No Summary: • To comply with City ordinances, the property owner needs to complete repairs to the roofs of the apartment buildings and maintain the grounds of the property. City Recommendation: Within fifteen days of this hearing, the property owners shall have a licensed roofer provide evidence that the remaining four roofs are not leaking and do not need remediation. Once the evidence is received the City will consider the property to be compliant and the daily fine will stop accruing. The Property Owner can then apply for a Fine reduction for the existing fines. Thereafter, the property owners shall have a licensed roofer provide twice annual evidence that the remaining four roofs are not leaking and do not need remediation while waiting for replacement in 2025 & 2026. Failure to comply with the required inspections will result in non-compliance and the City will pursue a new case. August 3, 2023 Code Officer Smith inspected the property; still non-compliant, the siding on the building in need of being replaced, exterior of the apartment building in need of maintenance and cleaning and roof repairs. August 17, 2023 Code Officer Smith inspected the property; still non-compliant, the siding remains an issue along the maintenance and cleaning of the building and mattresses and furniture on the side of the road. October 4, 2023 Ramsey James (General Manager) 352-257-0032 called in and spoke to Code Officer Smith and he was advised how long he had to bring the property into compliance before fines start to accrue. Code Officer Smith inspected the property; still non-compliant; the outside buildings had been pressured wash and the siding had been repaired on the gable of the buildings; however, trash/debris has been left around the dumpster and on the property in 2 areas and the exterior of the dumpster area need to be cleaned as well. October 10, 2023 Case presented to the Special Magistrate,found to be in violation of Chapter 30, Sections 30- 43 Public nuisances, 30-44 General cleaning and beautification, IPMC Chapter 3, Section 304.1.1 Unsafe conditions.A fine of$100.00 per day, plus a$50.00 one-time administrative fee imposed to begin 45 days after this hearing. Ruling deferred pending reinspection of the property within two days to verify that there are no other outstanding violations on the property other than the roofs on the apartment buildings, and at that point the respondents would have 45 days to provide proof of signed contracts for the roof repairs. November 20, 2023 Received an email from Jim Ramsey with the bid for the roofs to get repaired. Copy of the bid was placed in the file. November 27, 2023 Code Officers Smith and Curl received a call from Mr. Jim Ramsey inquiring about the lien/order he received in the mail. It was explained to him that as long as the property remains compliant and there is a contract in place for the roofs to be replaced and work started the property would remain in compliance and no fine would accrue, however if no contract is received then fine accrual would begin. February 13, 2024 Received a letter from Benjamin D.E. Falk, General Partner's Vice President & CFO for Tanglewood, LTD, 500 S Florida Ave, Suite 700, Lakeland, FL. 3801 requesting a pause to the amounts already accrued and for additional time to be provided in order to secure the funds needed to replace the roofs and to break the project into three sections and set new timelines for completion of the roofs and repairs for buildings in each section where fines would be delayed and based on new timeline. Letter placed in the file. February 15, 2024 SOV/NOH mailed via USPS certified return receipt for the April 9, 2024, Hearing to discuss the General Partner's request for additional time to General Partner's address, the mailing address of record and the property address of record. Received by the General Partner, signature illegible on February 22, 2024. The notice sent to the property address was returned, no such number, unable to forward on February 29, 2024. The notice sent to the mailing address of record was received by Erin Wilson on February 23, 2024. February 27, 2024 Code Officer Smith/Curl inspected the property; still non-compliant, no work has begun on any of the apartments. Photos in file. April 9, 2024 The case was presented to the Special Magistrate who ruled for the Lien/Order to be recorded in public records with a lien balance of$13,750.00 and for the City Staff to make a follow up recommendation on the roof repair timeline and delay of fine accrual. Page 2 of 4 Exhibit 1 Case #230817007, Tanglewood LTD c/o A & M Properties Inc Date Document/Event April 15, 2024 Code Officer Curl received an email from Ben Falk advising that the recorded lien/order was received, however the lien/order did not reflect what was discussed at the hearing of the$100.00 per day fine being paused as long as they followed through with the contracting and completing 2 of the 6 roofs within 60-days, with the remaining roofs to be completed two roofs at a time with the next intervals at 4/9/25 for the next 2 roofs and then 4/9/26 for the final two roofs. April 16, 2024 Code Officer Curl replied to Mr. Falks email letting him know that the original order issued on October 10, 2023 was recorded and it does include all the violations that the property was found to be in violation of at the time of the hearing even though some of them were corrected after the order was issued and that the accrued fine of$13,750.00 which accrued from November 25, 2023 through April 9, 2024 will be noted on the official minutes from the hearing. The daily fine of the$100.00 has been paused per the conversation as the contract was received and the work is to be completed within 60-days of the hearing and then if the work is completed on time, it will be paused until 2025 and then 2026. Mr. Falk then asked if the lien/order could be corrected to match what was discussed at the