Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to order on Tuesday December 10, 2024, at 6:02 P.M. in the City Council Chambers located at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance was led by Special Magistrate Azcona. II. AGENDA A. Requests for the addition, deferral, or withdrawal of agenda items. There were none. IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH A. Special Magistrate Azcona dispensed with the reading and approved the October 8, 2024, and the November 12, 2024, Minutes. B. This being a Quasi- Judicial proceeding , Special Magistrate Azcona collectively administered an Oath to Code Officers Smith, and Curl. V. NEW CASES A. Case No. 240927013; Sandi Magnolia Godinez-Roblero, 1010 Southwest 3rd Street, Violation of Code of Ordinances Chapter 90, Section 90-452 Swimming pool, Chapter 30, Sections 30-33 Owner to control excessive growths and unsanitary ponds and swimming pools, 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 1). AS- violation of Chapter 30, Section 30-33 Owner to control excessive growths and unsanitary ponds and swimming pools for having an above ground pool on the property filled with unsanitary or stagnant water that has not been drained or cleaned. Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for overgrown weeds, grass, bushes, and shrubs. Piles of trash, junk, and debris all over the property. Chapter 90, Section 90-452 Swimming pool for the pool not being properly enclosed by a wall, fence or other barrier safety enclosure of at least five feet high with doors and gates in the exterior enclosures with self-locking fasteners installed at least five feet above the ground level. The respondent is not a repeat violator. The respondent was first notified on September 16, 2024, via Courtesy Card. On September 24, 2024, Code Officer Curl inspected the property, still non-compliant, junk/debris remains all over the Page 1 of 8 V. NEW CASES CONTINUED A. Case No. 240927013; CONTINUED: property and piled by the side door. However, some progress had been made with the pool being drained and flat on the ground. Photos in the file. On September 27, 2024, SOV/NOH, photos and city ordinances mailed via USPS certified return receipt for the December 10, 2024, Hearing. The notice was received on October 7, 2024, signature not legible. On December 3, 2024, Code Officer Smith inspected the property; still non- compliant, over-grown vegetation: grass, weeds and shrubs need to be cut, and the debris needs to be picked up. Photos in file. To comply with city ordinances the respondent needs to cut the over-grown vegetation, remove the debris from the property, and remove or meet the requirements to maintain and have a pool on the property. The City recommends in accordance with the City's fine schedule a fine of $50.00 per day to begin on December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. Okay I will make a finding in this case of the City of Okeechobee vs. Sandi Magnolia Godinez-Roblero, Case No. 240927013; that the respondent was cited for violation of Chapter 30, Sections 30-33 Owner to control excessive growths and unsanitary ponds and swimming pools for an above ground pool on the property filled with unsanitary or stagnant water that has not been drained or cleaned, 30-43 Public nuisances, 30-44 General cleaning and beautification for overgrown weeds, grass, bushes, and shrubs. Piles of trash, junk, and debris all over the property, Chapter 90, Section 90-452 Swimming pool for a pool not properly enclosed by a wall, fence or other barrier safety enclosure of at least five feet high with doors and gates in the exterior enclosure with self-locking fasteners installed at least five feet above the ground level. Based on the testimony and the exhibits presented at this hearing by the certified Code Enforcement Officer Mr. Smith. I will make a finding that by examining the exhibits there is sufficient factual basis for the allegations in this case I do see from the photos what appears to be a lot of junk and debris all over the premises and I can also see that there is failure to maintain the brush and the weeds in this case they are substantially very tall as exhibited in these pictures. I will also make a finding that they were properly served in this case as the certified receipt was received as it was addressed to the owner. So, I will follow the city's recommendation in this case that the respondent be fined $50.00 per day beginning on December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. Thornton, Jr., 802 Northwest 10th Street, Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification, International Property Maintenance Code (IPMC) Chapter 1, Sections 111.1.1 Unsafe structure, 111.1.3 Structure unfit for human occupancy (Exhibit 2). AS- violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for having overgrown grass, weeds and trash thrown on the ground. IPMC Chapter 1 , Sections 111.1.1 Unsafe structure, 111.1.3 Structure unfit for human occupancy for personal affects outside of the shed giving the impression that someone was living in the shed. The