CALL TO ORDER Chairperson Hoover called the regular meeting of the Board of Adjustment for the City of Okeechobee to order on Thursday, July 18, 2024, at 6:00 P.M. in the City Council Chambers, located at 55 Southeast (SE) 3rd Avenue, Room 200, Okeechobee, Florida (FL), followed by the Pledge of Allegiance. II. ATTENDANCE Roll was taken by Board Secretary Patty Burnette. Chairperson Dawn Hoover, Vice Chairperson Doug McCoy, Board Members Carl Berlin, Jr., Karyne Brass and Jim Shaw were present. Board Member Phil Baughman and Alternate Board Member Jon Folbrecht were absent with consent, and Board Member Mac Jonassaint was absent without consent. III. AGENDA A. There were no items added, deferred, or withdrawn from the agenda. B. Motion by Vice Chairperson McCoy, seconded by Member Brass, to approve the agenda as presented. Motion Carried Unanimously. C. There were no comment cards submitted for public participation for issues not on the agenda. IV. MINUTES A. Motion by Member Brass, seconded by Vice Chairperson McCoy to dispense with the reading and approve the January 18, 2024, Board of Adjustment Regular Meeting minutes [as presented in Exhibit 1]. Motion Carried Unanimously. V. CHAIRPERSON HOOVER OPENED THE QUASI-JUDICIAL PUBLIC HEARING AT 6:02 P.M. A. Special Exception Petition No. 24-003-SE requests to allow a drive-through service in Heavy Commercial Zoning District, (Ref. Code Sec. 90-283(1)), located at 100 SE 81 Avenue, for the purpose of developing the property into a new 7 Brew Drive-Thru Coffe Shop. 1. Notary Public Patty Burnette administered an oath to Mr. Ben Smith, Morris-Depew Associates Inc., 2914 Cleveland Avenue, Fort Myers, FL, Mr. Chris Ossa, PE Kimley-Horn, 7341 Office Park Place, Suite 102, Melbourne, FL, and Ms. Shey Anderson, Real Estate Manager, Brew Horizons LLC, 2183 Highland Avenue #101, Melbourne, FL, who responded affirmatively. 2. City Planning Consultant Mr. Ben Smith briefly reviewed the Planning Staff Report recommending approval. He suggested possibly adding a condition that should any substantial changes to the Site Plan be needed due to the review by the Technical Review Committee, that then this Petition possibly come back for review by this Board. 3. Mr. Chris Ossa and Ms. Shey Anderson were present on behalf of the Applicant, Mr. Dennis Proto, Brew Horizons, LLC. Chairperson Hoover, Vice Chairperson McCoy and Board Members Brass and Shaw voiced concerns regarding stacking of traffic, dumpster location and vehicle headlights that would be directed to the residential property to the South. 4. No public comments were offered. Secretary Burnette stated for the record eight courtesy notices were mailed to the surrounding property owners, advertisements and two signs were properly posted, with no objections or comments received t date. 5. No Ex-Parte disclosures were offered. 6. Motion by Member Brass, seconded by Member Shaw, to continue Special Exception Petition No. 24-003-SE as presented in [Exhibit 2] to the September 19, 2024, meeting and to have the Applicant address how the proposed use would not create traffic congestion as required by Land Development Regulations Section 70-373(c) response to the list of findings number eight.
