WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance No. 402 in which a revised Official Zoning Map was adopted for said City; and WHEREAS, applicant Chris Ossa, PE of Kimley-Horn and Associates, Inc., has heretofore filed Petition No. 24-001-R, on behalf of the property owner, Be A Man Buy Land, LLC., pursuant to the Land Development Regulations of the City of Okeechobee for the purpose of rezoning a certain tract of land consisting of 0.51 acres from RMF to CHV; and WHEREAS, said Petition was reviewed by the City's Planning Consultant who determined, based on initial findings and review, that such petition is consistent with the Comprehensive Plan: and WHEREAS, said Petition being reviewed by the City's Planning Board at a duly advertised Public Hearing held on September 19, 2024, determined that such Petition is consistent with the Comprehensive Plan; and WHEREAS, the City Council agreed with the recommendation of the Planning Board and hereby finds such Rezoning Petition No. 24-001-R to be consistent with the City's Comprehensive Plan and deems it in the best interest of the inhabitants of said City to amend aforesaid revised Zoning Map as hereinafter set forth. NOW, THEREFORE, be it ordained before the City Council of the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City; that: SECTION 1: RECITALS ADOPTED. Each of the above stated recitals is true and correct and incorporated herein by this reference SECTION 2: LEGAL DESCRIPTION. The following described land consisting of approximately 0.51 acres, as the Subject Property, located in the City of Okeechobee, to-wit: LOTS 4 AND 5 OF TAYLOR CREEK MANOR, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 3, PAGE 4. OF THE PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA. TOGETHER with all the tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining. SECTION 3: ZONING MAP AMENDMENT. That the aforesaid Revised Zoning Map of the City of Okeechobee be amended to reflect the subject property to be changed from RMF to CHV. SECTION 4: CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: SEVERABILITY. If any provision or portion of this ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this ordinance shall remain in full force and effect. If the Application No. 24-001-SSA is timely challenged, this Ordinance shall become effective on the date the State Land Planning Agency, or the Administration Commission enters a Final Order determining the Zoning Map Amendment to be in compliance. II. ATTENDANCE Roll was taken by Board Secretary Patty Burnette. Chairperson Dawn Hoover, Board Members Phil Baughman, Carl Berlin, Jr., Karyne Brass, Mac Jonassaint, and Alternate Board Member Dora Roberts were present. CHAIRPERSON HOOVER OPENED THE PUBLIC HEARING AT 6:04 P.M. A. Comprehensive Plan Small Scale Future Land Use Map (FLUM) Amendment Application No. 24-001-SSA, to reclassify from Single-Family Residential (SFR) to Commercial (C) on 0.534± acres located at 102 SE 8th Ave, Lots 4 and 5, TAYLOR CREEK MANOR, Plat Book 3, Page 4, Okeechobee County Public Records. 1. City Planning Consultant Ben Smith with Morris-Depew Associates, Inc. briefly reviewed the Planning Staff Report finding the requested C FLUM designation for the subject property consistent with the City's Comprehensive Plan, reasonably compatible with adjacent uses, and consistent with the surrounding pattern of land use, therefore recommending approval. 2. Mr. Chris Ossa, PE for Kimley-Horn and Associates, LLC, was present and available for questions. There were none. 3. No public comments were offered. For the record, 16 surrounding property owner notices were mailed, advertisements and one sign were posted on the subject parcel, with no objections or comments received to date. 4. No Ex-Parte disclosures were offered. 5. Rezoning Petition No. 24-001-R, requests to rezone 0.534± acres from Residential Multiple Family (RMF) to Heavy Commercial (CHV), located at 102 SE 8th Ave. The proposed use is to develop the property into a new 7-Brew Drive-Thru Coffee Shop. 1. The request involves a parcel that is approximately 0.534 acres with frontage on SE 8'Avenue. The applicant has also submitted a concurrent application to Amendment to the Future Land Use Map of the City's Comprehensive Plan (24-001-SSA) to change the future land use designation of the subject parcel from Single-Family Residential to Commercial and a Special Exception application (24-003-SE)for a proposed 7 Brew drive through coffee shop. The applicant intends to redevelop the property, along with the adjoining property to the north, with a 535 square foot building, a 130 square foot cooler, two CITY OF OKEECHOBEE 1 MORRIS DEPEW • • Rezoning Request 09/10/2024 Staff Report Petition No. 24-001-R dedicated drive-through lanes, one pass through lane, and 8 parking spaces. If this rezoning is approved, the property may be developed according to standards of the Comprehensive Plan and the Land Development Code,specifically those that pertain to the CHV district. Consistency with LDC Section 70-340 City LDC Section 70-340 requires that applicants for rezoning requests must address the following standards.The applicant has submitted responses to each standard,which are provided un-edited below. Staff comments are also provided in response to the standards and the applicant's responses. 