respondent is not a repeat violator. The respondent was first notified on August 13, 2024, via Courtesy Card. On August 29, 2024, Code Officer Smith inspected the property; still non-compliant, overgrown grass &weeds, trash on the ground in front of the property. Photos in the file, SOV/NOH, copy of ordinance, and photos mailed via USPS certified return receipt for the October 8, 2024, Hearing. The notice was returned, unclaimed, unable to forward on September 24, 2024. On September 24, 2024, Code Officer Smith posted the City Hall and the property with the Notice to Appear for the October 8th Hearing. Photos in file. On October 1, 2024, Code Officer Smith inspected the property; still non-compliant, overgrown grass, weeds, and shrubs have not been cut, trash/debris in the yard, and gas cans randomly in the yard. Photos in file. On October 22, 2024, SOV/NOH mailed via USPS certified return receipt for the November 12, 2024, Hearing. Per USPS tracking they attempted to deliver the notice at 12:43 pm on October 25, 2024, and a notice was left because an authorized recipient was not available. If the item is unclaimed by November 9, 2024, it will be returned to the sender. The City Staff have not received the notice nor the signature receipt card back as of the date of this hearing. USPS tracking details placed in the file. October 23, 2024, Code Officer Smith posted the public notices board at City Hall and the property with a Notice to Appear for November 12th Hearing. Photos in file. On November 6, 2024, Code Officer Smith inspected the property; still non-compliant, trash/debris in the yard, and overgrown grass, weeds, and shrubs. Photos in file. On November 12, 2024, the case was presented to the Special Magistrate and as requested by Code Officer Smith; Special Magistrate Azcona deferred Case No. 240829006 to the next Special Magistrate Hearing. On November 14, 2024, SOV/NOH mailed via USPS certified return receipt for the December 10, 2024, Hearing. Per USPS tracking the notice was delivered to an individual at the address at 1:56 pm on November 18, 2024. The City Staff received the return receipt unsigned on November 21, 2024. On November 26, 2024, I, Code Officer Smith posted the public notices board at City Hall and the property with a Notice to Appear for the December 10th Hearing. Photos in file. On December 3, 2024, I, Code Officer Smith inspected the property; still non-compliant, trash/debris in the yard, and overgrown grass, weeds, and shrubs. Photos in file. On December 4, 2024, Officer Pitts gave Code Officer Smith an Investigation Narrative from the incident on August 6, 2024, stating that someone was living in the shed in the rear of the property. To comply with City ordinances the respondent needs to cut and maintain all overgrown vegetation and remove the person living in the shed in the rear of the property. The City recommends in accordance with the City's fine schedule a fine of $100.00 per day to begin on December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. RA- I am going to ask the City Attorney if there is anything you would like to add on behalf of the city, Mr. Hyden GH- yes just very briefly, Code Officer Smith who took the photographs that you have included in the file AS- I did sir Page 3 of 8 V. NEW CASES CONTINUED B. Case No. 240829006; CONTINUED: GH- in regard to the person living in the shed, you received a police narrative verifying that someone was living in the shed, correct? AS- that is correct GH- were there any other signs or reasons for you to believe that someone was living in that shed prior to you receiving a copy of the police narrative AS- yes, like I said early on in the testimony, there were personal belongings and stuff outside the shed, like chairs set up like someone would be sitting in the chairs. I couldn't really see it because it was very far tucked away. The Police Officer brought it to my attention that someone was living back there, so I made sure I got his statement GH- okay, nothing further, thank-you RA- Mr. Smith you took these photos AS- yes, I did RA- and all the dates and times attached to these photos represent the conditions of the premises at the time they were taken AS- that is correct RA- I will make a finding in this case of the City of Okeechobee vs. Joseph Berry Thornton, Jr., Case No. 240829006; the respondent was cited for violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for overgrown grass, weeds, and trash thrown on the ground, IPMC Chapter 1, Sections 111.1.1 Unsafe structure, 111.1.3 Structure unfit for human occupancy for having personal affects outside of the shed giving the impression that someone was living in the shed. Based on the testimony, allegations and exhibits presented at this hearing, I will find that there is sufficient factual basis for the allegations in this case and I will find that the respondents are in violation. I will also make a finding that the respondent was properly served with the posting of the notice of violation on their property. My examination of the photos I can see that there is a lot of overgrown grass and