Okeechobee, Florida, May 2nd, 1933.
The City Oow1ci1 of the City of Okeechobee, Florida, met in regular session II
at the City Hall at 8.00 o'clock P. M. on the above date and the following were
present: J. Denham Bird, Mayor, Alto Watford, President of City Oounci1, Oounci1men

J. H. Walker, Sr., Victor Domer, D. B. McOarthy and A. W. Brass with R. P. Fletcher,

City 01erk, G. O. Durrance, City Attorney and L. O. Tootle, Water Superintendent in
attendance.
Minutes of meetings held April 4th, April 13th, and April 21st were read and
approved.
Messrs. E. R. Wright and E. G. Arndt appeared before Oounci1 relative to
buildings located on Lot 12, Block E, Wright's Third Addition and Lot 9, Block 207, 4IÞ
and after discussing the matter with Oounci1, they agreed to repair their respactlve I
buildings satisfactory to the Oity Oounci1.

On motion of Councilman McUarthy, seconded by Oouncl1man Brass, Oounci1 instruot-
ed the City Attorney to interview Mr. H. G. Culbreth in regard to the operation of
his moving picture show on Sunday and report on same at next regular meeting of
Council.
Councilman McCarthy moved that Oi ty Tax Collector be authorized to allow Mrs.
R. H. Alderman exemption from all City taxes on Lots 2 and 3, Block 218, for the
following years: 1930, 1931 and 1932, motion seconded by Councilman Brass and passed.
On motion duly seconded and passed, CoID1c11 adjourned.

pursuant to call of Mayor Bird, the City Council of the City of Okeechobee, 4IÞ
Florida, met in spechal session at the City Hall at 4.00 o'clock P. M. on the

President of City Council, Councilmen Victor Domer, A. W. Brass and J. H. Walker, Sr.,
with R. P. Fletcher, City Clerk and G. C. Durrance,City Attorney in attendance.
Mayor Bird stated that meeting had been called for the purpose of considering
the passage of an ordinance ~egulating the' saJ.e~of malt and vinous beverages and
such other business as may come before the CoID1ci1.
Ordinance No. 142 was proposed by Counci1m~1 Walker, who moved its adoption, I
motlon seconded by Councilman Brass and passed.
ORDINANCE NO. 142
AN ORDINANCE REGULATING AND CONTROLLING THE MANUFACTURE, TRANSPORTATION AND
SALE OF MALT AND VINOUS BEVERAGES COMMONLY KNOWN AS BEER, PORTER, ALE, WINE OR FRUIT
JUICES AND SIMILAR BEVERAGES AS ARE NOT PROHIBITED BY THE LAWS OF THE STATE OF
FLORIDA; PRESCRIBING LICENSE FEES AND PROVIDING FOR THE COLLECTION THEREOF1

AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS
ORDINANCE.
II BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA.
SECTION L. No person, firm or corporation shall manufactuee, transport or sell,
or cause to be manufactured, transported or sold, or be concerned in the manufacture,
transportation or sale of any Malt or Vinous Beverages commonly known as Beer, Porter,
ale, Wine or Fruit Juices, containing more than one-half of one per centum of alcohol,
as are not prohibited by the laws of the State of Floriia, within the corporate
limits of the City of Okeechobee, Florida, without securing a license to conduct
such business.
SECTION 2. Application for llcense to engage in such a business as set out in
4IÞ Section One of this Ordinance, shall be made out and filed with the Clerk of the
I City of Okeechobee, Florida, Which said application shall state the character of b~
siness to be engaged in, whether as manufacturer, distributor, or vendor and whether
it is proposed to sell said beverage or beverages at Wholesale or retail, and said
application shall give the location where said business is to be conducted.
Upon receipt of such application the said Clerk shall cause the same to be
submitted to the City Council of Okeechobee, Florida, Whose duty it shall be to

determine the moral character of said applicant, and if the said applicant is found
to be of good moral character ~1d has complied with all of the provisions of this
Ordinance, a City License shall be issued to the said applicant, which said license
shall be procured from the Tax Collector of the said City and attested in the name
of the City Clerk and the Corporate Seal of said Oity impressed thereon by the said
City Clerk, Whose fee for attesting ~1d placing the seal' thereon shall be in the
sum of TWENTY-FIVE CENTS, to be paid by the person or persons, flrm or corporation
taking out said license.
I $CTION 3. Alllicenss fees ~~l be p~Mle on or before the First ~ of
January of each year, and no license shall be issued for any fractional part of a
4IÞ I year except ,as othervdse provided in this Ordinance; provided, however, that any
person, firm or corporation who shall be required to pay a license fee hereunder
. beginning business and applying for a license after the First day of July of any
year shall pay one-half of the license tax provided herein; provided, however,
Where said business was subject to license prior to July 1st, no fractional rate
shall be allowed.
SECTION~. No license issued under provision of this Ordinance shall be trans-
ferrable unless approved by said City Council.
I SECTION 5. No beverage or beverages as herein provided for shall be sold or
permitted to be sold, delivered, or otherwise be permitted to be delivered to any
person under the age of EIGHTEEN years.
SECTION 6. No beverage or beverages as herein provided for shall be manufactrured
Ͼ permitted to be manufactured, sold or permitted to be Bold within Five Hundred
feet of any School Building or within Three Hundred feet of any Church Building
within the City limits of Okeechobee, Florida.

SECTION 7. No person, association of persons, f~rm or corporation licensed
under the provisions of this Ordinance, shall place or caused to be placed a:n.d/or I
constructed any screen, blind, partition or any other object in the building where
such business is conducted, that will obstruct or tend to obstruct a plain view of
the interior of said premises.
SECTION 8. Licenses shall be issued only to citizens of the United states of
good moral character, who have not been convicted of any offense involving moral
turpi tude, and who are not less than twenty-one years of age and shall be issued
for a calendar year only except as otherwise provided herein. Licenses to corpor-
ations whose directors and officers are citizens of the United states and WQo have
not been convicted of any offense involving moral turpitude. There shall be no .
exemptions from the license taxes herein provided to any person, association 'of
persons or corporation, any other law to the contrary notwithstanding. I
SECTION 9. Licenses herein referred to shall be as follows:
(a) Each manufacturer authorized to do business under this Ordinance shall
pay a license fee of THREE HUNDRED SEVENTY-FIVE ($375.00) DOLLARS per annum for
each ma:n.ufacturing pla:n.t or establishment operated in said City; provided, however,
that manufacturers engaged exclusively in the production and processing og fruit
juices, shall pay a license fee of ONE HUNDRED TWENTY-FIVE ($125.00) DOLLARS per
annum.
(b) Each distributor or wholesale dealer authorized to do business únder this
Ofdinance shall pay a license fee of ONE HUNDRED ($100.00) DOLLARS per annum for
each ro1d every wholesale establlshment or branch which they may operate or conduct
in the City of Okeechobee, Florida.
(c) Each retail dealer shall pay an annual City License fee as follows:
RESTAURANTS AND EATING PLACES I
Accommo~ating less than 15 persons $10.00
Accommodating 15 to 49 persons 17.50
Accommodating 50 to 99 persons 37.50.
Accommodating 100 persons or more 50.00
HOTELS
Less than 30 ~ooms 10.00
30 rooms to 99 rooms 17.50
100 rooms to 299 rooms 37.50
300 rooms or more 50.00
Where a Hotel and restaurant or dining room are jointly operated, only one license
fee shall be paid, provided however,th~t said license fee shall be the highest
fee applicable in the premises.
All other persons not heretofore mentioned shall pay a license tax of SEVEN

SECTION 10. Said City Council shall have the power and the authority upon
sufficient cause appearing of the violation of any of the provisions of this
Ordinance, to cancel and/or revoke the license of any person, firm or corporation
herein licensed. Provided further that the City Council shall have the power and

the authority to revoke or cancel any license issued under the provisions of this
Ordinance, When said licensee permits his place of business to become unsanitary
II or when said licensee egages in or permits disorderly conduct on the premises where
said business is being conducted.
SECTION 11. Any person, association of person, firm or corporation, Who shall
viol-ate- any of the provi'sions of this Ordinance shall be punished by a fine not to
exceed ONE HUNDRED ($100.00) DOLLARS or sentenced to serve not more than NINETY (90)
DAYS in the City Jail of Okeechobee, Florida, or both in the discretion of the
Mayo r.
SECTION 12. All Ordinances in conflict with this Ordinance are hereby expressly
. repealed., - <
SECTION 13. If any of the provisions of this Ordinance be declared unconsti-
I tutional, the validY of the remainder of this Ordinance shall not be effected
thereby.
SECTION 14. This Ordinance shall go into effect upon its passage by the City
Council of Okeechobee, Florida, and approval by the Mayor thereof.

Councilman Brass moved that Oity offer a reward of $50.00 for evidence leading
. to the conviction of party or parties responsible for the destruction of shade
trees on the streets of Okeechobee, motion seconded by Councilman Walker and passed.
