I have reviewed the site for your proposed right of way use located per the legal description you
provided to the City:
That portion of alley lying between and adjacent to Lot 3 and Lot 10, Block 78,Okeechobee,
according to the plat thereof recorded in plat book 5 at page 5 of the public records of
Okeechobee County, Florida. Said portion of alley being bounded on the West by the extension
of the West line of said Lot 3 and 10 and bounded on the East by the extension of the East line of
said Lot 3 and 10.
The City has no objection to the use agreement contingent on receiving letters stating no objections
from the Okeechobee Utility Authority, Flower Power and Light, CenturyLink, and Comcast utilities.

DEFAULT JUDGMENT TO QUIET TITLE
THIS CAUSE was considered upon Plaintiff's Motion for Default Judgment to Quiet
Title filed on October 14, 2022. The Court, having reviewed Plaintiffs Motion and the
court docket, which reflects all defendants have been served and defaulted due to not
filing a response, and.
THE COURT, having considered the grounds for the Motion and considering the
applicable law, has FOUND:
Procedural History
1. Plaintiff filed this quiet title action on August 8, 2022, to quiet title on real
property (the "Property"), legally described as:

Lot 9 and 10, Block 78, City of Okeechobee, according to the map or plat
thereof, as recorded in Plat Book 5, Page 5 of the Public Records of
Okeechobee County, Florida.
Plaintiff purchased the Property on June 7, 2022.
2. This action was filed pursuant to s.65.061(2), Fla. Stat. (2022).
3. Defendants were served via publication. Proof of same has been filed with
the Court on September 15, 2022. Per the aforementioned statute, the appointment of a
guardian ad litem is not required.
4. No one has filed any response on behalf of the Defendants.
5. A Clerk's Default was entered on October 11, 2022.
6. As alleged in the complaint, SHIRLEY CAROL LONGSTON f/k/a SHIRLEY
SPAN, was the sole owner of the Property from July 27. 1968 until she passed away on
November 9, 1989.
7. As alleged in the complaint the current cloud on title was caused by
SHIRLEY CAROL LONGSTON'S now deceased adult son, Donald Spann. On
September 13, 1990, Donald Spann, without a probate order or legal title, quit claimed
his deceased mother's Property to various purchasers.
8. Since that time, the Property has been conveyed numerous times
culminating in Plaintiff's ownership.
9 Notwithstanding the multiple transfers, Defendant, SHIRELY CAROL
LONGSTON a/k/a SHIRLEY SPANN is still on title to the Property.
10 SHIRLEY CAROL LONGSTON, who died on November 9, 1989, was
unmarried and left behind one heir, an adult son named Donald Spann who died on
September 2, 2018. There are no known heirs to SHIRLEY CAROL LONGSTON and
any interest the now deceased Donald Spann may have had was quit claimed away by
him in 1990.
11. Plaintiff, who owns and is in possession of the subject property, seeks a
judgment to quiet title.
12. It is well settled that the effect of a default, if any, is that the defaulting party
admits all well plead allegations of the complaint. Rich v. Spivey, 922 So.2d 326 (Fla. 2d
DCA 2006)
THEREFORE, IT IS ORDERED AND ADJUDGED as follows:
A. Plaintiffs Motion is GRANTED. Plaintiff, 608 OKEECHOBEE, LLC, a
Florida Limited Liability Company is the owner of the real property described
above and is entitled to the sole possession.
B. Plaintiffs title is superior in dignity to any title, right or interest in any of the
Defendants.
C. Defendants and all persons claiming under said Defendants, are
permanently enjoined from asserting any estate, right, title, lien, or interest
in or to the real property or any part of the property.
DONE AND ORDERED in Okeechobee, Okeechobee County, Florida this

Okeechobee, FL, passed away on
March 16, 2020. She was born in
91
Coloma, MI on January 23, 1940.
She is preceded in death by her parents,
Arthur and Rachel Franklin, also her
late husband, Robert "Bud" Parker, all
of MO.
She is survived by her husband, Bill Kinney of Okeechobee, FL, sister,
Barbara Rokiski of Desloge, MO, along with three children, Wes Damos
of Park Hills, MO, Tona and (Randy Wood) of Farmington, MO, and
Robbie Parker of Okeechobee, FL, several grandchildren, one nephew,
and three stepchildren, Bill (Gwen) Kinney, David (Joyce) Kinney, and
Steve Kinney.
She had a very energetic personality and loved to dress to impress.
There's a possibility she could have gotten that flair after meeting Elvis
Presley and following his performances.
She will be dearly missed by all who had the chance to know and love
her.
A Celebration of Life will take place Saturday, March 21st at 10:00am in
the backyard at 1911 SE 24th Blvd in Okeechobee.

To Whom it May Concern:
The Okeechobee Utility Authority (OUA) has reviewed your request for Use of Alley License
Agreement, as referenced above.
OUA has a water main lying in the alleyway between Lots 3 and 10.
OUA has a waste water main lying in the alleyway between Lots 3 and 10.
The OUA has no objections to the application with the understanding that should the OUA need
access to the OUA infrastructure, the repair of the paved area will be at the expense of the
applicant/property owner, not the OUA.