weeds, and I can see what appears to be debris and trash just sitting all over the premises, therefore the respondents are in violation, they are not repeat offender. I will follow the city's recommendation in this case pursuant to the city's fine schedule of a fine of $100.00 per day to begin on December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. Anything else in this case Mr. Smith. AS- no sir RA- okay next case C. Case No. 241120004; Kenneth C. Leitner, 303 Northwest 11th Avenue, Violation of Code of Ordinances Chapter 54, Section 54-41 Blocking or obstructing (Exhibit 3). AS- violation of Chapter 54, Section 54-41 Blocking or obstructing for blocking the alleyway with personal items such as boats and trailers, etc. Also tearing up the alley making it unpassable for city employees to go through. The respondent is not a repeat violator. The respondent was first notified on September 12, 2024, via Courtesy Card. On September 10, 2024, Code Officer Smith/Curl observed the above-mentioned property to be in violation of the City Ordinances Chapter 54, Sections 54-41 Blocking or Obstructing: blocking the alley way with personal items such as boat and trailers etc. Also tearing up the alley making it unpassable Photos in file. On September 12, 2024, Courtesy Card, photos, city ordinances and property overview mailed via USPS regular mail, giving the property owner 14 days to correct the violation. On October 1, 2024, Code Officer Smith inspected the property; still non-compliant, the alley remains blocked. Photos in file. On November 18, 2024, Code Officer Smith inspected the property; still non-compliant, the alley remains blocked. Photos in file. On November 21, 2024, SOV/NOH, copy of ordinance, and photos mailed via USPS certified return receipt for December 10, 2024, Page 4 of 8 V. NEW CASES CONTINUED C. Case No. 241120004; CONTINUED: Hearing. Per USPS tracking the notice was delivered to an individual at the address on November 25, 2024, at 2:11 pm. USPS tracking details placed in the file. The City Staff received the return receipt card back on December 2, 2024, signed by Jess L. On December 3, 2024, Code Officer Smith inspected the property, still non-compliant, the alley remains blocked. Photos in file. On December 4, 2024, Code Officer Smith inquired with the city clerk's office for any documentation of either an alleyway user agreement or if the city had abandoned the alleyway, no agreement nor abandonment documentation for the alleyway. Email in the file. To comply with city ordinance the respondent needs to remove all personal items from the alleyway. The City recommends in accordance with the City's fine schedule a fine of$50.00 per day to begin on December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. RA- I am going to ask the City Attorney if there is anything you would like to add on behalf of the city, Mr. Hyden GH- yes sir, thank-you. Code Officer Smith, did you take all the photos in the file AS- that is correct GH- and you did confirm with the City on December 4th that there is no alley use agreement nor there is no alley abandonment, correct? AS- that is correct GH- okay, nothing further RA- I will make a finding in this case of the City of Okeechobee vs. Kenneth C. Leitner Case No. 241120004; the respondent in this case was cited for violation of Chapter 54, Section 54-41 Blocking or obstructing for blocking the alleyway with personal items such as boats and trailers, etc. and also tearing up the alleyway making it unpassable. Based on the testimony of the certified Code Enforcement Officer and exhibits presented at this hearing I will find that there is sufficient factual basis for the allegations in this case. I can see that there are personal items blocking what appears to be an alleyway and therefore the respondents will be in violation. I will also make a finding that the respondent was properly served via certified mail and there is a signature, and it was addressed to the property owner Kenneth C. Leitner, with the correct address, so the respondents were properly served. I will follow the city's recommendation in this case pursuant to the city's fine schedule of a fine of $50.00 per day to begin December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. Anything else in this case Mr. Smith AS- no sir RA- okay next case D. Case No. 241120005; Juan M.A. and Lydia E. Almodovar, 1804 Northwest 7th Avenue, Violation of Code of Ordinances Chapter 30, Section 30-41 Disabled vehicles (Exhibit 4). AS- violation of Chapter 30, Section 30-41 Disabled vehicles for having three disabled vehicles in front of the property. The respondent is not a repeat violator. The respondent was first notified on September 17, 2024, via Courtesy Card. On November 18, 2024, Code Officer Smith inspected the property, still non-compliant, disabled vehicles remain in front of the property. Photo in file. On November 20, 2024, SOV/NOH, copy of ordinance, and photos mailed via USPS certified return receipt for December 10, 2024, Hearing. Per USPS tracking the notice was delivered to an individual at the address on November 25, 2024, at 3:03 pm. USPS tracking details are placed in the file. The City Staff received the signature receipt card back on December 2, 2024, signature not legible. On December 3, 2024, Code Officer Smith inspected the property, still non-compliant, disabled vehicles remain in front of the property. Photo in file. While doing the inspection Page 5 of 8 V. NEW CASES CONTINUED D. Case No. 241120005; CONTINUED: of the property the property owner came out and I advised her what needed to be done to bring the property into compliance. Also advised her when it needed to be completed. To comply with city ordinance the respondent needs to remove the disabled vehicles from the property. The City recommends in accordance with the City's fine schedule a fine of $50.00 per day to begin on December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. RA- I am going to ask the City Attorney if there is anything you would like to add on behalf of the city, Mr. Hyden GH- no sir RA- okay I will make a finding in this case of the City of Okeechobee vs. Juan M.A. and Lydia E. Almodovar Case No. 241120005; the respondent in this case was cited for violation of Chapter 30, Section 30-41 Disabled vehicles and it appears to be three disabled vehicles in front of the property. Based on the testimony and the exhibits presented at this hearing I find that there is sufficient factual basis for the allegations in this case, I can see the exhibits in here that are dated with what appears to be images of disabled vehicles that are parked on the property and some of them are partial cars, so obviously they are not operating. I will also make a finding that the respondent was properly served via certified mail and the return receipt, there is tracking and what appears to be a signed receipt that is addressed to the respondent at the correct address. I will follow the city's recommendation in this case pursuant to the city's fine schedule of a fine of $50.00 per day to begin December 11, 2024, until the property is brought into compliance, plus a $50.00 administrative fee. Anything else in this case Mr. Smith AS- no sir RA- okay next case VI. RELEASE OF LIENS A. Case No. 221221016; 130 Palm Beach Properties LLC do Betty Khan, Northwest 11th Street, Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30- 44 General cleaning and beautification (Exhibit 5). AS- violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for overgrown weeds, grass, bushes, shrubs, or trees. The respondent is not a repeat violator. On February 13, 2024, the case was presented to the Special Magistrate. The City recommended in accordance with Ordinance No. 1274 a fine reduction of 50 percent, plus a $50.00 administrative fee and a payment plan of$350.00 due on the 15th of each month until the lien balance of $4,200.00 is paid in full. Special Magistrate Azcona ruled to reduce the fine by 50 percent, plus a $50.00 administrative fee, and a payment plan of$350.00 a month due on the 15th of each month was granted. On October 15, 2024, Fine balance paid in full. On October 21, 2024, Release of Lien prepared for the mayor's signature. On October 22, 2024, Release of Lien recorded at the Okeechobee County Clerk of Court, File#2024011407, Page(s):1. Recorded Release of Lien mail via USPS regular mail. Case closed. The City recommends no action on this matter, but requests it be noted for the record that the fine totaling $4,200.00 was paid in full on October 15, 2024. The release of Lien was recorded on October 22, 2024, at the Okeechobee County Clerk of Court, File #2024011407, Page(s): 1. No further action on this matter. The case is closed. Case No. 221221016; CONTINUED: RA- I will make the finding for purposes of the record in the case of the City of Okeechobee vs. 130 Palm Beach Properties LLC c/o Betty Khan Case No. 221221016 that for the purposes of the record the total fines in this case totaling $4,200.00 was paid in full on October 15, 2024, and the Release of Lien was recorded after it was signed by the mayor on October 22, 2024 with the corresponding county clerk file number, and the case is closed. Anything else in this one Mr. Smith AS- no sir RA- okay next case VII. COMPLIED CASES A. Case No. 231025003; Timothy Lee Thomas, 809 Northeast 5th Street, Violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 6). AS- violation of Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances for having several disabled/untagged vehicles on the property, and the exterior of the home is in need of being cleaned. Chapter 30, Section 30-44, General cleaning and beautification for overgrown grass and weeds. The respondent is not a repeat violator. The respondent was first notified on October 10, 2023, via Courtesy Card. On October 24, 2023, I, Code Officer Smith, inspected the property: still non-compliant, none of the issues have been addressed. Photos in file. SOV/NOH, and photos mailed via USPS certified return receipt for the December 12, 2023, Hearing. The notice was received on November 6, 2023, and the signature was not legible. On October 25, 2023, Code Officer Smith spoke with the daughter