I. CALL TO ORDER
Chairperson Hoover called the regular meeting of the Planning Board for the City of
Okeechobee to order on Thursday, October 19, 2023, at is P.M. in the City Council
Chambers, located at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida.

V. CHAIRPERSON HOOVER OPENED THE PUBLIC HEARING AT P.M.
A. Abandonment of Right-of-Way Petition No. 23-002-AC, requests to vacate the portion
of the 15 feet wide alleyway lying South to North between Lots 3 to 6 and 9 to 12 of
Block 34, FIRST ADDITION TO SOUTH OKEEECHOBEE, Plat Book 1, Page 17, public
records of Okeechobee County - City Planning Consultant (Exhibit 1).
1. City Planning Consultant Mr. Ben Smith of Morris-Depew Associates, Inc. reviewed the
Planning Staff Report. The portion of the alleyway subject to the request is 15 feet wide
by 199.58 feet long, totaling 2,994 square feet (0.07 acres). The Northern portion of the
right of way was previously vacated in Official Record Book 499, Page 506, and the
remaining portion of the alleyway is currently designated as public right-of-way. The
Applicant has identified that the two parcels bounding the alleyway to the East will
absorb the acreage from the abandonment. The adjacent property owner has provided
a signed letter of no objection to the request.

V. PUBLIC HEARING ITEM A CONTINUED
Planning Staff's responses to the required findings are proposed vacation is consistent
with LDR Section 78-33; right-of-way to be vacated is not the sole access to any
property, the alleyway has not been improved to facilitate vehicle travel and vacating the
right-of-way will transfer maintenance responsibilities to the current property owners
increasing the tax basis; and finally, no utilities or utility easements are located within
the subject right-of-way. The Applicant has received authorization from all necessary
utility entities. Planning Staff is recommending approval based on these findings.

for November 7, 2023, and December 5, 2023.
