr. Ledferd explained that he didn't think that the
Department of Transportation would approve the three proposed spaces that are located nearest to
Highway 70. Mr. Ledferd continued by explaining that in his opinion the parking spaces are a
safety hazard.
Board Member Mavroides questioned the non -conforming status of the building, he explained that
the use of a pawn shop would be less volume than a restaurant.
Mr. Whidden responded that the restaurant would be a higher volume than the pawn shop, however
it would be limited hours, like around lunch time and dinner time. Mr. Whidden also explained
that Northeast 3rd Avenue is not a high volume street. He continued by explaining that he has been
there 14 years and that there have been no accidents or traffic problems related to his business.

A. Consider Petition 05-001-V, continued.
Board Member K. Keller questioned the Board Attorney regarding Skip's Bar-B-Que. He
explained that it had recently changed owners and that they are still using the parking spaces
located in the front of the building that back out onto SE 6th Street. Attorney Cook explained that
he wasn't aware of the proposed plan for Skip's Bar-B-Que, but would check with the City
Engineer regarding that situation.
John Whidden also mentioned that Kahootz had recently been sold, and they use parking spaces
that back out onto NW 7th Avenue.
Attorney Cook recommended the Board to table Petition 05-001-V so that he could further
investigate the request.
Board Member Maxwell requested that the duration of the commitment, as well as the location of
the spaces and their relation to the actual restaurant site be added to the shared parking agreement.
Board Member McCoy motioned to table Petition 05-001-V so that the Board Attorney could
further investigate the request; seconded by Board Member Jones.

B. Whidden Enterprises, Inc. John Whidden, owner of Whidden Enterprises, Inc., is
the property owner and applicant. The applicant is proposing to change an existing
1300 square foot pawn shop into a 48 seat restaurant. The applicant is planning to
utilize the same building with modifications to existing paved parking. The
applicant is requesting a twenty percent reduction to the parking space
requirements.

Oscar Bermudez, City Engineer, explained that this project has had a problem with parking since the
beginning and Mr. Whidden has been working with the City to resolve the problem. Mr. Whidden has come
before us to resolve the parking problem. He has received permission from Chris and Gail Newman to use
five parking spaces at their un -occupied commercial building located next door to the proposed restaurant.
There is no landscaping plan provided, however Mr. Bermudez recommended the applicant to place some
trees around the property line, and some shrubs in the front of the building.
LC Fortner, Okeechobee Utility Authority, explained that there is existing water and sewer at this location,
however, the applicant will need to install a grease trap.
Herb Smith, Fire Chief, questioned the amount of square footage of where the occupants will be seated, the
type of seating that will be provided, amount of exits, and whether a hood system will be installed.
John Whidden, applicant, explained that the occupants will be using approximately 800 square feet for
seating purposes. There will be fixed benches, two tables, and eight bar stools for seating. There will be
an entrance, an exit, and a kitchen delivery door. Mr. Whidden explained that a hood system will be installed
and there will be two to three fryers, an oven, and a grill all located under the hood system.
Jim LaRue, City Planning Consultant explained that a reduction of parking request usually requires a parking
study to be submitted. A landscape plan will also need to be provided. Mr. LaRue also questioned whether
the Newman's were using the five parking spaces that they are donating to the restaurant?
Mr. Whidden explained that he is proposing to use every available square foot for parking, there was no plan
to put landscaping within the parking lot. Mr. Whidden continued by explaining that the Newman's were not
using any of the five parking spaces at this time, so they will be used for his restaurant only.
Donnie Robertson, Public Works Director, explained that Mr. Whidden will be required to obtain a Use of
Alley Agreement to utilize the alley as ingress and egress to the parking lot. Mr. Robertson explained that
three parallel spaces were noted on -street, however only two will be permitted.

Jim LaRue explained that it will be hard to provide additional parking as you get more popular. Mr. LaRue
again noted the following concerns for the record: twenty percent reduction of parking granted by City
Council; parking study showing that the reduction can be supported; alley use agreement; on -street parallel
spots approved by Public Works Department; variance request approved to allow backing onto street;
landscaping plan provided; and developers agreement permitting shared parking.
John Whidden explained that the area has a lot of surrounding on -street parking within walking distance.
Herb Smith, Fire Chief, noted that this parking situation is better than the parking situation at Pizza Heaven.
Bill Veach explained that since one restaurant has a bad parking situation, why create another one? Mr.
Veach explained that this is a tough situation, and questioned Mr. LaRue whether the obstacles could be
overcome.
Jim LaRue explained that a landscape plan is possible to overcome. The code specifically allows for an
alternate landscape plan if the regular landscaping requirements are unable to be met.
John Whidden explained that some landscaping could be provided by the dumpster, by the fire hydrant, and
on the eastern side of the handicap parking space.
Jim LaRue explained to the applicant that the engineer has designed the best layout possible for this existing
location, however he is concerned with the impact that a restaurant will have at this location. Mr. LaRue
recommended to wait and see how the variance goes next week therefore not recommending approval for
the twenty percent parking reduction request at this time. During the next week or so work on obtaining a
use of alley agreement, obtain someone to do an altemate landscape plan, and work with Attorney Cook to
get a Developer's Agreement for the shared parking.
John Whidden questioned the amount of landscaping that would be required? He asked if potted plants
would qualify as landscaping?
Jim LaRue explained that a copy of the landscaping code would be provided to him, and that potted plants
were not considered to be part of the required landscaping.
