Special Magistrate Hearing had to be cancelled.

August 6, 2024 Code Officers Smith inspected the property; still non-compliant, the overgrown
vegetation remains uncut and piles of trash/debris on the property. Photos in file.
• To comply with City ordinances the property owner needs to cut all the overgrown
vegetation and remove the trash and debris from the property.
City Recommendation:
The City recommends in accordance with the City's fine schedule a fine of $50.00 per day to
begin on August 13, 2024, until the property is brought into compliance, plus a $50.00
administration fee.

Complaint was emailed from County Code Enforcement that was made by Cassidy
Hernadez of 802 NW 11th St Okeechobee FL, 34972. Complaint that someone was living in
a tent on the vacant lot, throwing garbage and disposing of waste on the property.
Code Officer Smith/Curl observed the above-mentioned property to be in violation of the
City Ordinances Chapter 30, Sections 30-43 Public nuisances, and 30-44 General cleaning
and beautification: overgrown grass, weeds, trees, shrubs/bushes, garbage thrown in the
shrubs/bushes and evidence of a man living on the property in a tent. Code Officer Smith
made contact with the man staying on the property and he advised me that the property
owner was his friend and aware that he was there. He also denied that he was living on the
property. Photos in file.
May 10, 2024 Courtesy Card, photos, and city ordinances mailed via USPS regular mail, giving the property
owner 14 days to correct the violation
June 18, 2024 Code Officer Smith inspected the property; still non-compliant,the vegetation remains uncut and
piles of trash/debris on the property. The man staying in the tent has moved on. Photos in file.
SOV/NOH, copy of ordinance, and photos mailed via USPS certified return receipt for the July
9, 2024, Hearing. Returned, insufficient address, unable to forward on July 15, 2024.
June 25, 2024 Code Officer Smith posted the property and the public notices board at City Hall with the Notice

July 3, 2024 Code Officer Smith inspected the property; still non-compliant, the overgrown vegetation

On the corner of nw 8th ave and nw 12th st there is an empty field.This field has a few trees and a concrete base.

Someone has been living in a tent in this field behind my house for 5 days now.
This person has harassed me and cause trouble. Not only does he sleep there,there is constantly throwing garbage in the
field,lighting fires,and seems to have established this as a living quarter for him. I've witnessed this man using the
bathroom in the middle of this field. Why should I have to see that from my yard?
If applicable,how or why is this possible code enforcement violation an imminent threat to public health,safety or
welfare or the imminent destruction of habitat or sensitive resources?
Explain how or why possible code enforcement violation is an imminent threat.
I believe the violation is a homeless man Pitching tent in a field,Also littering I believe is a violation. I would assume his fires
could be a threat to the safety of the people around him.And really if he's using the bathroom in the middle of a field,

We're down the street from a school. What if a kid was walking home and seen this.The busses pass by this field constantly.
I don't know if pooping in a field is a violation,but it feels like it should be.

Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes,and the Code of Ordinances of City of
Okeechobee, I(hereinafter the"City of Okeechobee),the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code,as more particularly described herein,and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

Inspector to verify compliance,with the Okeechobee City Code Section(s)cited herein,you are hereby called upon to take
notice that a Hearing will be held in this cause before the City of Okeechobee Code Enforcement Magistrate on the 9th
day July, 2024 at 6:00 P.M.,located at 55 SE 3rd Ave Okeechobee City Hall,Okeechobee Florida 34974 in
Council Chambers.The Magistrate will receive testimony and evidence at said Hearing and shall make findings of fact and
conclusions of law as are supported by the evidence and testimony,and shall make an order thereupon.You are entitled to be
represented by counsel,present evidence,and present testimony.Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department.If you fail to appear at the hearing the
Magistrate may enter an Order of Violation,&impose a fine in your absence.

JULY MEETING CANCELED
BE ADVISED that due to unforeseen circumstances unrelated to the
matters raised in the Code Enforcement Agenda the July 9, 2024, City
of Okeechobee Code Enforcement Special Magistrate Hearing had to
be canceled.
Code Enforcement Cases scheduled to be heard at the July 9, 2024,
Hearing, as provided on the posted Agenda, will be postponed to the
next Hearing date, August 13, 2024, at 6 PM, or as soon thereafter as
possible at City Hall, 55 SE 3rd AVE, Okeechobee, FL 34974.
The public is invited to attend and be heard on all matters. Copies
of the agenda will be available at the Hearing or may be viewed/
downloaded prior to the Hearing from the website https://www.

BE ADVISED that should you intend to show any document, picture, video, or
items to the Special Magistrate in support or opposition to any item on the agenda,