hearing. Mr. Falk was advised that I would be reaching out to the City Attorney to see what steps we need to take. Code Officer Curl and Smith met with City Attorney Greg Hyden who advised that the city must treat all property owners the same and thus, as with any other property owner, if he/she/it can show documentation that remediation is occurring, the City does consider abatements of daily fines. In this case, two of the six buildings are under contract for a new roof. So long as those proceed expeditiously and that there is no breach of contract by the property owner, the City recommends abating the daily fines. With regard to the remaining four buildings, there is no documentation that they are being brought into compliance expeditiously and thus the City recommends the imposition of daily fines as they would with any other property owner April 24, 2024 SOV/NOH mailed via USPS certified return receipt for the May 14, 2024, Hearing to Clarify the timeline for the roof repairs and discuss the fine accrual. May 13, 2024 Email received from the Special Magistrate Azcona on Sunday May 12, 2024, asking that the hearing for May 14, 2024, be postponed due to him being in a complex trial in Vero Beach in the case of FL vs. Washburn (21CF1153) and he is unable to make it back by 6 pm. May 13, 2024 Email received from Mr. Ben Falk thanking us for the update and that they had to terminate a previous permit that was pulled on the roofs due to switching roof contractors. They worked with the building department and got the prior permit voided on 4/25. They are reaching out to OCC Quality Roofing to get an update on when they will be starting and will keep us informed. He believes we were previously provided with a copy of the contract for the first two building roof replacements. They will also get us a copy of the signed contract for the remaining roofs. Copy of email placed in the file. June 4, 2024 Received issued roof permit. Permit was issued on May 17, 2024, for apartments 19-22 & 23- 26. June 4, 2024 City Staff received an email from Mr. Ben Falk advising that the roofer as started work on the roofs and they are making good progress with photo attached. June 5, 2024 Code Officer Smith inspected the property; still non-compliant, they have started the roofs on the first two buildings. Photos in file. June 11, 2024 City Staff received emails from Mr. Ben Falk showing the first two roofs were completed and that the final inspection should be completed today. He requested to know where they currently stand now that the outstanding issues have been addressed and there is a schedule in place for the remaining roofs and if the requested revisions could be made to the recorded lien. City Staff advised Mr. Falk that the timeline, the delay/accrual of the fines, and the lien/order would be discussed in further detail at tonight's hearing, and it would be beneficial for them to have a representative attend. Staff also requested a copy of the contract for the remaining roofs. Mr. Falk sent an agreement for the remaining two buildings, which addressed the plan for the two additional buildings to be completed in 2025 and 2026 with the amounts as zero as the roofing company could not provide pricing at this time for future dates and they were unable to put half down at this time. June 11, 2024 The case was presented to the Special Magistrate who ruled to defer ruling until the next Special Magistrate Hearing on July 9, 2024, to see if the City Staff and the Respondent could come to an agreement. The case was presented to the Special Magistrate on October 10, 2023, and found to be in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification, IPMC Chapter 3, Section 304.1.1 Unsafe conditions. A fine of $100.00 per day, plus a one-time $50.00 administrative fee imposed to begin 45-days after the Hearing should the property fail to come into compliance. A Lien/Order was mailed via USPS certified return receipt on October 26, 2023. The notice was received by Erin Wilson on November 27, 2023. The City Staff received a letter from Benjamin D.E. Falk, General Partner's Vice President, and CFO with Tanglewood requesting a pause to the amounts already accrued and to set new timelines for completion of the roofs on February 13, 2024. A SOV/NOH was mailed via USPS certified return receipt on February 15, 2024. The notice was received by Erin Wilson on February 23, 2024. The property was inspected and found to be non-compliant on February 27, 2024,and April 2.2024. To comply with City Ordinances the property owner needs to replace the roofs on all buildings. Mr. Falk appeared before the Special Magistrate and conveyed his explanations and reasonings for why the property was non-compliant. Rutherford. 501 SE 6'h ST, Okeechobee [Legal Description: Lots 20 and 21 of Block E, CENTRAL PARK, PB 2, PG 39, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30. Sections 30-43 Public nuisances. 30-44 General cleaning and beautification, IPMC Chapter 3, Section 304.1 General. The respondent is not a repeat violator. A Courtesy Card was mailed via USPS regular mail on August 17, 2023. The property was inspected and found to be non-compliant on February 12,2024.A SOV/NOH was mailed via USPS certified return receipt on February 15, 2024. The notice was returned on March 8, 2024. The property was inspected and found to be non-compliant on March 11, 2024. A SOV/NOH was mailed via USPS regular mail, and A Notice to Appear was posted on the property and the Public Notices Board at City Hall on March 14, 2024. The City Staff received a contract for the sale of the property on March 28, 2024. Hayes, Jr., and Crystal L. Staton, 1002 NW 6th ST, Okeechobee [Legal Description: Lot 17 and West half of Lot 18 of Block 17, NORTHWEST ADDITION TO OKEECHOBEE, PB 1, PG 25, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-41 Disabled vehicles, 30- 43 Public nuisances, 30-44 General cleaning and beautification.
