ORDINANCE NO. 1296 • AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF OKEECHOBEE BY REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN, FROM RESIDENTIAL MULTIPLE FAMILY (RMF) TO HEAVY COMMERCIAL (CHV); PETITION NO. 24-001-R; AMENDING THE ZONING MAP ACCORDINGLY; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance No. 402 in which a revised Official Zoning Map was adopted for said City; and WHEREAS, applicant Chris Ossa, PE of Kimley-Horn and Associates, Inc., has heretofore filed Petition No. 24-001-R, on behalf of the property owner, Be A Man Buy Land, LLC., pursuant to the Land Development Regulations of the City of Okeechobee for the purpose of rezoning a certain tract of land consisting of 0.51 acres from RMF to CHV; and WHEREAS, said Petition was reviewed by the City's Planning Consultant who determined, based on initial findings and review, that such petition is consistent with the Comprehensive Plan; and WHEREAS, said Petition being reviewed by the City's Planning Board at a duly advertised Public Hearing held on September 19, 2024, determined that such Petition is consistent with the Comprehensive Plan; and WHEREAS, the City Council agreed with the recommendation of the Planning Board and hereby finds such Rezoning Petition No.24-001-R to be consistent with the City's Comprehensive Plan and deems it in the best interest of the inhabitants of said City to amend aforesaid revised Zoning Map as hereinafter set forth. NOW, THEREFORE, be it ordained before the City Council of the City of Okeechobee, Florida; presented at a duly advertised public meeting;and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City; that: SECTION 1: RECITALS ADOPTED. Each of the above stated recitals is true and correct and incorporated herein by this reference SECTION 2: LEGAL DESCRIPTION. The following described land consisting of approximately 0.51 acres, as the Subject Property, located in the City of Okeechobee, to-wit: LOTS 4 AND 5 OF TAYLOR CREEK MANOR, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 3, PAGE 4, OF THE PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA. TOGETHER with all the tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining. SECTION 3: ZONING MAP AMENDMENT. That the aforesaid Revised Zoning Map of the City of Okeechobee be amended to reflect the subject property to be changed from RMF to CHV. SECTION 4: CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: SEVERABILITY. Staff can utilize the recommendations provided by Airstron Mechanical as the specificationslscope of work or hire a mechanical contractor to provide specifications that would be rebid. I. The motion was to waive the formal bidding procedures in the Code of Ordinances Section 2-284 and award a quote to Bartow Ford for the purchase of a 2026 Ford F-750,full size dump truck in the amount of $94,000.00, as presented in Exhibit 14. It was the majority consensus of the Council to reject awarding the quote since the local vendors were not able to submit within the timeline.The matter will need to be represented with quotes from three companies for the same vehicle. MAYOR WATFORD CLOSED THE PUBLIC HEARING AT 6:46 P.M. VII. NEW BUSINESS A. As required by the Interlocal Agreement for Fire Services, County Fire Rescue Chief Wooten provided an update of Fire Services within City Limits[a four page handout was distributed at the meeting, labeled Exhibit 20, and added to the Minute file]. Page one included the number and Types of Calls for Service totaling 1,598, Average Response Time of four minutes and 38 seconds, Citizen Complaints, and Fire Prevention Activities between October 1, 2023, and September 30, 2024. Page two gave the breakdown of 9-1-1 Dispatch Codes for Fire and Emergency Medical Services(EMS). Page three provided a detailed breakdown for the 18 Fire incidents. Page four contained a graph Analysis by Detailed Incident Type. Chief Wooten responded to questions. The Council thanked him for the update. B. Mrs. Courtney Moyett, Project Director for Tobacco Free Partnership of Okeechobee County, presented the City with 50 Non-Smoking signs to be posted in the parks. Council Member McAuley noted the image on the sign included tobacco products that are not smoked or vaped, and those items were specifically excluded in Ordinance No. 1291; which states, "No person shall vape, smoke cigarettes, or smoke other tobacco products, except unfiltered cigars, within the public parks of the town." Staff will need to resolve the issue and add wording "per City Ordinance No. 1291" to the signs. There is a coordinating Rezoning Petition No.24-001-R,that will be considered on tonight's agenda, New Business item "A," Should the Council approve this FLUM change to C, the most appropriate type of zoning would need to be considered. The decision on this item and the Rezoning Petition hinges on whether the applicant will move forward with Special Exception Petition No. 24-005- SE, to be heard by the Board of Adjustment to allow a drive-thru service in a Heavy Commercial Zoning District (CHV) for the subject property together with Lots 1 through 3, located at 100 SE 8th AVE. The applicant initially submitted Special Exception Petition No. 24-003-SE for only Lots 1 through 3. It was withdrawn based on the Board of Adjustment feedback. In order to include Lots 4 and 5 in Petition No. 24-005-SE, the change to the FLUM and Rezoning were required. A real estate transaction is pending for Lots 1 through 5, to construct a 7 Brew Drive-Thru Coffee Shop. There were no comments from the public. Ms. Tijerina advised OCEDC undertook 13 new projects and assisted four privately owned Industrial Parks. They hosted a Grand Opening for Slim Chickens, bringing 60 new jobs to Okeechobee, and a New Business Blitz Day which was attended by 13 local business owners. OCEDC completed a Lodging Study by partnering with the City and Central FL Regional Planning Council, There are 26 projects still active. The scope of these projects includes housing, aviation, industrial, manufacturing, commercial, and agriculture; with an estimated capital investment of$139,000,000.00 and 470 new jobs. OCEDC started a Business Retention and Expansion Program (BREP) which is a complimentary resource connecting local companies with solutions to sustain and accelerate their operations and growth. BREP's main goals are to aid with issues which could force a company to fail and close, prevent companies from relocatingto a new community, and to assist existingindustries to grow their business P Y and add jobs. The BREP offers workforce development programs for the local youth. These programs include: the Okeechobee High School's Career and Technology Education program which allows students to attain future career knowledge while earninghigh school credits; courses range from 911 Dispatch, Fire and 9 9 9 Emergency Services, and Nursing. The Okeechobee Junior Leaders Summer Camp is a weeklong program built around introducing soft skills and leadership initiative into our future workforce as early as possible.Students are hosted,daily, by local businesses while also completing group projects with fellow campers. On the last day, each group presents their"new business" project and a graduation. OCEDC partners with the Education Foundation of Okeechobee and Children's Services Council of Okeechobee County to provide a$24,000.00 grant which aided in the stipend received by the students. Two students from last summer's camp even launched their own online business ForeverFlowers863, which is a floral bouquets company. Then, the Touch a Truck program provides an early career exploration event open to the community. Y A Re-Entry Job Fair was held at the Indian River State College Okeechobee Campus, which was co- hosted by CareerSource Heartland and the FL Department of Corrections, with more than 13 employers in attendance. Ms. Tijerina closed by stating these programs and events are only possible due to the support from the community and local businesses, and thanked the City for their yearly participation. C. The Fire Services update was withdrawn as Fire Chief Wooten was unable to attend. D. Mr. John Hayford, Executive Director for Okeechobee Utility Authority (OUA), gave a projects update, noting many of them are the same as the last. Pine Ridge Park is almost complete,the SW section/Eagle Bay Drive sewer extension is estimated to be completed by the Spring of 2025, and the OUA is applying for $2,500,000.00 in grants to help offset the costs for SW 5th AVE sewer extension, which is a $7,500,000,00 project. They are currently working with the Army Corp of Engineers on the extension to Okee-Tantie with the hope of also closing out the project in the Spring of 2025. The Taylor Creek Isles project, connecting 15 homes to the OUA service, is set to be completed in November. Treasure Island is a larger project, broken into three sections, with construction set to begin early next year. The OUA is expanding their service within the King's Bay subdivision.
