This email is to officially advise you that the Board of Adjustment at its regular meeting on August 15, 2024, approved Special Exception Petition No. 24-004-SE which requests to allow outdoor sales and storage, building trades contractor, in a Heavy Commercial Zoning District, (Ref. 90-283(5)), located at 1005 SW Park Street for the proposed use of a Well Service business, outdoor storage of equipment and trenchers, including overnight parking, with the following conditions: Screening on the entire perimeter of the fence and to provide landscaping where necessary. There are two important timelines you need to be aware of regarding Special Exceptions. Per Sec. 70-348(4) of the City Land Development Regulations, Special Exception use; variance. Special Exception use and variance approvals shall have a valid period of not more than two years, prior to which a building permit application must be submitted or the approval shall lapse. Per Sec. 70- 373(f), Nonuse. If the special exception use granted by the board of adjustment should fail to exist or fail to be used for a continuous period of 180 days, then such use shall lapse and the current owner be required to reapply as provided in this division. In case of hardship, where the loss of such special exception would materially affect the integrity of any mortgage or other financing arrangement on the subject real property, the board of adjustment may consider such hardship in granting a renewal of such special exception. Staff is not aware that any special exception was ever granted for that operation.The property was sold to the applicant in 2023, who operates a well service and plans to store equipment and materials on site. No site improvements are proposed at this time. Consistency with LDC Section 70-37_ City LDC Section 70-373(b) requires that applicants for special exception requests must address the following standards. The applicant has submitted responses to each standard, which are provided un- edited below. Staff comments are also provided in response to the standards and the applicant's responses. (1) Demonstrate that the proposed location and site is appropriate for the use. Applicant Response:The property is a whole city block,fenced with chain link, + has a lean to also. It also has a great area to store our pipe. Staff Comments:The property has historically been used for outdoor storage for many years. (2) Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood, or explain why no specific design efforts are needed. Applicant Response: There is an office bid - connected to a big warehouse will be great for our supplies also. Staff Comments: The applicant is not proposing any new buildings or any site improvements at this time. (3) Demonstrate any landscaping techniques to visually screen the use from adjacent uses. Applicant Response: There is very little landscaping+ Sod. Staff Comments: Ideally, the site would provide landscape buffering and/or some type of screening in conformance with current code. However, the site meets the definition of an existing nonconforming structure, and no expansions/improvements are proposed and the existing nonconformities will not be increased. Nearly the entire site is paved,though there are pervious areas where additional landscaping could be provided fronting SR-70 and SW11th Ave, as well as an isolated pervious area in the southeast corner of the site. (4) Demonstrate what is proposed to reduce the impact of any potential hazards, problems or public nuisance generated by the use. Applicant Response: We believe there will be very little impact, several trucks will leave every day + come back in at the end of the day. (5) Demonstrate how the utilities and other service requirements of the use can be met. Applicant Response: We need Elec for office+shops+water for bathrooms. Staff Comments: The site has existing service connections and no increase in intensity is proposed which would cause an increased demand for services. (6) Demonstrate how the impact of traffic generated will be handled, off site and on site. Applicant Response: We will enter+exit out the back, customer will enter from front. Staff Comments:The applicant is not proposing any changes to access points and is not likely to generate significantly more vehicle trips than the previous operator of the site. City LDC Section 70-373(c) provides a list of findings that the Board of Adjustment must address in its determination to approve the request, deny the request, or approve the request with conditions. The applicant has submitted responses to each finding, which are provided un-edited below. Staff comments are also provided in response to the findings and the applicant's responses. (1) The use is not contrary to comprehensive plan requirements. Applicant Response: pp po se No it is not. Staff Comments: The Okeechobee Comprehensive Plan does not contain any policies which prohibit the requested use. (2) The use is specifically authorized as a special exception use in the zoning district. Applicant Response: Yes—outside storage. Staff Comments: The use is authorized as a special exception use in the CHV district, as stated in LDC Section 90-283(5) The use will not have an adverse effect on the pu blic is interest. (3) Applicant Response: No, it shouldn't. Staff Comments: Staff Comments: The property has operated with outdoor storage previously and it is not expected that re-establishment of the use will create any new disturbance or adverse effects on the public interest. (4) The use is appropriate for the location proposed, is reasonably compatible with adjacent uses, and is not detrimental to urbanizing land use patterns. Applicant Response: It the perfect place. Staff Comments: The site provides convenient access to SR-70 for the service vehicles and is consistent with historical use of the property. CITY OF OKEECHOBEE 3 MORRIS DEPEW Special Exception August 6, 2024 Staff Report Petition No. 24-004-SE (5) The use will not adversely affect property values or living conditions, nor be a deterrent to the improvement or development of adjacent property. Applicant Response: Absolutely not. Staff Comments: Re-establishment of this use in this location should not adversely affect property values in this area of the City which contains existing heavy commercial uses. (6) The use may be required to be screened from surrounding uses, to reduce the impact of any nuisance or hazard to adjacent uses. Applicant Response:This will not be any problem. Staff Comments: The Board may consider whether additional buffering/screening is an appropriate condition to place on the approval of this special exception request to ensure compatibility. (7) The use will not create a density pattern that would overburden public facilities such as schools, streets, and utility services. Applicant Response: No It will not. Staff Comments:The proposed use will not include a residential component therefore,no direct effects on density patterns or demand for public-school facilities is expected. (8) The use will not create traffic congestion,flooding or drainage problems,or otherwise affect public safety. Applicant Response: No It will not. Staff Comments:The applicant is not proposing to use the property in a substantially different manner than the previous owner and no improvements to the site are proposed at this time. Staff is not aware of any public safety issues caused by outdoor storage at this site. Recommendation Based on the materials and statements provided by the applicant and the foregoing analysis, we recommend approval of this special exception request to re-establish outdoor storage at the subject property.