1) The request is not contrary to comprehensive plan requirements Applicant Response: The proposed rezoning is not contrary to the Comprehensive Plan requirements. A Comprehensive Plan Future Land Use (FLU) Amendment will be included with this rezoning application to change the existing FLU to Commercial. The proposed FLU amendment will allow for the proposed zoning and FLU to be consistent with the proposed use and existing zoning and FLU of the surrounding areas. Staff Response: The subject property is located within the SR-70 Commercial Corridor. The requested Heavy Commercial zoning designation is consistent with the uses to the north, east, and west, which are also zoned Heavy Commercial. If the applicant's concurrent comprehensive plan amendment request to change the Future Land Use from Single Family Residential to Commercial is approved,then staff finds that the requested zoning designation will be consistent with the Comprehensive Plan. 2) The use is specifically authorized under the zoning district regulations applied for. Applicant Response: The proposed coffee shop with drive through use is a permitted use under the proposed change to Heavy Commercial zoning district after the approval of a Special Exception.The proposed use is also consistent within the commercial SR 70 corridor uses. Staff Response:Per Section 90-282(3)of the LDC,restaurants,take-out restaurants,and cafes are all allowed uses within the Heavy Commercial zoning designation and drive through service is allowed as a special exception use. If the applicant's special exception application is approved, staff finds that the requested use is consistent with the City of Okeechobee Land Development Code. 3) Approval of the request will not have an adverse effect on the public interest Applicant Response:The proposed use will not have an adverse effect on the public interest. The project proposes to redevelop existing parcels to incorporate a new 7 Brew drive through coffee location. Staff Response: The proposed zoning change from Residential Multiple-Family to Heavy Commercial would allow for uses that are more consistent with the predominant commercial land use pattern found along SR 70 and for the development of additional consumer options. 4) The use is appropriate for the location proposed, is reasonably compatible with adjacent uses, and is not contrary or detrimental to urbanizing land use patterns Applicant Response:The proposed use is appropriate within the location proposed and is reasonably compatible with the adjacent land uses. The subject parcel falls within the SR 70 CITY OF OKEECHOBEE 2 MORRIS DEPEW • • Rezoning Request 09/10/2024 Staff Report Petition No. 24-001-R commercial corridor and is adjacent to commercial business parcels to the north,east,and west. With the proposed use located within an existing urban/commercial area there are no concerns of urbanizing this already urban area of the City. Staff Response: Surrounding uses include restaurants, office, a shopping center, and other commercial uses. Additionally, the subject property is located within the SR 70 commercial corridor, in which the City has historically encouraged the development of commercial uses. Staff finds that the requested usage is compatible with proximate uses and consistent with the established surrounding land use pattern. 5) Approval of the request will not adversely affect property values or living conditions,nor be a deterrent to the improvement or development of adjacent properties Applicant Response: The proposed use is not anticipated to adversely affect property values or living conditions or be a deterrent to improvement or development of adjacent property. Staff Response: Allowing for the highest and best use of this property to be realized through commercial development should positively impact property values and living conditions and may encourage improvement of adjacent properties. 6) The use can be suitable buffered from surrounding uses,so as to reduce the impact of any nuisance or hazard to the neighborhood Applicant Response:The proposed use is or will be suitably buffered from surrounding uses, so as to reduce the impact of any nuisance or hazard to the neighborhood to the south. Screening measures along the southern boundary with the multi-family parcel as per City requirements is proposed. The subject parcel is adjacent to Taylor Creek to the west, SE 8th Avenue ROW to the east, and FDOT SR 70 to the north. Staff Response:The subject property is large enough that adequate space for any required buffers is available. Once a site plan is proposed, it will be reviewed by staff and the City's Technical Review Committee for compliance with all applicable landscaping and buffering requirements. 7) Approval of the request will not create a density pattern that would overburden public facilities such as schools, streets, and utility services Applicant Response: The proposed use will not create a density pattern that would overburden public facilities such as schools due to this being a commercial use, due to the incorporation of the subject parcel to the project which allows for the single driveway into the development to be shifted further south away from the SR 70 and SE 8th Avenue intersection and utility services due to the proposed use combining 2 commercial buildings and one residential property into a single commercial building and use. Staff Response: The proposed commercial use will not affect density patterns, and it is not expected that any commercial use of this property will overburden public facilities. 8) Approval of the request will not create traffic congestion,flooding or drainage problems, or otherwise affect public safety Applicant Response: The proposed use does not have a potential of creating additional traffic congestion,due to the proposed layout of the site which mitigates customers from blocking SE 8th Avenue once they enter the drive through use. Flooding and/or drainage engineering design is to follow City and South Florida Water Management District requirements which are catered to provide designs that will not adversely affect the public safety. Staff Response: The applicant provided a Traffic Impact Study for this rezoning application and the associated Small Scale Comprehensive Plan Amendment(24-001-SSA)that was completed by Kimley-Horn and Associates. All calculations and references are included as they appear on the TIS. Staff agrees with this analysis of the TIS that there is adequate roadway capacity to support the traffic volume that the proposed amendment could create. 9) The use has not been inordinately burdened by unnecessary restrictions Applicant Response:The proposed use has not been inordinately burdened by unnecessary restrictions. Recommendation Based on the materials provided by the applicant and the above analysis, if the City approves the associated comprehensive plan amendment request for Commercial future land use, we find that this request to rezone the subject parcel from RMF to CHV is consistent with the City's Comprehensive Plan, reasonably compatible with adjacent uses, and is consistent with the surrounding pattern of land use.