of the homeowner, Lorrie Richards, she advised that her father had passed away 2 weeks ago, and she lived out of state in Ohio. She also advised that a company will be pressure washing the home next month and she would remove the vehicles as soon as the property is in her name. I advised her how much time before the hearing and for her to stay in contact with me to keep the office abreast of any changes. On December 6, 2023, Code Officer Smith inspected the property and found that the property is non-compliant. The disabled/ unregistered vehicles remain on the property however, the exterior of the home has been cleaned and the grass has been cut. Photos in file. On December 7, 2023, Code Officer Smith spoke with the property owner's daughter, and she advised that the outside of the home has been cleaned, and that she was trying to get the vehicles registered or moved but she lost her job, so things have become more difficult to handle. Advised her to keep in contact with the office. On December 11 , 2023, SOV/NOH mailed via USPS certified return receipt for the February 13, 2024, Hearing. The notice was delivered to an agent for final delivery on December 18, 2023, at 12:24 pm by USPS tracking detail. The signature is not legible. The USPS tracking detail was placed in the file. On December 12, 2023, Case presented to the Special Magistrate and deferred to a later hearing to allow the property owner an opportunity to be present at the hearing. On January 17, 2024, Code Officer Smith inspected the property; non-compliant, unregistered/inoperable vehicles remain on the property. Photos in file. On January 31, 2024, Code Officer Curl received a call from the daughter Lorrie Richards, she stated the property was in probate with Isaac Wiles Law Firm, Attorney Jessa Gary in Columbus, Ohio, contact #614-221-2121 and that she is in the process of getting appointed the executor of the estate in Ohio, then she will be able to file in FL and once she is appointed in FL she will be able to remove the vehicles from the property. I advised her that we would defer this case to a future date as she has complied with everything else and for her to keep in touch with us. On February 13, 2024, the case was presented to the Special Magistrate and was deferred to a future hearing to allow the probate case to be resolved. On October 4, 2024, Code Officer Curl received a Page 7 of 8 VII. COMPLIED CASES CONTINUED A. Case No. 231025003; CONTINUED: call from Lorrie Richards, stating that everything had been removed from the property. The home is in the process of being sold and would like the property to be inspected for compliance. On October 15, 2024, Code Officer Smith inspected the property; in compliance, the disabled/unregistered vehicles were removed from the property. Photos in file. Case closed. A Compliance letter was mailed out via USPS regular mail. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30- 44 General cleaning and beautification from October 10, 2023, until October 15, 2024, no lien/order recorded, no fine accrued. RA- I am going to ask the City Attorney if there is anything you would like to add on behalf of the city, Mr. Hyden GH- no sir RA- Mr. Smith, you took all these photos AS- that is correct RA- and the dates attached to them the accurately represent the conditions of the premises at the time they were taken AS- that is correct RA- I will make a finding in the case of the City of Okeechobee vs. Timothy Lee Thomas Case No. 231025003; the respondent was cited for violation of Chapter 30, Sections 30- 41 Disabled vehicles, 30-43 Public nuisances, for having several disabled/untagged vehicles on the property and the exterior of the home in need of being cleaned and Section 30-44 General cleaning and beautification for having overgrown grass, and weeds. The respondents are not repeat violators. I will make a finding based on the testimony and the exhibits presented by the certified Code Enforcement Officer Mr. Smith, that there is sufficient factual basis for the allegations in this case on examination of the exhibits I can see what looks like untagged vehicles and what looks like mold growing on the side of the home and even though they did eventually come into compliance they were in violation pursuant to the code up until they came into compliance on or about October 15, 2024. So, I will follow the city's recommendation in this case, and we will note for the record that the respondent was in violation of Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification from October 10, 2023, up until they came into compliance on October 15, 2024. I would also like to state that the homeowner was properly notified and was given plenty of opportunity and they did speak with the code enforcement and were supplied with a SOV/NOH via certified mail, it was addressed to the correct address, and someone did receive it, and they did come into compliance. That will be on the record. Anything else on this one Mr. Smith AS- no sir RA- anything else for the purposes of code enforcement for the City of Okeechobee AS- that is it for today sir VIII.
