~LOGUE - REQUEST FOR VARIANCE
Richard Logue was present to request a 2.5 foot variance per lot for the following
property:
Lots 8 and 9, Block 178, City of Okeechobee
Granting this variance would enable Mr. Logue to build a duplex apartment which requires
100 foot frontage.
Attorney Conlon advised Mr. Logue and the Board "the jurisdiction of the Board of
Adjustments and Appeals is only to consider a variance to the terms of the existing master
plan of the Zoning Ordinance."
Conlon further stated "under the. set of requirements to qualify for a variance to a
term, a person has to demonstrate the property is of a unique character from all other
property that is so platted."
Conlon advised l'1r. Lo!'ue to approach the Council and request the Zoning Ordinance be
amended to require a 95 foot frontage rather than 100 feet.
Board felt the Ordinance gives them the power to erant such a variance, lengthy
discussion ensued.
Attorney Conlon reaffirmed the City Council's position being "unle~s an applicant
can prove having a unique characteristic, by the Board's limited variance powers, this is
beyond their jurisdiction."
Member Altobello felt the Board has the jurisdiction and voted to grant the variance,
noting the fact that the lots are 47.5 feet is unique in itself. Member Ferneau agreed
and added that this was creating a hardship for Mr. Logue. Property is zoned RG-2, only
the front footage requirement is inadequate.
~ember Altobello moved to re~ommend Council grant the variance requested, seconded by
Member Ferneau, vote unani~~~~.
ROOKS - REQUEST FOR VARIANCE
William 1. Rooks appeared, presented plans for a ten unit apartment complex and requested
a variance of approximately 810 square feet. Mr. Rooks noted the square footage is ample
for nine units, however, felt having to prepare different set of prints with one less
unit would probably make the project eCŒ10rr 'nfeasable.

NOTICE OF AN APPEAL FROM DECISION OF ZONING ADMINISTRATION
NOTICE is hereby given that the Board of Adjustments and Appeals
of the City of Okeechobee, Florida, a municipal corporation, will
consider an appeal from a denial of a building permit and to amend
accordingly the Comprehensive Zoning Ordinance #402, the following
described real property, situate, lying and being within the corporate
limits of the City of Okeechobee,. Florida, to-wit:
