LUCIE COUNTY, FL, AND PB 1, PG 10 AND PB 5 PG 5, PUBLIC RECORDS OF OKEECHOBEE COUNTY, FL, AS SUBMITTED IN ABANDONMENT OF R-O-W PETITION NO. 24-002-AC; PROVIDING FOR RESERVING UNTO THE CITY, ITS SUCCESSORS AND ASSIGNS A NON- EXCLUSIVE EASEMENT FOR PUBLIC UTILITIES PURPOSES; PROVIDING FOR DIRECTING THE CITY CLERK TO RECORD THE ORDINANCE IN THE PUBLIC RECORDS OF THE CLERK OF THE CIRCUIT COURT IN AND FOR OKEECHOBEE COUNTY, FL; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Okeechobee General Services Department received Abandonment of R-O-W Petition No. 24-002-AC submitted by the property owner Gilbert Culbreth, President of First Methodist Church of Okeechobee Inc., for the abandonment of a certain R-O-W as described in this Ordinance; and WHEREAS, Petition No. 24-002-AC was reviewed and discussed byCity the of Okeechobee Technical Review Committee at a duly advertised public meeting held on November 21, 2024, and based on the findings recommends approval to the Planning Board; and WHEREAS, Petition No. 24-002-AC was reviewed and discussed by the City of Okeechobee Planning Board at a duly advertised Public Hearing held on January 16, 2025, and it was determined that such Petition met the required findings, is consistent with the Comprehensive Plan, and recommends the City Council adopt the Petition; and WHEREAS, the City Council considered Petition No. 24-002-AC, the recommendations from the Technical Review Committee and Planning Board, and finds the Petition to be consistent with the Comprehensive Plan, the R-O-W is not the sole access to any property, abandonment is in the best interest of the citizens, provides a benefit to the City of Okeechobee; and WHEREAS, the granting of the Petition will serve a legitimate public interest and is a proper exercise of the municipal authority of the City of Okeechobee as a discretionary function. NOW, THEREFORE, it is ordained before the City Council for the City of Okeechobee, FL; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City: SECTION 1: RECITALS ADOPTED. Each of the above recitals is true and correct and incorporated herein by this reference. SECTION 2: The unimproved, dedicated R-O-W described hereafter and as shown on Exhibit A, is hereby closed, vacated, and abandoned by the City of Okeechobee, FL to-wit: THE ALLEYWAY BEING 15-FEET WIDE BY 300-FEET LONG LYING EAST TO WEST BETWEEN LOTS 1 THROUGH 6 AND LOTS 7 THROUGH 12 OF BLOCK 139, TOWN OF OKEECHOBEE, AS RECORDED IN PB 2, PG 17, PUBLIC RECORDS OF ST. LUCIE COUNTY, FL, AND PB 1, PG 10 AND PB 5, PG 5, PUBLIC RECORDS OF OKEECHOBEE COUNTY, FL. SECTION 3: The City of Okeechobee, FL hereby reserves unto itself, its successors and assigns, a perpetual, non-exclusive Easement as a special condition requested by the utility companies and provided in Petition No. 24-002-AC, to-wit: • All that portion of the Alleyway being 15-feet wide by 300-feet long lying East to West between Lots 1 through 6 and Lots 7 through 12 of Block 139, TOWN OF OKEECHOBEE, as recorded in PB 2, PG 17, Public Records of St. Lucie County, FL, and PB 1, PG 10 and PB 5, PG 5, Public Records of Okeechobee County, FL. Ordinance No. 1301, Page 1 of 3 SECTION 4: The City Clerk shall cause a certified copy of the Ordinance to be recorded in the public records of Okeechobee County, FL. • SECTION 5: CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6: SEVERABILITY. If any provision or portion of this Ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this ordinance shall remain in full force and effect. SECTION 7: EFFECTIVE DATE. This Ordinance shall be set for final Public Hearing the 4th day of March 2025, and shall take effect upon its adoption by the City Council and recorded in the public records of the Clerk of Circuit Court, Okeechobee County, FL. Staff Response: The City of Okeechobee Comprehensive Plan does not provide any standards or regulations regarding abandonment or vacation of rights-of-way. 2) Right-of-way to be vacated is not the sole access to any property, and the remaining access is not an easement. Vacating the right-of-way will transfer maintenance and liability responsibilities from the City to a private property owner,which benefits the City,allowing for public resources to be allocated elsewhere and incrementally increasing the tax base. 4) Proposed vacation would not jeopardize the location of any utility. Applicant Response:Yes,the proposed vacation will not jeopardize any utility. Staff Response:The provided survey indicates that no utilities or utility easements are currently located within the subject right-of-way. Furthermore, the applicant has obtained a signed petition including Florida Power & Light, Embarq d/b/a Century Link, Comcast Cable, Okeechobee Utility Authority, and Florida Public Utilities authorizing the vacation of the alley. Parking Reduction Application No. 24-001-PR, requests to reduce the number of required paved parking spaces for Haven of Rest Church located at 807 Southwest 2nd Street, on 10.24± unplatted acres. 1. City Planning Consultant Smith, briefly reviewed the Planning Staff Report recommending approval based on the following conditions being met; Applicant shall provide a minimum of 24 paved parking spaces that comply with the design standards of City Land Development Regulations (LDR) Section 90-511 ; Applicant shall provide the minimum number of and minimum dimensions for ADA parking spaces that comply with Florida Accessibility Code requirements; and the revised internal vehicle circulation driveways and accessways must receive approval from the Fire Chief. 2. Building Official Newell stated, the recommendation will be made part of the building permit final inspection and Certificate of Occupancy. OCFR Deputy Fire Marshal Sasser stated that the driveway coming in needs to be 20-feet wide and millings need to be stabilized for the fire equipment. Chairperson Ritter and Planner Smith commented, concrete should be directly used around the facility abutting the building with ADA spaces, and then the remainder can be asphalt millings or grass parking. 3. Mr. Tom Velie, Registered Agent on behalf of the Property, Haven of Rest g g Inc., was present and available for questions. He confirmed the entrance driveway is 24-feet wide, and that concrete will be in place along with millings on the front, East and West sides. 4. No public comments were offered. 5. Vacating the right-of-way will transfer maintenance and liability responsibilities from the City to a private property owner,which benefits the City,allowing for public resources to be allocated elsewhere and incrementally increasing the tax base. 4) Proposed vacation would not jeopardize the location of any utility. Applicant Response:Yes,the proposed vacation will not jeopardize any utility. Staff Response:The provided survey indicates that no utilities or utility easements are currently located within the subject right-of-way.
