Okeechobee, Florida, Oct. .3, 1933. I. The City Council of the City of Okeechobee, Florida, ~et in regular session at the City Hall at S.OO o'clock P. M. on the above date and the following were present: Alto Watford, President of City Council and Acting Mayor, Councilmen J. H. Walker, Sr., A. W. Brass and D. B. McCart~y with R. P. Fletcher, City Clerk, G. C. Durramce, City Attorney, L. L. Conrad, Chief of Police and L. C. Toot~e, Water Superintendent in attendance. President pro-tem. Walker presided over meeting. Minutes of August 25th, September 5th and September 19th were read and.adopted. Councilman Councilman McCarthy moved that Council elect a Councilman to succeed forme*/ 4IÞ Victor Domer, resigned, by ballot, motion seconded by Councilman Brass and passed. The vote was taken by ballot~ and was as follows: II J. D. Brett received three votes. President Watford did not vote. J. D. Brett was declared elected a member of the City Council of the City of Okeechobee, Florida, to serve the. unexpired term of former Councilman Victor Domer. J. D. Brett was sworn in åø City Councilmro1 by County Judge T. W. Conely, Jr. I Judge T. W. Conely, appeared before Council relative to payment of delinquent City taxes prior to year 1931 with bonds. The following resolution was offered by Councilman McCarthy who moved its adoption, motion seconded.by Councilman Brass and passed: RESOLUTION BE IT RESOLVED by the Mayor and City Oouncil of the City of ~keechobee, ,... Florida, that: . 1. Bonds, delinquent interest coupons, or other due or past due obligations of said City shall be receivable at par in the redemption of lands wi thln said mun- II icipali ty for all tax sales or unpaid taxes levied for the year 1931 and any and all prior years, PROVIDED HOWEVER that the taxes levied by the said City of Okee- 4IÞ chobee, Florida, under and by authority of the Circuit Court of the 21st Judicial Circuit in and for Okeechobee County, Florida, wherein the said Circuit Court commanded the said City to levy 13 mills in a mandamus suit therein pending, shall be pa~d in cash. 2. BE IT FURTHER RESOLVED that the Clerk of said City of Okeechobee, Florida, is hereby authorized and directed to cancel and satisfy all unpaid tax certificates or other evidence of tax lien upon the receipt and delivery by the delinquent tax- payer to the said Clerk of an equivalent amount of bonds, delinquent interest coupons or other due or past due obligations of said City of Okeechobee, which equivalent amount of bonds, delinquent interest coupons or other obligations as aforesaid, shall be received, accepted and held by the proper custodian in exchange of the c&1cellatlon , satisfaction or surrender of the tax certificates or other evidences of tax lien for Which the same was received and accepted, and such bonds, inter est coupons or other due or past due obligations of said City, for which the exdhange was made, shall thereafter be held and constitute an asset of the said municipality. 418 ., - .--.. ... - --- ---- .-..- - .- ---- --..--------"'--"-- - ---- ---- -------------------.--- ---------------------- 3..A complete record of all such bonds, lnterest coupons and other evidences of debt taken under this resolution shall be kept by the custodian hereinafter appointed by said City Council, and said bonds, intereßt coupons and other evidences of debt, so so taken and held, shall constitute an asset in trust thereof for the use and benefit of the 01ty of Okeechobee, Florida. 4. Be it further resolved that no bonds or other obligations of the said-City of Okeechobee, Florida, shall be accepted as herein provided, unless and until the taxes for the current year of 1932 shall have been paid in cash. 5. BE IT FURTHER RESOLVED that R. P. Fletcher is hereby designated as custodian of said bonds, interest coupons and other evidences of lndebtedness, who shall keep and hold the same for the account of the parties in interest. Council refused to permit payment of 1932 taxes with bonds. The following committee was appointed to arrange for a loan from the U.. S. Goverruaent to be used in making repairs to City streets, sewers and waterworks: D. B. McCarthy, G. C. Durrance, L. C. Tootle and R. P. Fletcher. Councilman McCarthy moved that Council call a Special Election to be held on November 7th, 1933 for the purpose of electin~ a Mayor of the City of Okeechobee to fill the unexpired term of former Mayor J. Denham Bird, resigned, motion seconded by Councilman Brass and passed. Upon motion duly seconded and passed Council adjourned to meet at 2 o~?loCk P. M. October 6th, 1933.
