NOTICE OF REQUEST FOR VARIANCE
NOTICE is hereby given that the Board of Adju~ tments and Appeals
of the City of Okeechobee, Florida, a municipal cor poration, will
consider a request for a variance and to amend accc rdingly the Compre-
hensive Zoning Ordinance #402, the following deser' bed real property,
situate, lying and being within the corporate limit s of the City of
Okeechobee, Florida, to-wit:
Lot 2, Block 208, First Addition to Okeec hobee
(208 S.E. 3rd Street)
Granting the request for a variance would allow an addition to be built
on the existing home, on above described property. A public hearing
in relation thereto will be held at 7:00 P.M. in tr e 6th day of January,
1981, in the City Council Room, City Hall, Okeechot ee, Florida, at which
time all parties in interest and citizens shall ha\ e an opportunity to
be heard.

Chairman Burk reviewed parts of Ordinance It402 that ap lied to Non-ConfoI1Iling use,

Attorney Conlon noted after studying case law he fOW1d governing these cases.
COSTILLO - REQUEST FOR VARIANCE
Nicholas and Josephine Costillo, represented by Frank 'lbur appeared before the
Board to discuss the variance request, tabled at the January 6, 1981 meeting, to rebuild
a home on a lot 50' by 150' .
Chairman Burk pointed out this was not a Non-Confonr.ing use, but a Non-ConfoI1Iling
structure. After lengthy discussion Conlon noted with a non confoI1Iling structure, you
would not need a variance, but ~:)Uld need a building permit.
Member Kirk made a motion to refer the request to the b ilding official for granting
a building peI1Ilit, seconded by member Wright. Members Kirk, right and Burk voted yes,
Members Ferneau and Altobello absent, motion carried. Chai ßurk instructed the
secretary to notify t-I.r and Mrs Castillo to obtain a building peI1Ilit from the Building
Departmen t.
CONRAD - REQ1ÆST FOR VARIANCE
Tommy Walker appeared before the Board, representing Mr and Mrs Robert Conrad,
regarding the request for a variance, which was tabled at t January 6, 1981, meeting.
Chairman Burk noted this case was a non-confoI1Iling stru Attorney Conlon
asked the Conrads if they would bring anymore families in to dwelling. Nrs Conrad
stated no, they were the only family to live in the dwelling.
After discussion, the Board decided the Conrads did variance.
Member Wright made a motion to refer this case back to building official
for Mr. Walker to purchase a building peI1Ilit for Mr and Mrs nrad, seconded by member
Kirk, Members Wright and Kirk and Chairman Burk voted yes, me bers Ferneau and Altobello
were absent, motion carried.
MCALISTER - SPECIAL EXCEPTION
Mr. Westbrook infoI1Iled the Board the application for the special exception had been
withdrawn.
THOMPSON - SPECIAL EXCEPTION
Mr. C.B, Thompson appeared before the Board to ask for a special exception to build
an office and warehouses in a commercial zoned area. In orde to grant this request you
could not store flammable materials. Mr Thompson assured the ard he would not be storing
flammable materials in the warehouses.
According to Mr. l~mpson's plans, he also requested a 1 ' front set back instead
of the 20' as required by the schedule of District Regulation It was determined this
is a separate request for a variance, After lengthy discussi member Wright roved to
table the request W1til Ivlr. Thompson can present a corrected of plans, seconded by
member Kirk, members Kirk, Wright and Chairman Burk voted yes, members Ferneau and
Altobello absent, vote carried.
There being no further business for the Board of Adjus true ts and Appeals member
Wright moved to adjourn, seconded by member kirk, members Kir , Wright and Chairman
Burk voted yes, members Ferneau and Al tobello absent, vote ca ied.
